FOR the purpose of requiring manufacturers of menstrual hygiene products to include a 3
list of ingredients on each package of menstrual hygiene products sold in the State; 4
and generally relating to labeling of ingredients of menstrual hygiene products. 5

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 11
That the Laws of Maryland read as follows: 12

Unfair, abusive, or deceptive trade practices include any: 15

(xlvii) Title 14, Subtitle 50 of this article; [or] 17

(XLIX) SECTION 14–1330 OF THIS ARTICLE; OR 19

(A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS 21
INDICATED. 22

(2) “CONFIDENTIAL SUBSTANCE” MEANS ANY INGREDIENT: 23

(I) FOR WHICH A CLAIM HAS BEEN APPROVED BY THE U.S. 24
ENVIRONMENTAL PROTECTION AGENCY FOR INCLUSION ON THE CONFIDENTIAL 25
PORTION OF THE FEDER AL TOXIC SUBSTANCES CONTROL ACT CHEMICAL 26
SUBSTANCE INVENTORY; 27

(II) FOR WHICH THE MANUFAC TURER OF THE MENSTRU AL 28
PRODUCT OR THE SUPPLIER OF THE INGREDIENT CLAIMS PROTECTION UNDER THE 29
FEDERAL DEFEND TRADE SECRETS ACT; OR 30

(III) THAT IS GENERALLY REC OGNIZED AS S AFE BY THE U. S. 1
FOOD AND DRUG ADMINISTRATION UNDER 21 C.F.R. § 170.30. 2

(2) “DIVISION” MEANS THE DIVISION OF CONSUMER PROTECTION 3
OF THE OFFICE OF THE ATTORNEY GENERAL. 4

(2) (3) “INGREDIENT” MEANS ANY INTENTIONALLY 5
INTENTIONALLY ADDED SUBSTANCE IN A MENSTRUAL HYGIENE PR ODUCT THAT 6
SERVES A TECHNICAL O R FUNCTIONAL PURPOSE IN THE FINISHED PROD UCT, 7
INCLUDING ANY FRAGRANCE OR COLORING. 8

(3) (4) “MENSTRUAL HYGIENE PRO DUCT” MEANS A DISPOSABLE 9
OR REUSABLE PRODUCT USED FOR THE PURPOSE OF ABSORBING OR CONTAINING 10
MENSTRUAL BLOOD AND TISSUE MENSTRUATION OR VAGINAL DISCHARGE , 11
INCLUDING SANITARY PADS, TAMPONS, AND MENSTRUAL CUPS. 12

(B) (1) ON OR BEFORE BEGINNING APRIL 1, 2028, A A MANUFACTURER 13
OF MENSTRUAL HYGIENE PRODUCTS SHALL IN CLUDE A LIST OF ALL INGREDIENTS 14
LISTED IN ORDER OF P REDOMINANCE AND DISP LAYED PROMINENTLY IN 15
CONSPICUOUS TYPE ON EACH CONSUMER–FACING PACKAGE OF MENSTRUAL 16
HYGIENE PRODUCTS SOLD IN THE STATE. 17

(2) A MANUFACTURER MAY LIS T A PROPRIETARY INGREDIENT OR 18
COMBINATION OF INGRE DIENTS BY THEIR CONFIDENTIAL SUBSTAN CE BY ITS 19
COMMON NAME TO PROTECT CONFIDENTIALITY. 20

(C) A VIOLATION OF THIS SECTION IS: 21

(1) AN UNFAIR OR DECEPTIV E TRADE PRACTICE WIT HIN THE 22
MEANING OF TITLE 13 OF THIS ARTICLE; AND 23

(2) SUBJECT TO THE ENFORC EMENT AND PENALTY PR OVISIONS 24
CONTAINED IN TITLE 13 OF THIS ARTICLE. 25

(C) (1) A MANUFACTURER THAT VIOLATES THIS SECTION IS SUBJECT TO 26
A CIVIL PENALTY NOT EXCEEDING $1,000. 27

(2) THE DIVISION SHALL PAY AL L PENALTIES COLLECTE D BY THE 28
DIVISION UNDER THIS SUBSECTION INTO THE GENERAL FUND OF THE STATE WITH 29
THE INTENT THAT THE PENALTIES BE USED TO FULLY OFFSET ANY COSTS INCURRED 30
BY THE DIVISION IN CONNECTION WITH THE ENFORCEMENT OF THIS SECTION. 31

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 32
October 1, 2026. 33
