SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 1
That the Laws of Maryland read as follows: 2

Article 16 – Montgomery County 3

65–1. 4

(A) For the purposes of this chapter, the Village of Drummond, Montgomery 5
County, Maryland[, as hereinafter described,] (THE “VILLAGE”) shall constitute a special 6
tax area or district and shall [be deemed and taken to ] comprise certain parcels of land, 7
namely: The subdivision in [said] Montgomery County called “Drummond” as per plat no. 8
48, recorded in Plat Book No. 1, one (1) of the land records for [said] Montgomery County, 9
and the adjoining subdivision called “First Addition to Drummond ” as per plat no. 89, 10
recorded in [said] Plat Book No. 1. 11

(B) THE VILLAGE COUNCIL OF DRUMMOND, MONTGOMERY COUNTY, 12
MARYLAND (THE “VILLAGE COUNCIL”) SHALL CONSTITUTE THE GOVERNING BODY 13
OF THE VILLAGE. 14

65–2. 15

(a) On and after April 25, 1947, the following described area shall no longer be 16
included within the special taxing area of the Village [of Drummond, Montgomery County, 17
Maryland]: Lots numbered One, Two, and Three in the Village [of Drummond], located at 18
the southwest corner of Wisconsin and Hunt Avenues. 19

(b) The owner or owners of the property in [said] THE area [shall] DESCRIBED 20
IN SUBSECTION (A) OF THIS SECTION MAY not [hereafter] be levied upon for taxes 21
applicable only to the special taxing area of the [said] Village [of Drummond], nor shall 22
any indebtedness of [said] THE special taxing area, incurred after April 25, 1947, be a lien 23
upon the area so removed from [said] THE special taxing area[; provided, that any]. 24

(C) ANY future levy for any bond or indebtedness of [said] THE special taxing 25
area, incurred before April 25, 1947, or any extension, refinancing or renewal thereof, shall 26
include the owners of and be a lien upon the property within [said] THE excluded area[; 27
provided, however, that ] BUT nothing [herein contained ] IN THIS SECTION shall be 28
construed to relieve either the owner or the property in [said] THE area DESCRIBED IN 29
SUBSECTION (A) OF THIS SECTION from the obligation of the tax levy of July 1, 1946. 30

65–3. 31

(A) The [county council for] Montgomery County COUNCIL (THE “COUNTY 32
COUNCIL”) is hereby authorized, empowered and directed to levy and cause to be collected 33
from the property owners at the time of the county tax levy for [the] EACH FISCAL year 34
[commencing July 1, 1916, and ending June 30, 1917, and each succe eding year,] within 35

the [said village known as Drummond, as named and created by this chapter, ] VILLAGE 1
fourteen cents ($0.14) on each one hundred dollars ($100.00) of the assessable value of the 2
real property other than operating real property of a public utility and thirty –five cents 3
($0.35) on each one hundred dollars ($100.00) of the assessable value of the personal 4
property and operating real property of a public utility in [said village] THE VILLAGE, to 5
be collected as all other county taxes in [said] THE county are collected[; to be] AND paid 6
over by [said county council] THE COUNTY COUNCIL to the [treasurer of the committee 7
herein authorized to be created, or his successors selected by the majority of the members 8
as said committee, upon said treasurer having been duly selected by a majority of said 9
committee, and giving corporate bond to Montgomery County, Maryland, satisfactory to 10
and approved by the county manager and the county attorney in a penal sum to be fixed by 11
them, conditioned upon the faithful discharge of the duties of said treasurer; the said county 12
council] VILLAGE. 13

(B) THE COUNTY COUNCIL shall [also] order and have paid over to [said 14
treasurer] THE VILLAGE the proportion of the county road tax to be levied and collected 15
in the same manner as though [said] THE Village [of Drummond] was an incorporated 16
town, and the [said village ] VILLAGE shall for that purpose [,] be considered by [said 17
county council] THE COUNTY COUNCIL as an incorporated town in [said] THE county[;]. 18

