Business Regulation – Rounding Cash Transactions – Remittance to 2

FOR the purpose of requiring, if a merchant rounds up the price of a cash transaction for a 4
good or service in a certain manner, the merchant to remit to the Comptroller the 5
difference between the total price the customer is required to pay after the rounding 6
occurs and the price before the rounding occurs; requiring the Comptroller to 7
distribute certain revenue to the General Fund of the State; and generally relating 8
to rounding cash transactions between merchants and customers. 9

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15
That the Laws of Maryland read as follows: 16

(A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS 19
INDICATED. 20

(2) (I) “CASH” MEANS UNITED STATES COINS AND PAPER 21
CURRENCY. 22

(II) “CASH” DOES NOT INCLUDE: 23
2 HOUSE BILL 1512

1. A PAPER INSTRUMENT OTH ER THAN A FEDERAL 1
RESERVE NOTE; OR 2

2. A GIFT CARD. 3

(3) “MERCHANT” MEANS A PERSON ENGAG ED IN THE TRADE OR 4
BUSINESS OF THE SALE OF GOODS OR SERVICES. 5

(B) (1) THIS SUBSECTION DOES NOT APPLY TO A TRANSACTION WHERE A 6
CUSTOMER EXPRESSLY CONSENTS TO HAVING THE TRANSACTION ROUNDED UP FOR 7
THE EXPRESS PURPOSE OF PROVIDING A DONATION. 8

(2) IN A CASH TRANSACTION BETWEEN A MERCHANT A ND A 9
CUSTOMER FOR A GOOD OR SERVIC E, IF THE MERCHANT ROUNDS UP THE TOTAL 10
PRICE, INCLUDING ANY APPLIC ABLE DISCOUNT, TAX, OR FEE, TO THE NEAREST 5 11
CENTS, THE MERCHANT SHALL REMIT TO THE COMPTROLLER IN THE MANNER 12
PRESCRIBED BY THE COMPTROLLER AN AMOUNT THAT EQUALS T HE DIFFERENCE 13
BETWEEN: 14

(I) THE PRICE THE CUSTOMER IS REQUIRED TO PAY AFTER THE 15
ROUNDING OCCURS; AND 16

(II) THE PRICE BEFORE THE ROUNDING OCCURS. 17

(C) THE COMPTROLLER SHALL DIS TRIBUTE THE REVENUE COLLECTED 18
UNDER THIS SECTION TO THE GENERAL FUND OF THE STATE. 19

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 20
1, 2026. 21
