AN ACT concerning 1

Public Health – Drugs and Medical Devices Used in Death Sentences – 2
Prohibition 3

FOR the purpose of prohibiting a person doing business in the State from knowingly 4
manufacturing or selling, distributing, dispensing, or otherwise supplying a drug or 5
medical device or compounding a drug if the person knows or reasonably should 6
know certain authorization was prompted, either directly or indirectly, by a person 7
seeking the drug or device with the intent that the drug or device will be used to 8
carry out a death sentence; and generally relating to drugs and medical devices used 9
in death sentences. 10

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 16
That the Laws of Maryland read as follows: 17

A PERSON DOING BUSINES S IN THE STATE MAY NOT KNOWING LY 20
MANUFACTURE OR SELL, DISTRIBUTE, DISPENSE, OR OTHERWISE SUPPLY A DRUG 21
OR MEDICAL DEVICE OR COMPOUND A DRUG IF THE PERSON KNOWS OR 22
REASONABLY SHOULD KN OW THAT THE ORDER , PRESCRIPTION, OR OTHER 23
AUTHORIZATION FOR THE MANUFACTURE, COMPOUNDING, OR SUPPLYING OF THE 24
DRUG OR DEVICE WAS PROMPTED, EITHER DIRECTLY OR INDIRECTLY, BY A PERSON 25

SEEKING THE DRUG OR DEVICE WITH THE INTENT THAT THE DRUG OR DEVICE WILL 1
BE USED TO CARRY OUT A DEATH SENTENCE. 2

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 3
October 1, 2026. 4