(C) THE VILLAGE SHALL USE all of [said] THE funds [to be used directly by or 19
through said committee, ] UNDER SUBSECTION (B) OF THIS SECTION exclusively for 20
opening, improving, widening, maintaining, repairing and lighting the streets, roads, lanes, 21
approaches, alleys, sidewalks, parking, drainage, sewerage, sanitation and other village 22
improvements, FOR HIRING EMPLOYEES , and for furnishing po lice and fire protection, 23
clerical, PROFESSIONAL, and other public service, including the removal AND DISPOSAL 24
of SNOW, LEAVES, ashes, garbage and other refuse[, and the disposal thereof], and for the 25
enforcement of the requirements of all conveyances for properties situated in [said village] 26
THE VILLAGE, [and] for enforcing such building, sanitary and other regulations as [said 27
committee] THE VILLAGE COUNCIL subject to the approval of the [county council ] 28
COUNTY COUNCIL may prescribe for [said village] THE VILLAGE, or for any part thereof, 29
AND FOR OTHER PURPOSES DEEMED APPROPRIATE BY THE VILLAGE COUNCIL FOR 30
THE OPERATION OF THE VILLAGE AND THE PROTE CTION AND PRESERVATI ON OF 31
THE PUBLIC HEALTH, SAFETY, AND WELFARE. 32

(D) (1) THE VILLAGE SHALL OPERATE ON AN ANNUAL BUDGET FOR A 33
FISCAL YEAR BEGINNING EACH JULY 1 AND ENDING AT THE END OF EACH JUNE 30 34
OF THE FOLLOWING YEAR. 35

(2) BEFORE ADOPTING AN ANNUAL BUDGET, THE VILLAGE COUNCIL 36
SHALL HOLD A PUBLIC HEARING. 37

(3) THE VILLAGE COUNCIL SHALL PROVIDE THE PUBLIC NOTICE OF 38
AN ANNUAL BUDGET HEARING AT LEAST 10 DAYS BEFORE THE HEARING, INCLUDING 39

BY PROVIDING A COPY OF THE PROPOSED ANNUAL BUDGET OR A SUMMARY OF THE 1
PROPOSED ANNUAL BUDGET. 2

(4) THE ANNUAL BUDGET SHALL CONSIST OF A FINANCIAL PLAN FOR 3
THE FISCAL YEAR AND SHALL CONTAIN ESTIMATES OF ANTICIPATED REVENUES AND 4
PROPOSED EXPENDITURES. 5

(5) PUBLIC FUNDS MAY NOT BE EXPENDED WITHOUT FIRST HAVING 6
BEEN APPROPRIATED BY THE VILLAGE COUNCIL. 7

(6) THE VILLAGE COUNCIL MAY AMEND THE BUDGET AND 8
APPROPRIATE FUNDS FROM A RESERVE PROVIDED IN THE BUDGET FR OM TIME TO 9
TIME DURING THE FISC AL YEAR TO MEET EXTR AORDINARY OR UNANTIC IPATED 10
EXPENDITURES THAT MAY ARISE. 11

(7) THE VILLAGE COUNCIL SHALL HIRE OR EMPLOY A CER TIFIED 12
PUBLIC ACCOUNTANT TO AUDIT THE VILLAGE’S FINANCES. 13

65–4. 14

(A) If in any year the majority of the [said Drummond Citizens ’ Committee] 15
VILLAGE COUNCIL shall decide the sum hereinbefore authorized to be taxed and levied 16
is in excess of the amount required for the ensuing year, then [and in that event,] the [said 17
committee] VILLAGE COUNCIL may, on or before April 15 of any year, notify in writing 18
the [county council of Montgomery County] COUNTY COUNCIL to make a reduction in the 19
[said] levy of fourteen cents ($0.14) on each one hundred dollars ($100.00) of assessable 20
value of real property other than operating real property of a public utility and thirty –five 21
cents ($0.35) on each one hundred dollars ($100.00) of assessable value of personal property 22
and operating real property of a public utility, [as hereinbefore provided for, ] WITH the 23
amount of [said] THE reduction to be determined by the [said committee ] VILLAGE 24
COUNCIL and specified in the [said] notification to the [county council ; and upon ] 25
COUNTY COUNCIL. 26

