State Government – Governmental Procedures – Development and Review of 2
Standards 3

FOR the purpose of establishing certain requirements for standards developed by units of 4
State government; requiring the periodic review of st andards adopted by units of 5
State government; and generally relating to standards developed by units of State 6
government. 7

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 13
That the Laws of Maryland read as follows: 14

Article – State Government 15

(A) (1) IN THIS SECTION THE F OLLOWING WORDS HAVE THE MEANINGS 17
INDICATED. 18

(2) “DECISION–SUPPORT ALGORITHM” MEANS A COMPUTER 19
PROGRAM USED BY A UNIT OF STATE GOVERNMENT TO IMPROVE DECISION MAKING 20
THAT IS EVALUATED BY A TECHNICAL EXPERT BEFORE BEING USED. 21

(3) “STANDARDS” MEANS OPERATIONAL, TECHNICAL, OR 22
PROCEDURAL BENCHMARKS USED TO GUIDE IMPLEMENTATION PROCESSES. 23

(B) IN DEVELOPING STANDARDS, A UNIT OF STATE GOVERNMENT SHALL: 1

(1) RELY ONLY ON FEASIBL E, TRANSPARENT, AND REPRODUCIBLE 2
DATA; 3

(2) INCORPORATE FIRST –HAND KNOWLEDGE , INCLUDING BEST 4
PRACTICES AND REAL–WORLD EXPERIENCES; 5

(3) SEEK CONSENSUS AMONG STAKEHOLDERS; 6

(4) RESOLVE DISPUTES THR OUGH INDEPENDENT THI RD–PARTY 7
TECHNICAL REVIEW USI NG RECOGNIZED RESEAR CH AND EXPERTISE AND 8
REFERENCE TO RECOGNIZED INTERNATIONAL STANDARDS; 9

(5) AVOID RELYING ON TECHNICAL EXPERTS FO UND TO BE BIASED, 10
AS DETERMINED BY INDEPENDENT REVIEWS; 11

(6) TAKE INTO ACCOUNT: 12

(I) TRANSFORMATIVE LARGE–SCALE ECONOMIC EFFICIENCY; 13

(II) SCIENTIFIC STANDARDS; 14

(III) CULTURAL PRACTICES; 15

(IV) COMPARATIVE ADVANTAGES; AND 16

(V) STRUCTURED INPUT FRO M MULTIDISCIPLINARY EXPERTS; 17
AND 18

(7) UTILIZE A DECISION–SUPPORT ALGORITHM. 19

(C) ANY INITIAL STANDARDS ADOPTED BY A UNIT OF STATE GOVERNMENT 20
SHALL: 21

(1) BE BASED ON EXISTING CODES AND REGULATION S, UNLESS 22
OTHERWISE SPECIFIED; 23

(2) CONFIRM EXISTING PRACTICES AND STANDARDS; AND 24

(3) CLEARLY DEFINE GOALS, RISKS, AND METHODS. 25

(D) ANY STANDARDS ADOPTED BY A UNIT OF STATE GOVERNMENT SHALL 1
BE REVIEWED PERIODICALLY USING: 2

(1) CURRENT TECHNOLOGICAL BEST PRACTICES; AND 3

(2) INDEPENDENT PEER INPUT. 4

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 5
October 1, 2026. 6
