A BILL ENTITLED

AN ACT concerning 1

Family Law – Final Protective Orders – Duration 2

FOR the purpose of requiring all relief granted under a final protective order to remain 3
effective against a respondent on probation during the period of the respondent’s 4
probation; and generally relating to final protective orders. 5

BY repealing and reenacting, with amendments, 6
Article – Family Law 7
Section 4–506(j) 8
Annotated Code of Maryland 9

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 11
That the Laws of Maryland read as follows: 12

Article – Family Law 13

4–506. 14

(j) (1) Except as provided in paragraphs (2) [and], (3), AND (4) of this 15
subsection, all relief granted in a final protective order shall be effective for the period 16
stated in the order, not to exceed 1 year. 17

(2) [All] EXCEPT AS PROVIDED IN PARAGRAPHS (3) AND (4) OF THIS 18
SUBSECTION, ALL relief granted in a final protective order shall be effective for the period 19
stated in the order, not to exceed 2 years if: 20

(i) the court issues a final protective order under this section against 21
a respondent on behalf of a person eligible for relief: 22

1. for an act of abuse committed within 1 year after the date 1
that a prior final protective order issued against the same respondent on behalf of the same 2
person eligible for relief expires; or 3

2. by consent of the respondent within 1 year after the date 4
that a prior final protective order issued against the same respondent on behalf of the same 5
person eligible for relief expires; and 6

(ii) the prior final protective order was issued for a period of at least 7
6 months. 8

(3) IF A RESPONDENT IS ON PROBATION AT THE TIME A F INAL 9
PROTECTIVE ORDER IS ISSUED, OR IF THE RESPONDENT IS PLACED ON PROBATION 10
DURING THE EFFECTIVE PERIOD OF A FINAL PR OTECTIVE ORDER , THE RELIEF 11
GRANTED IN THE FINAL PROTECTIVE ORDER MAY NOT TERMINATE BE FORE THE 12
PROBATION EXPIRES OR IS TERMINATED BY COURT ORDER. 13

(4) A subsequent circuit court order pertaining to any of the provisions 14
included in the final protective order shall supersede those provisions in the final protective 15
order. 16

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effec t 17
October 1, 2026. 18