(B) ON receipt of [such] A notification UNDER SUBSECTION (A) OF THIS 27
SECTION, the [board of county council of Montgomery County ] COUNTY COUNCIL is 28
authorized, empowered and directed to make a levy less than the [said] fourteen cents 29
($0.14) or thirty –five cents ($0.35) in the amount determined and specified by the [said 30
committee] VILLAGE COUNCIL. 31

65–5. 32

(A) On the first Monday [in] OF EACH May [in the year 1917 and on the same 33
day in each year thereafter], an election shall be held in the [said] Village [of Drummond] 34
for the election of three (3) [committeemen] MEMBERS OF THE VILLAGE COUNCIL, each 35

of whom shall have been a resident of [said] THE Village [of Drummond] for AT LEAST six 1
(6) months [previous to said] BEFORE THE election, [and over the age of twenty–one (21) 2
years, the three (3) said committeemen to be and] AND BE AT LEAST 21 YEARS OLD. 3

(B) THE INDIVIDUALS ELECT ED SHALL constitute the [Drummond Citizens ’ 4
Committee] VILLAGE COUNCIL for the ensuing year, each of whom shall qualify within 5
twenty (20) days after [said] THE election by taking the oath prescribed by the Constitution 6
of [Maryland] THE STATE, before an officer of the law duly commissioned to administer 7
[same] THE OATH. 8

(C) (1) The annual election of [said committeemen as herein provided ] THE 9
MEMBERS OF THE VILLAGE COUNCIL shall be held [under and] in accordance with the 10
laws of the State [of Maryland], but the returns [thereof] OF THE ELECTION shall be made 11
to the [county council of Montgomery County; all] COUNTY COUNCIL. 12

(2) ALL residents of [said] THE Village [of Drummond for six (6) months 13
previous to said election, and over the age of twenty–one (21) years,] WHO ARE AT LEAST 14
18 YEARS OLD shall be eligible to vote at [such elections; said elections] THE ELECTION. 15

(3) THE ELECTION shall be conducted by UP TO three (3) judges of election 16
[and two (2) clerks, to be] appointed by [said committee, who shall serve without pay; and 17
the polls of said election shall be open from 7:00 p.m. to 9:00 p.m. on the first Monday in 18
May as hereinbefore provided] THE VILLAGE COUNCIL. 19

(D) (1) THE MEMBERS OF THE VILLAGE COUNCIL SHALL SERVE 20
WITHOUT PAY. 21

(2) A MAJORITY OF THE MEMBERS OF THE VILLAGE COUNCIL SHALL 22
CONSTITUTE A QUORUM FOR THE TRANSACTION OF BUSINESS. 23

(3) THE VILLAGE COUNCIL SHALL DETERMINE THE VILLAGE 24
COUNCIL’S RULES AND ORDER OF BUSINESS. 25

(4) THE VILLAGE COUNCIL SHALL MEET AT LEAST 11 TIMES EACH 26
YEAR ON DATES DETERMINED BY THE VILLAGE COUNCIL, EXCEPT THAT THE MAYOR 27
AND THE VILLAGE COUNCIL MAY CALL SPECIAL MEE TINGS OF THE VILLAGE 28
COUNCIL. 29

