AN ACT concerning 1

State Procurement – Preferences – Francis Scott Key Bridge Reconstruction 2

FOR the purpose of establishing a certain procurement preference in the purchase of 3
supplies or services for State contracts related to the recon struction of the Francis 4
Scott Key Bridge for certain vendors; and generally relating to the Francis Scott Key 5
Bridge reconstruction and State procurement preferences. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12
That the Laws of Maryland read as follows: 13

Article – State Finance and Procurement 14

14–419. 15

(A) IN THIS SECTION, “LOCAL VENDOR” MEANS A VENDOR LOCATED IN THE 16
6TH LEGISLATIVE DISTRICT. 17

(B) THIS SECTION APPLIES ONLY TO STATE CONTRACTS RELATED TO THE 18
RECONSTRUCTION OF THE FRANCIS SCOTT KEY BRIDGE. 19

(C) A UNIT SHALL GIVE PREF ERENCE IN THE PURCHA SE OF SUPPLIES OR 20
SERVICES TO A LOCAL VENDOR AS REQUIRED UNDER SU BSECTION (D) OF THIS 21
SECTION. 22

(D) (1) IF A UNIT AWARDS A CO NTRACT USING COMPETI TIVE SEALED 1
BIDS UNDER § 13–103 OF THIS ARTICLE, THE UNIT SHALL AWARD THE CONTRACT TO 2
A LOCAL VENDOR IF THE LOCAL VENDOR: 3

(I) SUBMITS THE LOWEST RESPONSIVE BID; OR 4

(II) DOES NOT SUBMIT THE LOWEST RESPONSIVE BID, BUT THE 5
DIFFERENCE BETWEEN THE LOCAL VENDOR BID AND THE LOWEST RESPONSIVE BID 6
SUBMITTED BY A NONLOCAL VENDOR DOES NOT EXCEED 10%. 7

(2) IF A UNIT AWARDS A CO NTRACT USING COMP ETITIVE SEALED 8
PROPOSALS UNDER § 13–104 OF THIS ARTICLE , THE UNIT SHALL AWARD THE 9
CONTRACT TO A LOCAL VENDOR IF THE LOCAL VENDOR: 10

(I) SUBMITS THE RESPONSI VE PROPOSAL THAT IS MOS T 11
ADVANTAGEOUS TO THE UNIT; OR 12

(II) DOES NOT SUBMIT THE RESPONSIVE PROPOSAL THAT IS 13
MOST ADVANTAGEOUS TO THE UNIT , BUT THE DIFFERENCE BETWEEN THE 14
PROPOSAL SUBMITTED BY THE LOC AL VENDOR AND THE LOWEST RESPO NSIVE 15
PROPOSAL SUBMITTED BY A NONLOCAL VENDOR DOES NOT EXCEED 10%. 16

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 17
1, 2026. 18
