AN ACT concerning 1

Baltimore County Board of Education – Membership – Alterations 2

FOR the purpose of altering the membership of the Baltimore County Board of Education 3
to be composed of nine members elected from each of the nine councilmanic districts 4
of Baltimore County as they exist after a certain date and two appointed members 5
at large beginning with a certain election; and genera lly relating to the Baltimore 6
County Board of Education. 7

SECTION 1. BE IT ENACTED BY THE GENE RAL ASSEMBLY OF MARYLAND, 13
That the Laws of Maryland read as follows: 14

Article – Education 15

3–2B–01. 16

(a) (1) [The] BEFORE THE 2030 GENERAL ELECTION , THE Baltimore 17
County Board of Education consists of: 18

[(1)] (I) Seven nonpartisan elected members; 19

[(2)] (II) Four appointed members; and 1

[(3)] (III) One student member. 2

(2) BEGINNING WITH THE 2030 GENERAL ELECTION , THE 3
BALTIMORE COUNTY BOARD OF EDUCATION CONSISTS OF: 4

(I) NINE NONPARTISAN ELECTED MEMBERS; 5

(II) TWO APPOINTED MEMBERS; AND 6

(III) ONE STUDENT MEMBER. 7

(b) (1) (I) BEFORE THE 2030 GENERAL ELECTION, THE ELECTED AND 8
APPOINTED MEMBERS OF THE COUNTY BOARD ARE ELECTED AND APPOINTE D IN 9
ACCORDANCE WITH THIS PARAGRAPH. 10

(II) Of the 11 elected and appointed members of the county board: 11

[(i)] 1. One member shall be elected from each of the seven 12
councilmanic districts in the county, established by the County Council of Baltimore 13
County, by the voters of that district; and 14

[(ii)] 2. Four members shall be appointed by the Gov ernor from 15
the county at large. 16

[(2) (i)] (III) 1. The seven elected members shall be elected at a 17
general election in gubernatorial election years in accordance with § 3 –2B–02 of this 18
subtitle. 19

[(ii)] 2. The four appointed members shall be appointe d by the 20
Governor in presidential election years from a list of nominees submitted by the Baltimore 21
County School Board Nominating Commission as provided in § 3–2B–03 of this subtitle: 22

[1.] A. On the expiration of the term of an incumbent 23
appointed member within 30 days after the general election; or 24

[2.] B. Within the 30–day period otherwise required under 25
this subtitle. 26

(2) (I) BEGINNING WITH THE 2030 GENERAL ELECTION , THE 27
ELECTED AND APPOINTE D MEMBERS OF THE COU NTY BOARD ARE ELECTE D AND 28
APPOINTED IN ACCORDANCE WITH THIS PARAGRAPH. 29

(II) OF THE 11 ELECTED AND APPOINTE D MEMBERS OF THE 1
COUNTY BOARD: 2

1. ONE MEMBER SHALL BE ELECTED FROM EACH OF THE 3
NINE COUNCILMANIC DISTRICTS IN THE COUNTY BY THE VOTERS OF THAT DISTRICT; 4
AND 5

2. TWO MEMBERS SHALL BE APPOINTED BY THE 6
GOVERNOR FROM THE COUNTY AT LARGE. 7

(III) 1. THE NINE ELECTED MEMBERS SHALL BE ELECTED AT 8
A GENERAL ELECTION IN GUBERNATORIAL ELECTION YEARS IN ACCORDANCE WITH 9
§ 3–2B–02 OF THIS SUBTITLE. 10

2. THE TWO APPOINTED MEM BERS SHALL BE 11
APPOINTED BY THE GOVERNOR IN PRESIDENTIAL ELECTION YEARS FROM A LIST OF 12
NOMINEES SUBMITTED BY THE BALTIMORE COUNTY SCHOOL BOARD NOMINATING 13
COMMISSION AS PROVIDED IN § 3–2B–03 OF THIS SUBTITLE: 14

A. ON THE EXPIRATION OF THE TERM OF AN INCUMBENT 15
APPOINTED MEMBER WITHIN 30 DAYS AFTER THE GENERAL ELECTION; OR 16

B. WITHIN THE 30–DAY PERIOD OTHERWISE REQUIRED 17
UNDER THIS SUBTITLE. 18

(3) (i) A member from a [school board] COUNCILMANIC district shall 19
be at least 21 years old, a resident of that district for at least 2 years, and a registered voter 20
of the county before the election. 21

(ii) A member from a district who does not maintain residency in 22
that district may not continue as a member of the county board and the office shall be 23
deemed vacant. 24

(iii) If the boundary line of a district is changed, the term of an 25
incumbent member of the county board who no longer resides in the district because of the 26
change is not affected during this term. 27

(4) (i) A member may not be elected or appointed to serve on the county 28
board for more than three consecutive terms. 29

(ii) A member who has served three consecutive 4 –year terms may 30
not be elected or appointed to the county board until at least 4 years have elapsed since the 31
end of the member’s last term on the county board. 32

(5) During an election year: 33

(i) The Governor may not appoint as a member of the county board 1
an individual who files a certificate of candidacy for election to the county board; and 2

(ii) An individual who files a certificate of candidacy for election to 3
the county board may not seek appointment to the county board by the Governor through 4
nomination by the Baltimore County School Board Nominating Commission. 5

SECTION 2. AND BE IT FURTHER ENACTED, That of the four members 6
appointed to the Baltimore County Board of Education in 2028: 7

(1) The terms of two members shall terminate in 2030; and 8

(2) The terms of two members shall terminate in 2032. 9

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 10
October 1, 2026. 11
