GEORGE’S COUNTY. 5

(B) THE AUTHORITY IS A BODY P OLITIC AND CORPORATE AND IS AN 6
INSTRUMENTALITY OF THE STATE. 7

(C) THE EXERCISE BY THE AUTHORITY OF A POWER UNDER THIS SUBTITLE 8
IS THE PERFORMANCE OF AN ESSENTIAL GOVERNMENTAL FUNCTION. 9

(D) THE GOVERNOR MAY SHALL INCLUDE EACH YEAR IN THE STATE 10

GEORGE’S COUNTY, PARTICULARLY THE SUITLAND ROAD AND SILVER HILL ROAD 18
INTERSECTION CORRIDOR, A NEED FOR RESIDENTI AL AND COMMERCIAL 19
DEVELOPMENT OR REDEVELOPMENT IN FURTHERANCE OF THE PUBLIC’S INTEREST; 20

(2) THE SUITLAND ROAD AND SILVER HILL ROAD INTERSECTION 21
CORRIDOR HAS EXPERIENCED LOW HOUSING AND ECONOMIC DEVELOPMENT IN THE 22
COMMUNITY FOR DECADES; 23

(3) AREAS IN THE SUITLAND ROAD AND SILVER HILL ROAD 24
INTERSECTION CORRIDOR INCLUDE BOTH AREAS THAT ARE CONSIDERED SLUM OR 25
BLIGHTED AND AREAS T HAT ARE DETERIORATED OR SUBJECT TO FURTHE R 26
DETERIORATING CONDITION, AND THOSE AREAS ARE IN NEED OF DEVELOPMENT OR 27
REDEVELOPMENT FOR THE PUBLIC BENEFIT; 28

(4) THE REVITALIZATION O F AREAS WITHIN THE SUITLAND ROAD 29
AND SILVER HILL ROAD INTERSECTION CORRIDOR NEEDING COMMERCIAL 30

(II) ENCOURAGING THE INCR EASE OF COMMERCE AND A 4
BALANCED ECONOMY; 5

(III) ASSISTING IN THE RET ENTION OF BUSINESSES AND 6
RESIDENTS; 7

(IV) ATTRACTING NEW INDUSTRIES AND COMMERCE; 8

(V) PROMOTING ECONOMIC DEVELOPMENT AND GROWTH; AND 9

(VI) GENERALLY PROMOTING THE HEALTH , WELFARE, AND 10
PUBLIC SAFETY OF RES IDENTS IN PRINCE GEORGE’S COUNTY AND INCREASING 11
PROPERTY TAX REVENUES FOR THE STATE AND PRINCE GEORGE’S COUNTY; 12

(5) THE ESTABLISHMENT OF THIS PUBLIC AUTHORITY TO PROVIDE 13
FINANCIAL RESOURCES FOR THE DEVELOPMENT AND ESTABLISHMENT OF 14
RESIDENCES AND BUSIN ESSES THROUGH COMMUN ITY ORGANIZATIONS IN THE 15

AND SILVER HILL ROAD INTERSECTION CORRIDOR IN PRINCE GEORGE’S COUNTY; 24

(2) PROMOTE ECONOMIC DEVELOPMENT; 25

(3) ENCOURAGE THE INCREASE OF BUSINESS ACTIVITY, COMMERCE, 26
AND A BALANCED ECONOMY IN PRINCE GEORGE’S COUNTY; 27

(4) HELP TO RETAIN AND A TTRACT BUSINESS ACTI VITY AND 28
COMMERCE IN PRINCE GEORGE’S COUNTY; AND 29

(1) THE AUTHORITY OPERATE AND EXERCISE ITS CORPORA TE 4
POWERS ALONG THE SUITLAND ROAD AND SILVER HILL ROAD INTERSECTION 5
CORRIDOR IN PRINCE GEORGE’S COUNTY; 6

