AN ACT concerning 1

State Government – Data–Sharing Agreements and Personal Identifying 2
Information – Prohibition and Reporting 3
(Maryland Data Privacy and Federal Shield Act) 4

FOR the purpose of requiring the Attorney General to submit a certain report on 5
data–sharing agreements between the State or a unit of local government and the 6
federal government; prohibiting certain individuals or agencies from providing 7
certain information or assisting in the establishment or maintenance of a certain 8
registry under certain circumstances; and generally relating to data and information 9
privacy. 10

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 16
That the Laws of Maryland read as follows: 17

Article – State Government 18

(A) ON OR BEFORE JANUARY 1, 2027, AND EACH JANUARY 1 THEREAFTER, 20
THE ATTORNEY GENERAL SHALL SUBMIT A REPORT ON STATE DATA –SHARING 21
AGREEMENTS WITH THE FEDERAL GOVERNMENT TO THE GOVERNOR AND , IN 22
ACCORDANCE WITH § 2–1257 OF THIS ARTICLE, THE GENERAL ASSEMBLY. 23

(B) THE REPORT REQUIRED UNDER SUBSECTION (A) OF THIS SECTION 1
SHALL: 2

(1) IDENTIFY ALL CURRENT DATA–SHARING AGREEMENTS BETWEEN 3
THE STATE OR A UNIT OF LOCAL GOVERNMENT AND THE FEDERAL GOVERNMENT; 4

(2) DETERMINE WHETHER TH E DATA –SHARING AGREEMENT IS IN 5
COMPLIANCE WITH RELEVANT STATE OR FEDERAL PRIVACY LAWS; AND 6

(3) IF A DATA–SHARING AGREEMENT IS NOT IN COMPLIANCE WI TH 7
STATE OR FEDERAL PRIVACY LAWS, PROVIDE RECOMMENDATIONS TO BRING THE 8
AGREEMENT INTO COMPLIANCE. 9

(A) IN THIS SECTION, “PERSONAL IDENTIFYING INFORMATION” INCLUDES: 11

(1) CITIZENSHIP OR IMMIGRATION STATUS; 12

(2) RELIGIOUS AFFILIATION, BELIEF, OR OPINION; AND 13

(3) BIOMETRIC DATA, AS DEFINED IN § 14–4701 OF THE COMMERCIAL 14
LAW ARTICLE. 15

(B) UNLESS SPECIFICALLY R EQUIRED BY STATE OR FEDERAL LAW OR 16
COURT ORDER: 17

(1) THE STATE, A UNIT OF LOCAL GOVERNMENT, A COUNTY SHERIFF, 18
OR ANY OTHER AGENCY, OFFICER, EMPLOYEE, OR AGENT OF THE STATE OR A UNIT 19
OF LOCAL GOVERNMENT MAY NOT PROVIDE PERSONAL IDENTIFYING INFORMATION 20
TO THE FEDERAL GOVERN MENT, INCLUDING FEDERAL LA W ENFORCEMENT 21
AGENCIES; AND 22

(2) THE STATE OR A UNIT OF LOCAL GOVERNMENT MAY NOT PROVIDE 23
INFORMATION OR ASSIST IN THE ESTABLISHMENT OR MAINTENANCE OF A FEDERAL 24
REGISTRY BASED ON: 25

(I) RACE; 26

(II) NATIONAL ORIGIN; OR 27

(III) RELIGIOUS AFFILIATION, BELIEF, OR OPINION. 28

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 1
October 1, 2026. 2
