Queen Anne’s County – Speed Monitoring System – U.S. Route 301 2
FOR the purpose of authorizing the placement State Highway Administration to place and 3
use of speed monitoring systems on a certain portion of U.S. Route 301 in Queen 4
Anne’s County; and generally relating to the placement and use of speed monitoring 5
systems in Queen Anne’s County. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 7
That the Laws of Maryland read as follows: 8
Article – Courts and Judicial Proceedings 9

(e) (3) (ii) 1. The fines collected by the District Court as a result of 11
violations enforced by speed monitoring systems on Interstate 695 in Baltimore County 12
[and], ON Interstate 83 in Baltimore County , AND ON U.S. ROUTE 301 APPROACHING 13
THE INTERSECTIONS OF OR BETWEEN MARYLAND ROUTE 405 AND MARYLAND 14
ROUTE 19 IN QUEEN ANNE’S COUNTY shall be remitted to the Comptroller for 15
distribution to the State Highway Administration to be used solely to: 16
A. Recover the cost of implementing and administering the 17
speed monitoring systems on Interstate 695 in Baltimore County [and], ON Interstate 83 18
in Baltimore County , AND ON U.S. ROUTE 301 APPROACHING THE INTE RSECTIONS 19
OF OR BETWEEN MARYLAND ROUTE 405 AND MARYLAND ROUTE 19 IN QUEEN 20
ANNE’S COUNTY; and 21
B. Assist in covering the cost of roadway and safety 22
improvements on Interstate 695 in Baltimore County [and], ON Interstate 83 in Baltimore 23
County, AND ON U.S. ROUTE 301 IN QUEEN ANNE’S COUNTY. 24
2. Fines distributed to the State Highway Administration 25
under subsubparagraph 1 of this subparagraph are supplemental to and are not intended 26
to take the place of funding that would otherwise be appropriated for uses described under 27
subsubparagraph 1 of this subparagraph. 28

21–809. 30
(a) (1) In this section the following words have the meanings indicated. 31
(2) “Agency” means: 32

(i) A law enforcement agency of a local political subdivision that is 1
authorized to issue a citation for a violation of the Maryland Vehicle Law or of local traffic 2
laws or regulations; 3
(ii) For a municipal corporation that does not maintain a police force, 4
an agency established or designated by the municipal corporation to implement this 5
subtitle using speed monitoring systems in accordance with this section; 6
(iii) For speed monitoring systems placed and used on Interstate 83 7
in Baltimore County [or], Interstate 695 in Baltimore County, OR ON U.S. ROUTE 301 8
APPROACHING THE INTERSECTIONS OF OR BETW EEN MARYLAND ROUTE 405 AND 9
MARYLAND ROUTE 19 IN QUEEN ANNE’S COUNTY, the State Highway Administration; 10
or 11
(iv) For speed monitoring systems placed and used on Maryland 12
Route 200 (Intercounty Connector), the Maryland Transportation Authority. 13
(9) “Speed monitoring system” means a device with one or more motor 14
vehicle sensors producing recorded images of motor vehicles traveling at speeds at least 12 15
miles per hour above the posted speed limit. 16
(b) (1) (i) 1. A speed monitoring system may not be used by a local 17
jurisdiction under this section unless its use is authorized by the governing body of the local 18
jurisdiction by local law enacted after reasonable notice and a public hearing. 19
2. The State Highway Administration may use speed 20
monitoring systems on Interstate 83 in Baltimore County [and], ON U.S. ROUTE 301 21
APPROACHING THE INTERSECTIONS OF OR BETW EEN MARYLAND ROUTE 405 AND 22
MARYLAND ROUTE 19 IN QUEEN ANNE’S COUNTY, AND Interstate 695 in Baltimore 23
County in accordance with this section. 24
(vi) This section applies to a violation of this subtitle recorded by a 25
speed monitoring system that meets the requirements of this subsection and has been 26
placed: 27
8. By the Maryland Transportation Authority on Maryland 28
Route 200 (Intercounty Connector) in Montgomery County; [or] 29
9. Subject to subparagraph (xii) of this paragraph, in 30
Montgomery County on a highway identified in the municipality’s, county’s, or State’s most 31
recent Strategic Highway Safety Plan or Vision Zero Plan as a highway that is at high risk 32
for motor vehicle crashes that result in serious bodily injury or death; OR 33
10. IN QUEEN ANNE’S COUNTY, BY THE STATE HIGHWAY 34
ADMINISTRATION ON U.S. ROUTE 301 AT APPROACHING THE INTERSECTIONS OF 35

