Requirements 3

FOR the purpose of requiring each public high school in the State to maintain an injury log 4
for injuries that occur during school athletic activities, subject to certain 5
requirements; requiring each local school system to submit a report of high school 6
athletic injuries to the State Department of Education on or before a certain date 7
each year; and generally relating to the recordkeeping and reporting of sports 8
injuries at public high school athletic activities. 9

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15
That the Laws of Maryland read as follows: 16

2 HOUSE BILL 1097

(A) EACH PUBLIC HIGH SCHO OL IN THE STATE SHALL MAINTAIN A 1
STANDARDIZED INJURY LOG FOR ALL INJURIES THAT OCCUR DURING AT HLETIC 2
ACTIVITIES CONDUCTED BY THE SCHOOL. 3

(B) AN INJURY LOG REQUIRE D UNDER SUBSECTION (A) OF THIS SECTION 4
SHALL INCLUDE, AT A MINIMUM: 5

(1) THE DATE AND TIME OF THE INJURY; 6

(2) THE SPORT OR ACTIVITY DURING WHICH THE INJURY OCCURRED; 7

(3) A GENERAL DESCRIPTION OF THE INJURY, INCLUDING THE BODY 8
PART AFFECTED; 9

(4) WHETHER THE INJURY OCCURRED DURING A PR ACTICE, 10
COMPETITION, OR CONDITIONING ACTIVITY; 11

(5) WHETHER THE STUDENT W AS REMOVED FROM THE SPORT OR 12
ACTIVITY AND, IF KNOWN, THE DURATION OF REMOVAL; 13

(6) WHETHER MEDICAL EVALUATION OR TREATMENT WAS PROVIDED 14
OR RECOMMENDED; AND 15

(7) THE ROLE OF THE INDIVIDUAL DOCUMENTING THE INJURY; AND 16

(8) IF APPLICABLE , A DATE ON WHICH THE INJURED STUDENT IS 17
AUTHORIZED TO RETURN TO THE ACTIVITY. 18

(C) (1) THE INDIVIDUAL DOCUMENTING THE INJURY SHA LL DOCUMENT 19
THE INJURY NOT LATER THAN 24 HOURS AFTER THE INJURY IS OBSERVED OR 20
REPORTED. 21

(2) A COACH, CERTIFIED ATHLETIC T RAINER, SCHOOL NURSE , OR 22
OTHER DESIGNATED SCH OOL PERSONNEL MAY CO MPLETE THE DOCUMENTA TION 23
REQUIRED UNDER THIS SECTION. 24

(D) EACH SCHOOL SHALL RETAIN INJURY LOGS FOR A MINIMUM OF 5 YEARS 25
AND MAKE THE LOGS AVAILABLE ON REQUEST BY THE LOCAL SCHOOL SYSTEM AND 26
THE DEPARTMENT FOR COMPLIANCE AND SAFETY REVIEW PURPOSES. 27

(E) (1) ON OR BEFORE JULY 1, 2027, AND EACH JULY 1 THEREAFTER, 28
EACH LOCAL SCHOOL SY STEM SHALL SUBMIT AN AGGREGATED REPORT OF HIGH 29
HOUSE BILL 1097 3

SCHOOL ATHLETIC INJURIES FOR THE IMMEDIATELY PRECEDING SCHOOL YEAR TO 1
THE DEPARTMENT IN A MANNER PRESCRIBED BY THE DEPARTMENT. 2

(2) THE LOCAL SCHOOL SYST EM MAY NOT INCLUDE I NDIVIDUAL 3
STUDENT–IDENTIFYING INFORMATION IN THE REPORT. 4

(F) EACH PUBLIC HIGH SCHOOL S HALL MAINTAIN INJURY LOGS AND 5
REPORTS UNDER THIS SECTION IN COMPLIANCE WITH ALL APPLICABLE STATE AND 6
FEDERAL STUDENT PRIV ACY LAWS , INCLUDING THE FEDERA L FAMILY 7
EDUCATIONAL RIGHTS AND PRIVACY ACT. 8

(G) THE DEPARTMENT, IN COLLABORATION W ITH THE MARYLAND 9
DEPARTMENT OF HEALTH, THE MARYLAND ATHLETIC TRAINERS’ ASSOCIATION, 10
AND THE MARYLAND PUBLIC SECONDARY SCHOOLS ATHLETIC ASSOCIATION, MAY 11
ADOPT REGULATIONS AN D STANDARDIZED REPOR TING FORMS NECESSARY TO 12
IMPLEMENT THIS SECTION. 13

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 14
1, 2026. 15
