A BILL ENTITLED

AN ACT concerning 1

Calvert County – County Commissioners – Prohibited Agreements 2

FOR the purpose of prohibiting the County Commissioners of Calvert County from entering 3
into a nondisclosure agreement or a confidentiality agreement with another person; 4
and generally relating to nondisclosure agreements, confidentiality agreements, and 5
the County Commissioners of Calvert County. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12
That the Laws of Maryland read as follows: 13

Article 5 – Calvert County 14

(A) THE COUNTY COMMISSIONERS, OR A PERSON ACTING O N BEHALF OF 16
THE COMMISSIONERS, MAY NOT ENTER INTO A NONDISCLOSURE AGREEMENT OR A 17
CONFIDENTIALITY AGREEMENT WITH ANOTHER PERSON. 18

(B) A PROVISION IN AN AGRE EMENT THAT IS EXECUTED IN VIOLATION OF 19
THIS SECTION IS VOID AND UNENFORCEABLE AS CONTRARY TO PUBLIC POLICY. 20

SECTION 2. AND BE IT FURTHER ENACTED, That a presently existing 21
agreement, obligation, or contract right may not be impaired in any way by this Act and 22
that this Act shall be construed to apply only prospectively and may not b e applied or 23

interpreted to have any effect on or application to any nondisclosure or confidentiality 1
agreement or provision in effect before the effective date of this Act. 2

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 3
October 1, 2026. 4