(5) ALL MEETINGS OF THE VILLAGE COUNCIL, REGULAR AND 30
SPECIAL, SHALL BE PUBLIC MEET INGS DURING WHICH MEMBERS OF THE PUBLIC 31
SHALL HAVE A REASONA BLE OPPORTUNITY TO B E HEARD , EXCEPT THAT THE 32
VILLAGE COUNCIL MAY HOLD CLOSED SESSIONS, WORK SESSIONS AT WHICH PUBLIC 33
COMMENT MAY BE PROHIBITED, AND SPECIAL PURPOSE MEETINGS AT WHICH ALL 34
PUBLIC COMMENT MAY BE LIMITED TO THE SUBJECT OF THE MEETING. 35

(6) THE VILLAGE COUNCIL SHALL KEEP A RECORD OF MEETING 1
MINUTES AND MAKE THE RECORD AVAILABLE FOR PUBLIC INSPECTION. 2

(E) ANY MEMBER OF THE VILLAGE COUNCIL MAY BE REMOVE D BY THE 3
COUNTY COUNCIL UPON THE CHAR GE OF MALFEASANCE OR MISFEASANCE IN 4
OFFICE, PROFFERED BY A MEMBER OF THE VILLAGE COUNCIL, AFTER DUE NOTICE 5
OF THE CHARGE AND OPPORTUNI TY TO DEFEND AGAINST TH E CHARGE AT A 6
HEARING. 7

65–6. 8

(a) (1) [Said Drummond Citizens ’ Committee] THE VILLAGE COUNCIL is 9
empowered to ESTABLISH, OPERATE, MAINTAIN, AND CONTROL ALL PUBLIC WAYS IN 10
THE VILLAGE EXCEPT THE PUBLIC WAYS UNDER THE JURISDICTION OF THE STATE, 11
INCLUDING BY REQUIRING THE OWNERS OF PROPERTY ABUTTING A STREET, ROAD, 12
OR LANE TO REMOVE ICE, SNOW, DIRT, DEBRIS, OR OTHER OBSTRUCTIONS AS WELL 13
AS ANY OTHER ACTION NEC ESSARY FOR THE PUBLIC HEALTH OR SAF ETY, 14
CONSTRUCT A NEW STREET , ROAD, OR LANE, grade, pa ve, macadamize or otherwise 15
improve any existing street, road or lane, or any street, road or lane which has been or may 16
be acquired and opened for public use, and to lay sidewalks [and], curbs, AND GUTTERS 17
thereon[; provided, that said Drummond Citizens’ Committee]. 18

(2) THE VILLAGE COUNCIL, subject to the approval of the [county 19
council] COUNTY COUNCIL and after petition of residents and hearing, as hereinafter 20
provided, shall have power to assess the cost, or any part of the cost, of [said] THE 21
CONSTRUCTING, grading, paving, macadamizing or improving against the property 22
abutting on [said] A street, road or lane, or sidewalk, in proportion to the frontage of [said] 23
THE abutting property on the [same; provided, further, that upon ] STREET, ROAD OR 24
LANE, OR SIDEWALK. 25

(3) ON the petition in writing of two –thirds of the residents owning 26
property abutting upon any street, road or lane to be CONSTRUCTED, graded, paved, 27
macadamized or otherwise to be improved under the provisions of this section requesting 28
the CONSTRUCTING, grading, paving, macadamizing or otherwise improving of [such] 29
THE streets, roads or lanes, it shall be the duty of the [Drummond Citizens’ Committee] 30
VILLAGE COUNCIL to make the [said] assessment against the abutting property to 31
provide the funds for and cause to be performed the necessary work or construction to be 32
done in accordance with the provisions herein provided [; and provid ed, further, that 33
before]. 34

(4) BEFORE any contract for work shall be entered into, or any obligation 35
with respect [thereto] TO THE CONTRACT incurred, notice shall be given to the owners 36

and others of record interested in [said] THE abutting property of a hearing at which they 1
will be given an opportunity to be heard[, such]. 2

(5) THE hearing [to be had] SHALL BE before [said Drummond Citizens’ 3
Committee] THE VILLAGE COUNCIL, which shall decide the matters properly brought 4
before it[; and any]. 5

