A BILL ENTITLED

AN ACT concerning 1

State Procurement – Prohibited Certifications – Boycotts of Foreign Countries 2

FOR the purpose of prohibiting a procurement officer from requiring a certain certification 3
from a bidder or offeror or including a certain clause in a State procurement contract 4
or contract renewal relating to boycotts of foreign countries; and generally relating 5
to prohibited certifications and State procurement. 6

Preamble 12

WHEREAS, Executive Order No. 01.01.2017.25, signed by Governor Larry Hogan on 13
October 23, 2017, prohibits State executive agencies from entering into contracts with 14
businesses or entities that engage in boycotts of Israel; and 15

WHEREAS, This Executive Order has raised concerns regarding its impact on 16
freedom of speech, constitutionally protected political expression, and Mar yland’s 17
commitment to upholding civil rights; and 18

WHEREAS, Th e General Assembly recognizes the importance of ensuring State 19
policies reflect the values of free expression, inclusivity, and nondiscrimination; and 20

WHEREAS, It is essential to review and rectify State policies that may infringe upon 21
constitutionally protected rights; now, therefore, 22

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 23
That the Laws of Maryland read as follows: 24

A PROCUREMENT OFFICER MAY NOT REQUIRE A BI DDER OR OFFEROR , AS A 3
CONDITION TO SUBMITT ING A BID OR PROPOSA L ON A STATE PROCUREMENT, TO 4
CERTIFY THAT THE BID DER OR OFFEROR , EXCEPT AS REQUIRED U NDER THIS 5
ARTICLE OR UNDER FEDERAL LAW: 6

(1) IS NOT ENGAGING IN A BOYCOTT OF A FOREIGN COUNTRY; OR 7

(2) WILL REFRAIN FROM A BOYCOTT OF A FOREIGN COUNTRY FOR 8
THE DURATION OF THE CONTRACTUAL OBLIGATIONS. 9

A PROCUREMENT OFFICER MAY NOT INCLUDE IN A STATE PROCUREMENT 11
CONTRACT, OR RENEWAL OF A CONTRACT, A CLAUSE REQUIRING THE CONTRACTOR 12
TO CERTIFY THAT THE CONTRACTOR, EXCEPT AS REQUIRED U NDER THIS ARTICLE 13
OR UNDER FEDERAL LAW: 14

(1) IS NOT ENGAGING IN A BOYCOTT OF A FOREIGN COUNTRY; OR 15

(2) WILL REFRAIN FROM A BOYCOTT OF A FOREIGN COUNTRY FOR 16
THE DURATION OF THE CONTRACTUAL OBLIGATIONS. 17

SECTION 2. AND BE IT FURTHER ENACTED, That, on or before June 1, 2027, 18
each unit of State government shall: 19

(1) update its procurement policies, guidelines, and procedures to reflect 20
the repeal of Executive Order No. 01.01.2017.25 by means of this Act; and 21

(2) review any contracts or solicitations in conflict with this Act and amend 22
the contract or solicitation. 23

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect July 24
1, 2026. 25