OR BETWEEN MARYLAND ROUTE 405 AND MARYLAND ROUTE 19 IN QUEEN ANNE’S 1
COUNTY. 2
(viii) Before activating a speed monitoring system, the local 3
jurisdiction, the State Highway Administration, or the Maryland Transportation 4
Authority, as appropriate, shall: 5
1. Publish notice of the location of the speed monitoring 6
system on its website and in a newspaper of general circulation in the jurisdiction; 7
2. Ensure that each sign that designates a school zone is 8
proximate to a sign that: 9
A. Indicates that speed monitoring systems are in use in the 10
school zone; and 11
B. Is in accordance with the manual for and the specifications 12
for a uniform system of traffic control devices adopted by the State Highway Administration 13
under § 25–104 of this article; 14
3. With regard to a speed monitoring system established on 15
Maryland Route 210 (Indian Head Highway) in Prince George’s County, based on proximity 16
to an institution of higher education under subparagraph (vi)3 of this paragraph, on 17
Interstate 83 in Baltimore City, in Anne Arundel County on Maryland Route 175 (Jessup 18
Road) between t he Maryland Route 175/295 interchange and the Anne Arundel 19
County–Howard County line, at the intersection of Maryland Route 333 (Oxford Road) and 20
Bonfield Avenue in Talbot County, on Interstate 83 in Baltimore County or Interstate 695 21
in Baltimore County, [or] on Maryland Route 200 (Intercounty Connector) in Montgomery 22
County, OR ON U.S. ROUTE 301 APPROACHING THE INTERSECTIONS OF OR BETWEEN 23
MARYLAND ROUTE 405 AND MARYLAND ROUTE 19 IN QUEEN ANNE’S COUNTY, 24
ensure that all speed limit signs approaching and within the segment of highway on which 25
the speed monitoring system is located include signs that: 26
A. Are in accordance with the manual and specifications for 27
a uniform system of traffic control device s adopted by the State Highway Administration 28
under § 25–104 of this article; and 29
B. Indicate that a speed monitoring system is in use; and 30
4. With regard to a speed monitoring system placed on 31
Maryland Route 210 (Indian Head Highway) in Prince G eorge’s County, Interstate 83 in 32
Baltimore City, in Anne Arundel County on Maryland Route 175 (Jessup Road) between 33
the Maryland Route 175/295 interchange and the Anne Arundel County –Howard County 34
line, at the intersection of Maryland Route 333 (Oxford Roa d) and Bonfield Avenue in 35
Talbot County, on Interstate 83 in Baltimore County or Interstate 695 in Baltimore County, 36
[or] on Maryland Route 200 (Intercounty Connector) in Montgomery County, OR ON U.S. 37

ROUTE 405 AND MARYLAND ROUTE 19 IN QUEEN ANNE’S COUNTY, ensure that each 2
sign that indicates that a speed monitoring system is in use is proximate to a device that 3
displays a real–time posting of the speed at which a driver is traveling. 4
(d) (2) (i) Except as provided in subparagraphs (ii) and (iii) of this 5
paragraph, an agency may mail a warning notice instead of a citation to the owner liable 6
under subsection (c) of this section. 7
(ii) With regard to a speed monitoring system established on 8
Interstate 83 in Baltimore City, an agency shall mail a warning notice instead of a citation 9
for a violation recorded by the speed monitoring system during the first 90 days that the 10
speed monitoring system is in operation. 11
(iii) With regard to a speed monitoring system established on 12
Interstate 83 in Baltimore County [or], Interstate 695 in Baltimore County, OR ON U.S. 13
ROUTE 301 APPROACHING THE INTE RSECTIONS OF OR BETW EEN MARYLAND 14
ROUTE 405 AND MARYLAND ROUTE 19 IN QUEEN ANNE’S COUNTY, the State 15
Highway Administration shall mail a warning notice instead of a citation for a violation 16
recorded by the speed monitoring system during the first 30 days that the speed monitoring 17
system is in operation. 18
(k) (2) The report shall include: 19
(x) The locations a t which each speed monitoring system was used 20
in the local jurisdiction, on Interstate 83 in Baltimore County or Interstate 695 in Baltimore 21
County, [or] on Maryland Route 200 (Intercounty Connector) , OR ON U.S. ROUTE 301 22
APPROACHING THE INTERSECTIONS OF OR BETWEEN MARYLAND ROUTE 405 AND 23
MARYLAND ROUTE 19 IN QUEEN ANNE’S COUNTY; 24
(xi) The activation start and stop dates of each speed monitoring 25
system for each location at which it was used; and 26
(xii) The number of citations issued by each speed monitoring system 27
at each location. 28
(3) Each local jurisdiction with a speed monitoring system program, the 29
State Highway Administration, or the Maryland Transportation Authority shall submit the 30
information required under paragraph (2) of this subsection to the Commission by October 31
31 of each year and assist the Commission in the preparation of the annual report. 32
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 33
October 1, 2026. It shall remain effective for a period of 6 years and 9 months and, at the 34
end of June 30, 2033, this Act, with no further action required by the General Assembly, 35
shall be abrogated and of no further force and effect. 36