(6) ANY party affected by the final decision of [said Drummond Citizens ’ 6
Committee] THE VILLAGE COUNCIL made after [such] THE hearing shall have the right 7
to appeal [therefrom] THE DECISION within ten (10) days to the [circuit court of] 8
Montgomery County CIRCUIT COURT. 9

(b) (1) Any tax so assessed, as above provided in this section, shall be payable 10
to [the county treasurer] MONTGOMERY COUNTY in from four (4) to ten (10) semiannual 11
installments, as nearly equal as may be, the first installment thereof to become due and 12
payable within six (6) months after the levy of [said] THE special tax as above provided, 13
and each of the other [said] installments within six (6) months after the preceding one (1) 14
shall have become due[; each]. 15

(2) EACH installment of [said] THE tax shall become a lien against [said] 16
THE abutting property and shall bear interest from the date of levy thereof at the rate of 17
six (6) per centum per annum until paid [;] or [said] THE tax may be paid in full without 18
interest during the first installment period[, and if]. 19

(3) IF any of [said] THE installments [thereof be] OF THE TAX ARE not 20
paid within thirty (30) days after [same] THE INSTALLMENT shall have become due, the 21
entire amount of [said] THE tax assessed to the person [or persons ] or corporation in 22
default, with interest, shall [thereupon] THEN become due and payable, and may be 23
collected in the same manner provided in the act for the collection of unpaid taxes. [And 24
the said Drummond Citizens’ Committee] 25

(4) THE VILLAGE COUNCIL shall have the power to prescribe the number 26
of semiannual installments in which the tax [so assessed, as above provided, ] shall be 27
payable. 28

(c) All money so received by [said county treasurer] THE COUNTY shall, [upon] 29
ON order of [said county council] THE COUNTY COUNCIL, be paid over to the treasurer of 30
[said] THE Village [of Drummond, and the said Drummond Citizens ’ Committee shall 31
become charged with the duty of paving, grading, macadamizing or otherwise improving 32
said streets, roads, lanes or sidewalks within said village]. 33

(d) (1) For the purpose of making the improvements provided for in this 34
section, the [said Drummond Citizens ’ Committee] VILLAGE COUNCIL is [hereby] 35
authorized and empowered to borrow money and otherwise contract indebtedness and 36

obligate [said] THE Village [of Drummond] in an amount not exceeding at any time the 1
sum of four (4) per centum of the assessed valuation of the real property other than 2
operating real property of a public utility and ten (10) per centum of the assessed valuation 3
of the operating real property of a public utility within [said village] THE VILLAGE, and 4
for this purpose [said] THE Village [of Drummond] shall be and hereby is con stituted a 5
corporation[, and the said Drummond Citizens’ Committee]. 6

(2) THE VILLAGE COUNCIL is empowered to act for [said] THE 7
corporation[; provided, that should]. 8

(3) IF there [be] IS A default on bonds or other indebtedness incurred by 9
the [said citizens’ committee of the said Village of Drummond for the said village] VILLAGE 10
COUNCIL, it shall be the duty of the [county council of Montgomery County ] COUNTY 11
COUNCIL to levy or have levied special general taxes against the real property of [said] 12
THE Village [of Drummond] to the extent only that [such] THE default bonds or incurred 13
indebtedness shall be liquidated. 14

65–7. 15

[Any member of the Drummond Citizens’ Committee may be removed by the county 16
council upon the charge of malfeasance or misfeasance in office, preferred by a member of 17
said committee, after due notice of said charge and opportunity has been given in defense 18
thereof, and a hearing to be fixed therefor.] 19

(A) THE VILLAGE COUNCIL SHALL APPOINT: 20

(1) A MAYOR, WHO SHALL PRESIDE OVER MEETINGS OF THE VILLAGE 21
COUNCIL AND SERVE AS THE CHIEF EXECUTIVE OF THE VILLAGE; 22

