FOR the purpose of requiring the parents of a child with a disability who has an 5
individualized education program to receive a certain notice when certain special 6
education or related service s specified in the individualized education program are 7
missed, incomplete, or interrupted as specified ; and generally relating to 8
individualized education programs for special education students. 9

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15
That the Laws of Maryland read as follows: 16

Article – Education 17

8–405.2. 18

(A) THE PARENTS OF A CHILD WITH A DISAB ILITY WHO HAS AN 19
INDIVIDUALIZED EDUCATION PROGRAM SHALL BE PROVIDED WRITTEN NOTICE, IN 20
ACCORDANCE WITH THE REQUIREMENTS OF THIS SECTION, WHEN A SPECIAL 21
EDUCATION SERVICE , RELATED SERVICE , OR SUPPLEMENTARY AID OR SUPPORT 22
SPECIFIED IN THE INDIVIDUALIZED EDUCATION PROGRAM: 23

(1) WAS NOT INITIATED BY THE DATE SET FORTH IN THE 1
INDIVIDUALIZED EDUCATION PROGRAM; OR 2

(2) EXCEPT FOR A CHILD ’S ABSENCE FROM SCHOO L, WAS NOT 3
PROVIDED TO THE CHILD BY THE LOCAL SCHOOL SYSTEM AS FOLLOWS: 4

(I) FOR A SERVICE , AID, OR SUPPORT REQUIRED DAILY, FIVE 5
INSTANCES OF MISSED , INCOMPLETE, OR INTERRUPTED SERVICES OR SUPPORTS 6
WITHIN A PERIOD OF 10 CONSECUTIVE SCHOOL DAYS; 7

(II) FOR A SERVICE , AID, OR SUPPORT REQUIRED TO BE 8
PROVIDED A SPECIFIC NUMBER OF TIMES WITHIN A SPECIFIED TIME PERIOD, THE 9
NUMBER OF INSTANCES THE SERVICE , AID, OR SUPPORT WAS MISSED, 10
INCOMPLETELY PROVIDED, OR INTERRUPTED OVER A TIME PERIOD AT LEAST TWO 11
TIMES LONGER THAN THE SPECIFIED TIME PERIOD; OR 12

(III) FOR A PATTERN OF MISS ED, INCOMPLETE, OR 13
INTERRUPTED SESSIONS THAT SUBSTA NTIALLY LIMIT THE DE LIVERY OF THE 14
SERVICE, AID, OR SUPPORT. 15

(B) A WRITTEN NOTICE REQUIRED UNDE R SUBSECTION (A) OF THIS 16
SECTION SHALL: 17

(1) BE SENT TO THE PARENT S WITHIN 3 SCHOOL DAYS AFTER A 18
CONDITION BEING MET UNDER SUBSECTION (A) OF THIS SECTION; AND 19

(2) INCLUDE: 20

(I) AN EXPLANATION OF THE MISSED, INCOMPLETE, OR 21
INTERRUPTED SERVICE, AID, OR SUPPORT AND THE REASON THE SERVICE, AID, OR 22
SUPPORT WAS MISSED, INCOMPLETE, OR INTERRUPTED; 23

(II) STEPS THE LOCAL SCHOOL SYSTEM WILL TAKE TO ENSURE 24
THE SERVICE , AID, OR SUPPORT WILL BE PROVIDED IN ACCORDAN CE WITH THE 25
STUDENT’S INDIVIDUALIZED EDUCATION PROGRAM; AND 26

(III) INFORMATION FOR PARENT S TO REQUEST AN 27
INDIVIDUALIZED EDUCATION PROGRAM MEETING TO DISCUSS: 28

1. COMPENSATORY SERVICES; 29

2. ALTERNATIVE METHODS O R SERVICES TO ADDRES S 30
THE CHILD’S NEEDS IF THE LOCAL SCHOOL SYSTEM DETERMINES THAT SERVICES, 31

AIDS, OR SUPPORTS ARE LIKELY TO CONTIN UE BEING MISSED , INCOMPLETE, OR 1
INTERRUPTED; AND 2

3. DISPUTE RESOLUTION OPTIONS. 3

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 4
1, 2026. 5
