AN ACT concerning 1

Calvert County – Contracts for Infrastructure or Asset Management – Contract 2
Duration 3

FOR the purpose of authorizing Calvert County to enter into a contract for a certain term 4
for certain infrastructure or asset management programs; and generally relating to 5
contracts for infrastructure and asset management programs in Calvert County. 6

BY repealing and reenacting, without amendments, 7

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 17
That the Laws of Maryland read as follows: 18

Article 5 – Calvert County 19

2 HOUSE BILL 1158

(a) When it is advantageous to the county to do so, the county may contract to 1
purchase supplies or services for periods of more than one year if: 2

(1) Funds for the total cost of the contract are available at the time the 3
contract is executed; or 4

(2) Subject to Subsection (c) of this section, a contract requiring the 5
payment of funds from appropriations of more than one fiscal year is approved by resolution 6
of the Commissioners. 7

(E) (1) NOTWITHSTANDING SUBSECTION (A) OF THIS SECTION , THE 8
COUNTY MAY ENTER INTO A CONTRACT THAT IS FOR A TERM OF NOT MORE THAN 20 9
YEARS FOR INFRASTRUCTURE OR AS SET MANAGEMENT PROGR AMS WHERE THE 10
INFRASTRUCTURE OR AS SET HAS A LIFE CYCLE OF NOT LESS THAN 15 YEARS, 11
INCLUDING: 12

(I) WATER TOWERS; 13

(II) FLOW METERS; AND 14

(III) ANY OTHER WATER AND SEWER ASSETS. 15

(2) AN INFRASTRUCTURE OR ASSET MANAGEMENT PROGRAM UNDER 16
PARAGRAPH (1) OF THIS SUBSECTION MAY INCLUD E PLANNING , DESIGN, 17
CONSTRUCTION, OPERATION, MAINTENANCE, MODIFICATION, REVITALIZATION, 18
AND DECOMMISSIONING OF QUALIFYING INFRASTRUCTURE OR ASSETS. 19

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 20
October 1, 2026. 21