(2) A TREASURER, WHO SHALL ASSIST IN THE PREPARATION OF THE 23
ANNUAL BUDGET AND SUPERVISE THE DISBURSEMENT OF PUBLIC FUNDS; 24

(3) A SECRETARY, WHO SHALL ASSIST IN THE KEEPING OF RECOR DS 25
OF THE VILLAGE COUNCIL; AND 26

(4) OTHER OFFICERS AND EMPLOYEES, WHO SHALL HOLD TERMS AND 27
WHO SHALL HAVE DUTIES ESTABLISHED BY THE VILLAGE COUNCIL. 28

(B) The [said treasurer and other ] officers AND EMPLOYEES of [said] THE 29
Village [of Drummond ] shall hold their offices or positions at the pleasure of [said 30

between said committee and such officers and employees, for a period not to extend beyond 32
the limits of the terms of office of said committee] THE VILLAGE COUNCIL. 33

(C) (1) THE OFFICERS AND EMPLOYEES OF THE VILLAGE SHALL GIVE 1
BOND TO THE VILLAGE IN AN AMOUNT AND WITH SURETY DETE RMINED BY THE 2
VILLAGE COUNCIL. 3

(2) THE PREMIUMS OF FIDELITY BONDS OWED BY OFFICERS AND 4
EMPLOYEES OF THE VILLAGE SHALL BE PAID BY THE VILLAGE. 5

65–8. 6

(A) [Said Drummond Citizens’ Committee shall] THE VILLAGE COUNCIL MAY 7
not expend for material or work [in connection with anyone undertaking] a sum exceeding 8
[three hundred dollars ($300.00) ] FIFTEEN THOUSAND DOL LARS ($15,000), OR THE 9
AMOUNT FOR WHICH PUBLICATION OF NOTICE OF PROCUREMENT IS REQUIRED BY 10
STATE LAW, WHICHEVER IS GREATER, without having first advertised the specifications 11
[therefor] and inviting bids [for the same ], after which [said committee] THE VILLAGE 12
COUNCIL may purchase [such] THE material or make contract for [such] THE work, or 13
have [such] THE work done by employing labor, or otherwise, as it may deem best. 14

(B) NOTWITHSTANDING ANY OTHER PROVI SION TO THE CONTRARY , THE 15
VILLAGE COUNCIL MAY CONTRACT FOR MATERIAL OR WORK WITHOUT FIRST 16
HAVING INVITED BIDS IF: 17

(1) THE CONTRACT AWARD SERVES A PUBLIC PURPOSE AND THERE IS 18
ONLY ONE SOURCE FOR THE REQUIRED MATERIA L TO MEET THE NEEDS OF THE 19
VILLAGE; 20

(2) THE CONTRACT IS IN CONNECTION WITH POTENTIAL OR PENDING 21
LITIGATION, CONDEMNATION, OR COLLECTIVE BARGAINING; 22

(3) A PROPOSED CONTRACTOR OR SUB CONTRACTOR HAS BEEN 23
SPECIFICALLY IDENTIFIED IN A GRANT ACCEPTED BY THE VILLAGE; 24

(4) A PROPOSED CONTRACTOR OR SUB CONTRACTOR HAS BEEN 25
SELECTED THROUGH A COMPETITIVE BIDDING PROCESS UNDERTAKEN BY A STATE, 26
COUNTY, OR MUNICIPAL CORPORATION, OR COOPERATIVELY WIT H THE VILLAGE, 27
AND SUBSTANTIALLY SIMILAR TERMS ARE OFFERED TO THE VILLAGE; 28

(5) THE SERVICES ARE PROFESS IONAL IN NATURE , INCLUDING 29
ACCOUNTING, ARCHITECTURE, AUDITING, ENGINEERING, LEGAL, OR SURVEYING 30
SERVICES; OR 31

(6) THERE EXISTS A THREAT TO THE PUBLIC HEALTH , SAFETY, OR 32
WELFARE OR WHERE DELAY WOULD SERIOUSLY INJURE THE VILLAGE FINANCIALLY 33
OR OTHERWISE. 34

