AN ACT concerning 1

Vehicle Laws – Speed Monitoring Systems – Residential Districts 2

FOR the purpose of applying statewide certain provisions of law authorizing the use of 3
speed monitoring systems in certain residential districts; and generally relating to 4
speed monitoring systems in residential districts. 5

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 16
That the Laws of Maryland read as follows: 17

Article – Transportation 18

21–101. 19

(a) In this title and Title 25 of this article the following words have the meanings 20
indicated. 21

(s) “Residential district” means an area that: 22

(1) Is not a business district; and 1

(2) Adjoins and includes a highway where the property along the highway, 2
for a distance of at least 300 feet, is improved mainly with residences or residences and 3
buildings used for business. 4

21–809. 5

(a) (1) In this section the following words have the meanings indicated. 6

(9) “Speed monitoring system” means a device with one or more motor 7
vehicle sensors producing recorded images of motor vehicles traveling at speeds at least 12 8
miles per hour above the posted speed limit. 9

(b) (1) (i) 1. A speed monitoring system may not be used by a local 10
jurisdiction under this section unless its use is authorized by the governing body of the local 11
jurisdiction by local law enacted after reasonable notice and a public hearing. 12

2. The State Highway Administration may use speed 13
monitoring systems on Interstate 83 in Baltimore County and Interstate 695 in Baltimore 14
County in accordance with this section. 15

3. The Marylan d Transportation Authority may use speed 16
monitoring systems on Maryland Route 200 (Intercounty Connector) in accordance with 17
this section. 18

(vi) This section applies to a violation of this subtitle recorded by a 19
speed monitoring system that meets the re quirements of this subsection and has been 20
placed: 21

1. [In Anne Arundel County, Montgomery County, or Prince 22
George’s County, on] ON a highway in a residential district, as defined in § 21–101 of this 23
title, with a maximum posted speed limit of 35 mile s per hour, which speed limit was 24
established using generally accepted traffic engineering practices; 25

2. In a school zone with a posted speed limit of at least 20 26
miles per hour; 27

3. In Prince George’s County: 28

A. Subject to subparagraph (vii) 1 of this paragraph, on 29
Maryland Route 210 (Indian Head Highway); or 30

B. On that part of a highway located within the grounds of 31
an institution of higher education as defined in § 10 –101(h) of the Education Article, or 32
within one–half mile of the groun ds of a building or property used by the institution of 33
higher education where generally accepted traffic and engineering practices indicate that 34

motor vehicle, pedestrian, or bicycle traffic is substantially generated or influenced by the 1
institution of higher education; 2

4. Subject to subparagraph (vii)2 of this paragraph, on 3
Interstate 83 in Baltimore City; 4

5. In Anne Arundel County, on Maryland Route 175 (Jessup 5
Road) between the Maryland Route 175/295 interchange and the Anne Arundel 6
County–Howard County line; 7

6. Subject to subparagraph (vii)3 of this paragraph, at the 8
intersection of Maryland Route 333 (Oxford Road) and Bonfield Avenue in Talbot County; 9

7. Subject to subparagraph (vii)4 of this paragraph, by the 10
State Highway Administration on Interstate 83 in Baltimore County or on Interstate 695 11
in Baltimore County; 12

8. By the Maryland Transportation Authority on Maryland 13
Route 200 (Intercounty Connector) in Montgomery County; or 14

9. Subject to subparagraph (xii) of this paragraph, in 15
Montgomery County on a highway identified in the municipality’s, county’s, or State’s most 16
recent Strategic Highway Safety Plan or Vision Zero Plan as a highway that is at high risk 17
for motor vehicle crashes that result in serious bodily injury or death. 18

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 19
October 1, 2026. 20