(2) WITHOUT LIMITING ITS AUTHORITY TO OTHERWISE EXERCISE ITS 7
POWERS, THE AUTHORITY EXERCISES ITS POWERS TO ASSIST PRIVATE REAL ESTATE 8
ENTITIES AND NONPROF IT COMMUNITY DEVELOP MENT CORPORATIONS TO 9
DEVELOP AND REHABILI TATE HOUSING AND COM MERCIAL UNITS IN PRINCE 10
GEORGE’S COUNTY AND SUPPORT LOCAL ECONOMIC DEVELOPMENT AGENCIES TO 11
CONTRIBUTE TO THE EX PANSION, MODERNIZATION, AND RETENTION OF EXI STING 12
ENTERPRISES IN PRINCE GEORGE’S COUNTY AS WELL AS THE ATTRACTION OF NEW 13
BUSINESSES TO PRINCE GEORGE’S COUNTY; AND 14

(3) THE AUTHORITY SHOULD NOT OWN AND OPERATE A PR OJECT 15
UNLESS: 16

(I) THE BOARD DETERMINES BY R ESOLUTION THAT THE 17
PRIVATE SECTOR HAS N OT DEMONSTRATED SERI OUS AND SIGNIFICANT INTEREST 18
AND DEVELOPMENT CAPACITY TO OWN AND OPERATE THE PROJECT; OR 19

(II) A REPRESENTATIVE OF A GOVERNMENTAL UNIT REQUESTS 20
IN WRITING THAT THE AUTHORITY OWN AND OPERATE THE PROJECT. 21

PROPERTY TAXES FROM THE TIME OF SALE OR LEASE. 24

(C) THE AUTHORITY IS EXEMPT F ROM STATE AND LOCAL TRANS FER AND 25
RECORDATION TAX. 26

(D) THE AUTHORITY IS EXEMPT F ROM THE SALES A ND USE TAX ON 27
CONSTRUCTION MATERIALS FOR A PROJECT IN THE TARGET AREA OF THE BUFFER 28

(A) IN THIS SECTION , “FUND” MEANS THE SUITLAND DEVELOPMENT 1
AUTHORITY FUND. 2

(B) THERE IS A SUITLAND DEVELOPMENT AUTHORITY FUND. 3

(C) THE PURPOSE OF THE FUND IS TO PROVIDE FU NDS FOR THE 4
AUTHORITY TO USE FOR CONSULTING FEES , SALARIES, AND ADMINISTRATIVE 5
EXPENSES. 6

(D) THE AUTHORITY SHALL ADMINISTER THE FUND. 7

(E) (1) THE FUND IS A SPECIAL , NONLAPSING FUND THAT IS NOT 8
SUBJECT TO § 7–302 OF THE STATE FINANCE AND PROCUREMENT ARTICLE. 9

(2) THE STATE TREASURER SHALL HOLD THE FUND SEPARATELY , 10
AND THE COMPTROLLER SHALL ACCOUNT FOR THE FUND. 11

(F) THE FUND CONSISTS OF: 12

(1) MONEY APPROPRIATED IN THE STATE BUDGET TO THE FUND; 13

(2) INTEREST EARNINGS; AND 14

(3) ANY OTHER MONEY FROM ANY OTHER SOURCE ACC EPTED FOR 15
THE BENEFIT OF THE FUND. 16

(G) THE FUND MAY BE USED ONLY FOR ADMINISTRATIVE PURPOSES AND TO 17
CARRY OUT THE FUNCTIONS OF THIS SUBTITLE. 18

(H) THE STATE TREASURER SHALL INVES T THE MONEY OF THE FUND IN 19
THE SAME MANNER AS OTHER STATE MONEY MAY BE INVESTED. 20

(I) EXPENDITURES FROM THE FUND MAY BE MADE ONLY IN ACCORDANCE 21
WITH THE STATE BUDGET. 22

(a) (2) (i) This paragraph does not apply in fiscal years 2024 through 2028. 25

(ii) Notwithstanding any other provision of law, and unless 26
inconsistent with a federal law, grant agreement, or other federal requirement or with the 27

terms of a gift or settlement agreement, net interest on all State money allocated by the 1
State Treasurer under this section to special funds or accounts, and otherwise entitled to 2
receive interest earnings, as accounted for by the Comptroller, shall accrue to the General 3

(iii) The provisions of subparagraph (ii) of this p aragraph do not 5
apply to the following funds: 6

212. the Department of Social and Economic Mobility Special 7
Fund; [and] 8

213. the Population Health Improvement Fund; AND 9
