FOR the purpose of prohibiting certain nonprofit organizations from aiding or abetting 5
certain activity by the government of Israel or a citizen of Israel; authorizing the 6
Attorney General or a certain person to bring a certain action against a nonprofit 7
organization that violates this Act; requiring the Secretary of State to remove a 8
nonprofit organization from the Registry of Charitable Solicitation following receipt 9
of certain notice; and generally relating to the prohibition against unauthorized 10
support of Israeli settlement activity by a nonprofit organization. 11

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18
That the Laws of Maryland read as follows: 19

(A) IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS 24

(B) “NONPROFIT ORGANIZATION” MEANS AN ORGANIZATION EXEMPT FROM 2
TAXATION UNDER § 501(C)(3) OR (4) OF THE INTERNAL REVENUE CODE. 3

(C) “OCCUPIED TERRITORY” MEANS THE ISRAELI–OCCUPIED WEST BANK, 4
INCLUDING EAST JERUSALEM. 5

(D) (1) “PROTECTED PERSONS ” MEANS INDIVIDUALS PR OTECTED 6
UNDER GENEVA CONVENTION (IV) RELATIVE TO THE PROTECTION OF CIVILIAN 7
PERSONS IN TIME OF WAR, 12 AUGUST 1949, 6 U.S.T. 3516. 8

(2) “PROTECTED PERSONS ” INCLUDES CIVIL IANS IN OCCUPIED 9
TERRITORY IN ACCORDANCE WITH INTERNATIONAL LAW. 10

(E) “UNAUTHORIZED SUPPORT OF ISRAELI SETTLEMENT ACTIVITY” MEANS 11
AIDING AND ABETTING ACTIVITY OF THE GOVERNMENT OF ISRAEL, OR A CITIZEN OF 12
ISRAEL, THAT IS BANNED UNDER THE GENEVA CONVENTIONS SIGNED AUGUST 12, 13
1949, AS AMENDED, AND THEIR ADDITIONAL PROTOCOLS, TO WHICH THE UNITED 14
STATES IS A PARTY, INCLUDING THE FOLLOWING ACTIVITY: 15

(1) THE UNLAWFUL TRANSFER OF ISRAELI CIVILIANS INT O 16
OCCUPIED TERRITORY; 17

(2) ACTS OF VIOLENCE AGAI NST PROTECTED PERSONS BY CITIZE NS 18
OF ISRAEL LIVING IN OCCUPIED TERRITORIES, INCLUDING: 19

(I) ABDUCTION; 20

(II) MURDER; 21

(III) ASSAULT; 22

(IV) ARSON; AND 23

(V) THE COMMISSION OF ANY ACT DESCRIBED IN ITE MS (I) 24

WITHIN OCCUPIED TERR ITORY, OR THE DEPORTATION O F PROTECTED PERSONS 14
FROM OCCUPIED TERRITORY; AND 15

(6) THE DESTRUCTION OF IN FRASTRUCTURE WITHIN OCCUPIED 16
TERRITORY INCLUDING THE DESTRUCTION OF: 17

(I) HOSPITALS AND OTHER MEDICAL FACILITIES; 18

(II) WATER AND SEWAGE SYSTEM ELEMENTS; 19

(III) ELECTRICAL LINES; 20

(IV) ROADS; 21

(V) SCHOOLS; AND 22

(A) A NONPROFIT ORGANIZATION REGISTERED WITH T HE SECRETARY OF 25

STATE TO SOLICIT CHAR ITABLE DONATIONS IN THE STATE MAY NOT KNOWING LY 1
ENGAGE IN UNAUTHORIZED SUPPORT OF ISRAELI SETTLEMENT ACTIVITY. 2

(B) (1) THE ATTORNEY GENERAL MAY BRING AN ACTION FOR 3
INJUNCTIVE RELIEF AN D DAMAGES ON BEHALF OF THE STATE OR ANY OF ITS 4
POLITICAL SUBDIVISIO NS AGAINST A DIRECTO R, AN OFFICER , A PARTNER , A 5
TRUSTEE, A MANAGER, OR ANY OTHER AGENT OF A NONPROFIT ORGANIZATION THAT 6
VIOLATES SUBSECTION (A) OF THIS SECTION. 7

(2) IN AN ACTION FILED UN DER PARAGRAPH (1) OF THIS 8
SUBSECTION, THE ATTORNEY GENERAL MAY SEEK NOT LESS THAN $1,000,000 IN 9
DAMAGES. 10

(C) (1) A PERSON HARMED BY A VIOLATION OF SUBSECTION (A) OF THIS 11
SECTION MAY BRING AN ACTION FOR INJUNCTIVE RELIEF AND ACTUAL DA MAGES 12
AGAINST A DIRECTOR , AN OFFICER, A PARTNER, A TRUSTEE, A MANAGER, OR ANY 13
OTHER AGENT OF A NONPROFIT ORGANIZATION THAT VIOLATES SUBSECTION (A) OF 14
THIS SECTION. 15

(2) IN ADDITION TO INJUNC TIVE RELIEF AND ACTU AL D AMAGES, A 16
COURT MAY AWARD ATTORNEY’S FEES TO A PREVAILING PLAINTIFF. 17

(D) ON NOTICE FROM THE ATTORNEY GENERAL OR A PREVAILI NG 18
PLAINTIFF OF A JUDGM ENT ENTERED AGAINST A NONPROFIT ORGANIZA TION 19
UNDER THIS SECTION, THE SECRETARY OF STATE SHALL REMOVE THE NONPROFIT 20
ORGANIZATION FROM THE REGISTRY OF CHARITABLE SOLICITATION. 21

(E) AN ACTION UNDER THIS SECTION: 22

(1) MAY BE BROUGHT IN ANY COUNTY IN THE STATE; AND 23

(2) SHALL BE FILED WITHIN 10 YEARS AFTER THE DATE OF THE 24
OCCURRENCE OF THE ACT ON WHICH THE CLAIM IS BASED. 25

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 26
October 1, 2026. 27
