AN ACT concerning 1

Parking Enforcement – Vehicles in Custody or Control of Auto Repair or 2
Storage Facility 3

FOR the purpose of establishing that if a parking citation is issued for a motor vehicle while 4
the motor vehicle is in the custody or control of an auto repair or storage facility, the 5
auto repair or storage facility, and not the registered owner, is liable for the parking 6
citation and any associated fines or late fees; prohibiting an auto repair or storage 7
facility from requiring a customer to waive the customer’s rights established under 8
this Act as a condition of service; and generally relati ng to parking citations issued 9
to motor vehicles in the custody or control of an auto repair or storage facility. 10

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 16
That the Laws of Maryland read as follows: 17

(A) (1) IN THIS SECTION THE F OLLOWING WORDS HAVE THE MEANINGS 20

(2) (I) “AUTO REPAIR OR STORAG E FACILITY” MEANS A PERSON 2
ENGAGED IN THE REPAI R, SERVICING, STORAGE, OR MAINTENANCE OF MO TOR 3
VEHICLES FOR COMPENSATION. 4

(II) “AUTO REPAIR OR STORAGE FACILITY” DOES NOT INCLUDE 5
A SELF–SERVICE STORAGE FACILITY, AS DEFINED IN § 18–501 OF THIS ARTICLE. 6

(3) “CUSTODY OR CONTROL ” MEANS THE POSSESSION OF A MOTOR 7
VEHICLE UNDER A REPA IR ORDER , SERVICE AGREEMENT , OR OTHER 8
AUTHORIZATION FROM THE REGISTERED OWNER. 9

(B) (1) IF A PARKING CITATION IS ISSUED FOR A MOTOR VEHICLE WHILE 10
THE MOTOR VEHICLE IS IN THE CUST ODY OR CONTROL OF AN AUTO REPAIR OR 11
STORAGE FACILITY: 12

(I) THE REGISTERED OWNER OF THE MOTOR VEHICLE MAY NOT 13
BE HELD LIABLE FOR THE PARKING VIOLATION AND ANY ASSOCIATED FINE OR LATE 14
FEE ARISING FROM THE PARKING CITATION; AND 15

(II) THE AUTO REPAIR OR STORAGE FACILITY MAY BE HELD 16
LIABLE FOR THE PARKING VIOLATION. 17

(2) IT IS AN AFFIRMATIVE DEFENSE TO LIABILITY FOR A PARKING 18
CITATION IF THE REGI STERED OWNER OF THE MOTOR VEHICLE FOR WH ICH THE 19
CITATION WAS ISSUED DEMONSTRATES THAT, AT THE TIME OF THE VIOLATION, THE 20
MOTOR VEHICLE WAS IN THE CUSTODY OR CONTR OL OF AN AUTO REPAIR OR 21
STORAGE FACILITY. 22

(3) IF A REGISTERED OWNER IS FOUND TO BE NOT L IABLE FOR A 23
PARKING CITATION BY ASSERTING THE AFFIRM ATIVE DEFENSE ESTABL ISHED 24
UNDER PARAGRAPH (2) OF THIS SUBSECTION, A COURT SHALL IMMEDIATELY WAIVE 25
ALL FINES AND FEES A ND DISMISS THE CITAT ION AGAINST THE REGI STERED 26
OWNER, REGARDLESS OF WHETHE R LIABILITY IS TRANS FERABLE TO THE AUTO 27
REPAIR OR STORAGE FACILITY. 28

(C) IF SUFFICIENT EVIDENC E IS AVAILABLE TO IN DICATE THAT A MOTOR 29
VEHICLE WAS IN THE C USTODY OR CONTROL OF AN AUTO REPAIR OR ST ORAGE 30
FACILITY AT THE TIME THE PARKING ENFORCEM ENT AGENCY ISSUED TH E 31
CITATION, THE PARKING ENFORCEMENT AGENCY MAY REISSUE THE CITATION FOR 32
THE PARKING VIOLATION DIRECTLY TO THE AUTO REPAIR OR STORAGE FACILITY. 33

(D) AN AUTO REPAIR OR STO RAGE FACILITY MAY NO T REQUIRE A 1
CUSTOMER TO WAIVE TH E CUSTOMER ’S RIGHTS UNDER THIS SECTION AS A 2
CONDITION OF SERVICE. 3

(E) THIS SECTION DOES NOT LIMIT THE AUTHORITY OF A PARKING 4
ENFORCEMENT AGENCY TO ENFORCE PARKING LAWS UNDER ITS JURISDICTION. 5

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 6
October 1, 2026. 7
