Calvert County – Procurement – Long–Term Contracts for Infrastructure and 2
Asset Management 3
FOR the purpose of authorizing Calvert County to enter into certain contracts for 4
infrastructure and asset management under certain circumstances; and generally 5
relating to procurement in Calvert County. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEM BLY OF MARYLAND, 13
That the Laws of Maryland read as follows: 14
Article 5 – Calvert County 15
6–103. 16
(a) When it is advantageous to the county to do so, the county may contract to 17
purchase supplies or services for periods of more than one year if: 18

(1) Funds for the total cost of the contract are available at the time the 1
contract is executed; or 2
(2) Subject to Subsection (c) of this section, a contract requiring the 3
payment of funds from appropriations of more than one fiscal year is approved by resolution 4
of the Commissioners. 5
(b) Notwithstanding Subsection (a) of this section, the County may enter into a 6
contract for solid waste disposal that: 7
(1) May include transportation; 8
(2) May require payment of funds from appropriations of the Cou nty or 9
receipt of payment to the County; and 10
(3) Is not for more than a twenty–year initial term. 11
(c) A contract requiring the payment of funds from appropriations of more than 12
one fiscal year, approved by resolution of the Commissioners, shall be awarded as: 13
(1) A one–year contract with the option to renew for not more than four 14
one–year terms for a contract that is not governed by item (2) of this Subsection; or 15
(2) A multiyear contract for a period not to exceed 20 years, including the 16
initial contract term and all options, if the contract is for: 17
(i) Banking and investment services; 18
(ii) Retirement and pension system management; 19
(iii) Health insurance; or 20
(iv) Information technology, including software and the provision of 21
voice, data, and Internet services. 22
(d) (1) Notwithstanding Subsection (a) of this section, the County may enter 23
into [a] THE FOLLOWING CONTRACTS IF THE INITIAL T ERM OF THE CONTRACT OR 24
LEASE IS NOT MORE THAN 20 YEARS: 25
(I) A contract for a cellular tower lease, including a cellular tower 26
lease on a water tower[, if the initial term of the lease is not more than 20 years]; AND 27
(II) CONTRACTS FOR INFRAST RUCTURE OR ASSET 28
MANAGEMENT PROGRAMS IF THE INFRASTRUCTURE OR ASSET HAS A LIFE CYCLE OF 29
NOT LESS THAN 15 YEARS, INCLUDING WATER TOWERS, FLOW METERS, AND OTHER 30
WATER AND SEWER ASSETS. 31

(2) A CONTRACT FOR INFRASTRUCTURE OR AN ASSET MANAGEMENT 1
PROGRAM UNDER PARAGR APH (1)(II) OF THIS SUBSECTION MAY INCLUD E THE 2
PLANNING, DESIGN, CONSTRUCTION, OPERATION, MAINTENANCE, MODIFICATION, 3
REVITALIZATION, AND DECOMMISSIONING OF THE INFRASTRUCTURE OR ASSET. 4
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 5
October 1, 2026. 6