The [said county council ] COUNTY COUNCIL may, [upon] ON recommendation of 2
the [Drummond Citizens’ Committee] VILLAGE COUNCIL, adopt [such] regulations with 3
respect to dumping of garbage, sanitation, erection of buildings, care of property, USE OF 4
PUBLIC WAYS, PARKING ON PUBLIC WA YS, or other police or health regulations, and 5
provide penalties for the violation [thereof] OF THE REGULATIONS as [said board] THE 6
COUNTY COUNCIL may deem proper, which regulations may be enforced by or through 7
[said committee] THE VILLAGE COUNCIL. 8

[Said] THE members of [said Drummond Citizens ’ Committee] THE VILLAGE 10
COUNCIL, for the purpose of making contracts or otherwise incurring liabilities in the 11
performance of the duties provided by this subtitle shall be considered in law as a 12
corporation, and are not to be held individually or personally liable in connection 13
[therewith] THOSE DUTIES. 14

65–11. 15

(A) The treasurer of [said Drummond Citizens ’ Committee] THE VILLAGE 16
COUNCIL shall deposit all funds [coming into his hands, as such, ] in A depositary [or 17
depositaries] as may be designated by the majority vote of the [said committee] VILLAGE 18
COUNCIL, duly recorded in the minutes [thereof, to his credit, as such treasurer, and that 19
said treasurer shall not dispose of any of the funds coming into his hands, as such treasurer, 20
except upon check, duly signed by him, as such trea surer, and countersigned by the 21
chairman of said committee, or some member thereof acting as chairman; said acting 22
chairman shall be duly authorized to act by resolution of said committee which must be 23
first placed upon the minutes of the committee] OF THE VILLAGE COUNCIL. 24

(B) ALL CHECKS ISSUED FROM T HE VILLAGE SHALL BE SIGN ED BY THE 25
TREASURER. 26

(C) THE VILLAGE COUNCIL MAY AUTHORIZE PAYMENTS TO BE MADE BY 27
METHODS OTHER THAN C HECK IF REASONABLE S AFETY MEASURES ARE 28
INSTITUTED. 29

(A) THE ENUMERATION OF PA RTICULAR POWERS IN T HIS CHAPTER MAY 31
NOT BE HELD OR DEEMED TO BE EXCLUSIVE. 32

(B) THE VILLAGE SHALL HAVE OT HER POWERS AS ARE IN CIDENT TO TH E 1
POWERS SPECIFICALLY ENUMERATED, AS ARE A NECESSARY CONSEQUENCE OF THE 2
POWERS SPECIFICALLY ENUMERATED, OR AS ARE A NECESSARY CONSEQUENCE OF 3
THE POWERS HEREIN CONFERRED. 4

(C) IN ADDITION TO THE PO WERS ENUMERATED IN T HIS CHAPTER, THE 5
VILLAGE SHALL HAVE ALL POWERS, RIGHTS, AND PRIVILEGES NOW OR HEREAFTER 6
GRANTED BY THE CONSTITUTION AND LAWS OF THE STATE. 7

65–13. 8

IF ANY SECTION OR PAR T OF A SECTION OF THIS CHAPTER IS HELD INVALID 9
BY A COURT OF COMPET ENT JURISDICTION, THE HOLDING MAY NOT AFFECT THE 10
REMAINDER OF THIS CHAPTER NOR THE CONTEXT IN WHICH THE SECTION OR PART 11
OF THE SECTION HELD INVALID APPEARS, EXCEPT TO THE EXTENT THAT AN ENTIRE 12
SECTION OR PART OF A SECTION MAY BE INSEP ARABLY CONNECTED IN MEANING 13
AND EFFECT WITH THE SECTION OR PART OF THE SECTION TO WHICH THE HOLDING 14
DIRECTLY APPLIES. 15

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 16
October 1, 2026. 17
