SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 9
That the Laws of Maryland read as follows: 10

Article – Agriculture 11

11–101. 12

(a) In this title the following words have the meanings indicated. 13

(l) “Weight and measure” means any instrument or device used for weighing or 14
measuring, and any appliance or accessory associated with any instrument or device used 15
for weighing or measuring. 16

11–204. 17

(a) (1) IN THIS SECTION THE F OLLOWING WORDS HAVE THE MEANINGS 18
INDICATED. 19

(2) “MASS–PRODUCED DEVICE ” MEANS A DEVICE PRODU CED BY 20
MEANS OF A MOLD OR DIE AND NOT SUSCEPTIBLE OF INDIVIDUAL ADJUSTMENT. 21

(3) “SINGLE–SERVICE DEVICE ” MEANS A DEVICE DESIG NED TO BE 22
USED COMMERCIALLY ONLY ONCE AND THEN DISCARDED. 23

(B) [Upon the] ON request of any competent State authority, the Secretary may 24
inspect and test any weight and measure. 25

[(b)] (C) (1) Unless otherwise provided, the Secretary may inspect and test to 26
ascertain if they are correct, every weight and measure possessed, offere d, or exposed for 27
sale. 28

(2) The Secretary shall inspect and test every weight and measure 29
commercially used in determining: 30

[(1)] (I) The weight, measurement, or count of any commodity sold, or 31
offered or exposed for sale, on the basis of weight, measure, or count; 32

[(2)] (II) Any charge or payment for services rendered on the basis of 1
weight, measure, or count; and 2

[(3)] (III) Weight, measurement, or count when a charge is made for the 3
determination. 4

[(c)] (D) (1) The Secretary may test wit h representative samples any 5
single–service device or mass–produced device. 6

(2) The lot of which any sample is representative shall be held to be correct 7
or incorrect [upon] ON the basis of the results of the inspections and tests on the samples. 8
[For the purposes of this section, a single –service device is a device designed to be used 9
commercially only once and then discarded; and a mass –produced device is a device 10
produced by means of a mold or die and not susceptible of individual adjustment.] 11

[(d)] (E) The Secretary shall conduct inspections as provided in a memorandum 12
of understanding on behalf of and in coordination with other agencies when performing 13
weights and measures inspections at gasoline retailing operations. 14

(F) FUNDING FOR THE PURCHASE OF EQUIPMENT NECESSARY TO INSPECT 15
A WEIGHT AND MEASURE USED FOR THE RETAIL SALE OF ELECTRICITY AS A MOTOR 16
FUEL SHALL BE PROVIDED FR OM THE MARYLAND STRATEGIC ENERGY 17
INVESTMENT FUND ESTABLISHED UNDER § 9–20B–05 OF THE STATE GOVERNMENT 18
ARTICLE. 19

(A) [The] SUBJECT TO SUBSECTION (B) OF THIS SECTION, THE Secretary may 21
set reasonable fees for registering each weight and measure used for commercial purposes 22
under this subtitle. 23

(B) THE PER PORT FEE FOR REGISTERING A WE IGHT AND MEASURE USE D 24
FOR THE RETAIL SALE OF ELECTRICITY AS A MOTOR FUEL MAY NOT EXCEED THE 25
FEE CHARGED PER METER FOR A RETAIL MOTOR FUEL DISPENSER METER. 26

(a) There is a Maryland Strategic Energy Investment Fund. 29

(f) The Administration shall use the Fund: 30

(13) notwithstanding subsection (g) of this section, to pay costs associated 1
with the Air and Radiation Administration within the Department of the Environment; 2
[and] 3

(14) TO PAY COSTS ASSOCIATED WITH THE INSPECTION AND TESTING 4
OF WEIGHTS AND MEASU RES USED FOR THE RET AIL SALE OF ELECTRIC ITY AS A 5
MOTOR FUEL UNDER § 11–204 OF THE AGRICULTURE ARTICLE; AND 6

[(14)] (15) to pay the expenses of the Program. 7

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 8
1, 2026. 9
