AN ACT concerning 1
Education – Public School Construction – Funding 2
FOR the purpose of codifying certain provisions of law specifying the intent of the General 3
Assembly regarding funding for public school construction and increasing the annual 4
funding goal beginning in a certain fiscal year; and generally relating to funding for 5
public school construction. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 16
That the Laws of Maryland read as follows: 17

(M) IT IS THE INTENT OF THE GENERAL ASSEMBLY THAT: 20
(1) BEGINNING IN FISCAL Y EAR 2027, WITHIN THE DEBT 21
AFFORDABILITY GUIDELINES, THE STATE SHOULD PROVIDE AT LEAST $550,000,000 22
EACH YEAR FOR PUBLIC SCHOOL CO NSTRUCTION IN ORDER TO MAINTAIN A 23

RELATIVELY STABLE NU MBER OF FUNDED PROJE CTS IN THE CAPITAL 1
IMPROVEMENT PROGRAM; AND 2
(2) THE ANNUAL GOAL ESTABLISHED UNDER PARAGRAPH (1) OF THIS 3
SUBSECTION: 4
(I) SHOULD BE RECALCULATED BEFORE THE NANCY K. KOPP 5
PUBLIC SCHOOL FACILITIES PRIORITY FUND ESTABLISHED UNDER § 5–326 OF 6
THIS SUBTITLE IS FUNDED; AND 7
(II) DOES NOT INCLUDE FUND ING PROVIDED FOR PUB LIC 8
SCHOOL CONSTRUCTION THROUGH THE BUILT TO LEARN PROGRAM. 9

SECTION 4. AND BE IT FURTHER ENACTED, That it is the intent of the General 11
Assembly that: 12
(1) [beginning in fiscal year ] FOR FISCAL YEARS 2023 THROUGH 2026, 13
within the current debt affordability guidelines, the State should provide at least 14
$450,000,000 each year for public school construction in order to maintain a relatively 15
stable number of funded projects in the Capital Improvement Program; and 16
(2) the annual goal established under item (1) of this section: 17
(i) should be recalculated prior to the Public School Facilities 18
Priority Fund being funded; and 19
(ii) does not include funding provided for public school construction 20
through the Built to Learn Program. 21
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 22
1, 2026. 23
