AN ACT concerning 1

State Highway Administration Highways – Highway Work Permits – Notice 2

FOR the purpose of requiring the State Highway Administration an applicant for a certain 3
work permit on a State highway to immediately provide certain notice including 4
certain information to certain members of the General Assembly of an application 5
for a work permit on a State highway; and generally relating to notice of work 6
permits for State highways. 7

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18
That the Laws of Maryland read as follows: 19

(a) Except as permitted by this section or in accordance with a permit ob tained 2
from the Administration, a person may not: 3

(1) Make an opening in any State highway; 4

(2) Place any structure on any State highway; 5

(3) Change or renew any structure placed on any State highway; 6

(4) Dig up any State highway for any purpos e, including the placement of 7
pipes, sewers, poles, wires, or rails; 8

(5) Plant or remove any tree on any State highway; or 9

(6) Place any obstruction or improvement on any State highway. 10

(b) (1) The Administration may issue a permit for work otherwi se prohibited 11
by subsection (a) of this section. 12

(2) Work done under the permit shall be performed to the satisfaction of 13
the Administration and under its supervision. 14

(E) (1) ON RECEIPT OF WITHIN 10 DAYS AFTER AN APPLICANT SUBMITS 15
AN APPLICATION FOR A PERMIT UNDER THIS SE CTION FOR A TYPE 2 OR TYPE 3 16
PROJECT, AS DESIGNATED BY THE ADMINISTRATION, THE ADMINISTRATION, IN 17
ACCORDANCE WITH § 2–1257 OF THE STATE GOVERNMENT ARTICLE, THE 18
APPLICANT SHALL IMMEDIATELY PROVIDE NOTICE OF TH E APPLICATION TO EACH 19
MEMBER OF THE GENERAL ASSEMBLY WHO REPRESENTS THE STATE LEGISLATIVE 20
DISTRICT IN WHICH THE PROPOSED WORK IS TO BE PERFORMED. 21

(2) THE NOTICE REQUIRED U NDER THIS SUBSECTION SHALL 22
INCLUDE: 23

(I) THE NAME OF THE APPLICANT; 24

(II) THE LOCATION OF THE PROPOSED WORK; 25

(III) THE EXPECTED STARTING DATE FOR THE PROPOSED WORK; 26
AND 27

(IV) A BRIEF DESCRIPTION OF THE NATURE OF THE PR OPOSED 28
WORK. 29

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 1
1, 2026. 2
