A BILL ENTITLED
AN ACT concerning 1
Motor Vehicles – Automated Traffic Enforcement Systems – Impoundment 2
FOR the purpose of authorizing a law enforcement agency to impound a motor vehicle to 3
which a certain number of certain unpaid and overdue civil citations issued through 4
the use of an automated traffic enforcement system apply; and generally relating to 5
automated traffic enforcement systems. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 24
That the Laws of Maryland read as follows: 25

(A) IN THIS SECTION , “AUTOMATED TRAFFIC ENFORCEMENT SYSTEM ” 2
MEANS: 3
(1) A TRAFFIC CONTROL SIGNA L MONITORING SYSTEM UNDER § 4
21–202.1 OF THIS ARTICLE; 5
(2) AN AU TOMATED RAILROAD GRADE CROSS ING ENFORCEMENT 6
SYSTEM UNDER § 21–704.1 OF THIS ARTICLE; 7
(3) A SCHOOL BUS MONITORING CAMERA UNDER § 21–706.1 OF THIS 8
ARTICLE; 9
(4) A STOP SIGN MONITORING SYSTEM UNDER § 21–707.1 OF THIS 10
ARTICLE; 11
(5) A SPEED MONITORING SYSTEM UNDER § 21–809 OF THIS ARTICLE; 12
(6) A WORK ZONE SPEED CONTROL SYSTEM UNDER § 21–810 OF THIS 13
ARTICLE; 14
(7) A BUS LANE MONITORING S YSTEM UNDER § 21–1134 OF THIS 15
ARTICLE; 16
(8) A NOISE ABATEMENT MONIT ORING SYSTEM UNDER § 22–612 OF 17
THIS ARTICLE; 18
(9) A VEHICLE HEIGHT MONITO RING SYSTEM UNDER § 24–111.3 OF 19
THIS ARTICLE; AND 20
(10) ANY OTHER AUTOMATED T RAFFIC ENFORCEMENT S YSTEM 21
AUTHORIZED UNDER STATE LAW. 22
(B) (1) A LAW ENFORCEMENT AGENCY MAY IMPOUND A MOTOR VEHICLE 23
FOR WHICH THREE OR M ORE CITATIONS FROM A N AUTOMATED TRAFFIC 24
ENFORCEMENT SYSTEM H AVE BEEN ISSUED IF T HE CITATIONS ARE UNPAID AND 25
OVERDUE BY AT LEAST 30 DAYS. 26
(2) A LAW ENFORCEMENT AGENCY MAY IMPOUND A MOTOR VEHICLE 27
UNDER THIS SECTION ONLY: 28

(I) AS A SECONDARY ACTION WHEN A LAW ENFORCEMENT 1
OFFICER DETAINS THE DRIVER OF THE MOTOR VEHICLE FOR A SUSPECTED 2
VIOLATION OF ANOTHER PROVISION OF THE CODE; OR 3
(II) WHEN THE MOTOR VEHICLE IS PARKED. 4
SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland read 5
as follows: 6

(a) In this section, “automated traffic enforcement system” means: 9
(1) A traffic control signal monitoring system under § 21 –202.1 of this 10
article; 11
(2) An auto mated railroad grade crossing enforcement system under § 12
21–704.1 of this article; 13
(3) A school bus monitoring camera under § 21–706.1 of this article; 14
(4) A stop sign monitoring system under § 21–707.1 of this article; 15
(5) A speed monitoring system under § 21–809 of this article; 16
(6) A work zone speed control system under § 21–810 of this article; 17
(7) A bus lane monitoring system under § 21–1134 of this article; 18
(8) [A noise abatement monitoring system under § 22–612 of this article; 19
(9)] A vehicle height monitoring system under § 24–111.3 of this article; and 20
[(10)] (9) Any other automated traffic enforcement system authorized 21
under State law. 22
(b) (1) A law enforcement agency may impound a motor vehicle for which three 23
or more ci tations from an automated traffic enforcement system have been issued if the 24
citations are unpaid and overdue by at least 30 days. 25
(2) A law enforcement agency may impound a motor vehicle under this 26
section only: 27
(i) As a secondary action when a law enforcement officer detains the 28

driver of the motor vehicle for a suspected violation of another provision of the Code; or 1
(ii) When the motor vehicle is parked. 2
SECTION 3. AND BE IT FURTHER ENACTED, That the Laws of Maryland read 3
as follows: 4

(a) In this section, “automated traffic enforcement system” means: 7
(1) A traffic control signal monitoring system under § 21 –202.1 of this 8

[(9)] (8) A vehicle height monitoring s ystem under § 24 –111.3 of this 19
article; and 20
[(10)] (9) Any other automated traffic enforcement system authorized 21
under State law. 22
(b) (1) A law enforcement agency may impound a motor vehicle for which three 23
or more citations from an automated traffic enforcement system have been issued if the 24
citations are unpaid and overdue by at least 30 days. 25
(2) A law enforcement agency may impound a motor vehicle under this 26
section only: 27

(i) As a secondary action when a law enforcement officer detains the 1
driver of the motor vehicle for a suspected violation of another provision of the Code; or 2
(ii) When the motor vehicle is parked. 3
SECTION 4. AND BE IT FURTHER ENACTED, That Section 2 of this Act shall take 4
effect July 1, 2028, the termination date of Chapter 625 of the Acts of the General Assembly 5
of 2024, as amended by Chapter 712 of the Acts of the General Assembly of 2025. If the 6
termination date of Chapter 625 is amended, this Act shall take effect on the termination 7
of Chapter 625. This Act may no t be interpreted to have any effect on that termination 8
provision. 9
SECTION 5. AND BE IT FURTHER ENACTED, That Section 3 of this Act shall take 10
effect July 1, 2029, the termination date of Chapter 678 of the Acts of the General Assembly 11
of 2024. If the termination date of Chapter 678 is amended, this Act shall take effect on the 12
termination of Chapter 678. This Act may not be interpreted to have any effect on that 13
termination provision. 14
SECTION 6. AND BE IT FURTHER ENACTED, That , except as provided in 15
Sections 4 and 5 of this Act, this Act shall take effect October 1, 2026. 16
