A BILL ENTITLED

AN ACT concerning 1

Public Health – Goods, Services, or Technologies Used in Death Sentences – 2
Prohibition 3

FOR the purpose of prohibiting a person doing business in the State from knowingly 4
manufacturing or selling, distributing, dispensing, or otherwise supplying a drug , 5
medical device, or other good, service , or technology or compounding a drug if the 6
person knows or reasonably should know that certain authorization was prompted, 7
either directly or indirectly, by a person seeking the drug, medical device, or other 8
good, service, or technology with the intent that the drug, medical device, or other 9
good, service, or technology will be used to carry out a death sentence; requiring a 10
health occupations board to deny or revoke a license or certi ficate to an applicant, 11
licensee, or certificate holder if the holder violates or has violated a certain provision; 12
and generally relating to goods, services, or technologies used in death sentences. 13

SECTION 1. BE IT ENACTED BY THE GENER AL ASSEMBLY OF MARYLAND, 24
That the Laws of Maryland read as follows: 25

(A) A PERSON DOING BUSINES S IN THE STATE MAY NOT KNOWING LY 2
MANUFACTURE OR SELL, DISTRIBUTE, DISPENSE, OR OTHERWISE SUPPLY A DRUG, 3
MEDICAL DEVICE, OR OTHER GOOD, SERVICE, OR TECHNOLOGY OR COMPOUND A 4
DRUG IF THE PERSON KNOWS OR REASONABLY SHOULD KNOW THAT THE ORDER , 5
PRESCRIPTION, OR OTHER AUTHORIZATI ON FOR THE MANUFACTU RE, 6
COMPOUNDING, OR SUPPLYING OF THE DRUG, MEDICAL DEVICE, OR OTHER GOOD, 7
SERVICE, OR TECHNOLOGY WAS PROMPTED, EITHER DIRECTLY OR INDIRECTLY, BY 8
A PERSON SEEKING THE DRUG, MEDICAL DEVICE, OR OTHER GOOD , SERVICE, OR 9
TECHNOLOGY WITH THE INTENT THAT THE DRUG , MEDICAL DEVICE , OR OTHER 10
GOOD, SERVICE, OR TECHNOLOGY WILL BE USED TO CARRY OUT A DEATH SENTENCE. 11

(B) A PERSON WHO VIOLATES THIS SECTION IS SUBJ ECT TO A CIVIL 12
PENALTY OF $10,000. 13

IF AN APPLICANT, LICENSEE, OR CERTIFICATE HOLDER UNDER THIS ARTICLE 16
VIOLATES OR HAS VIOL ATED § 21–1114 OF THE HEALTH – GENERAL ARTICLE, A 17
HEALTH OCCUPATIONS BOARD SHALL: 18

(1) DENY A LICENSE OR CERTIFICATE TO THE APPLICANT; OR 19

(2) REVOKE THE LICENSE OR CERTIFICATE. 20

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 21
October 1, 2026. 22
