AN ACT concerning 1
Baltimore County – Alcoholic Beverages – Sale for Off–Premises Consumption 2
FOR the purpose of providing that certain authorization for the holders of certain licenses 3
to sell alcoholic beverages for off–premises consumption in a certain manner applies 4
only if the Board of License Commissioners for Baltimore County has adopted certain 5
regulations; authorizing the holders of certain licenses in Baltimore County that 6
authorize the sale of alcoholic beverages at a restaurant or bar to sell certain 7
alcoholic beverages for off –premises consumption under certain circumstances; 8
prohibiting the Board from charging a certain license holder an additional fee under 9
certain circumstances; authorizing a local licensing board to limit the quantity of 10
alcoholic beverages sold to an individual in a single transaction; and generally 11
relating to the sale of alcoholic beverages at res taurants and bars in Baltimore 12
County. 13

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 2
That the Laws of Maryland read as follows: 3

This title applies only in Baltimore County. 6
13–1104. 7
(A) (1) THIS SECTION APPLIES ONLY IF THE BOARD HAS ADOPTED 8
REGULATIONS TO AUTHO RIZE THE SALE OF ALC OHOLIC BEVERAGES FOR 9
OFF–PREMISES CONSUMPTION IN ACCORDANCE WITH THIS SECTION. 10
(2) IN CONSIDERING WHETHER TO ADOPT REGULATIONS UNDER THIS 11
SECTION, THE BOARD SHALL CONSIDER THE PUBLIC HEALTH IMPACTS OF THE SALE 12
OF ALCOHOLIC BEVERAGES FOR OFF–PREMISES CONSUMPTION. 13
(B) (1) THIS SUBSECTION APPLI ES ONLY TO A CLASS B OR CLASS D 14
LICENSE THAT AUTHORI ZES THE SALE OF ALCO HOLIC BEVERAGES FOR 15
ON–PREMISES AND OFF–PREMISES CONSUMPTION AT A RESTAURANT OR BAR. 16
(2) A LICENSE HOLDER UNDER THIS SUBSECTION MAY OBTAIN A 17
PERMIT FROM THE BOARD THAT AUTHORIZES THE HOLDER TO SELL, IF 18
AUTHORIZED UNDER THE HOLDER’S LICENSE , MIXED DRINKS OR COCK TAILS IN 19
SEALED OR CLOSED CONTAINERS FOR OFF–PREMISES CONSUMPTION IF: 20
(I) THE MIXED DRINK OR C OCKTAIL IS PURCHASED ALONG 21
WITH PREPARED FOOD OTHER THAN PREPACKAGED SNACKS; 22
(II) THE INDIVIDUA L PURCHASING THE MIX ED DRINK OR 23
COCKTAIL: 24
1. IS AT LEAST 21 YEARS OLD; AND 25
2. PROVIDES VALID IDENTIFICATION AS PROOF OF AGE; 26
AND 27
(III) EACH MIXED DRINK OR COCKTAIL SOLD FOR OFF–PREMISES 28
CONSUMPTION IS: 29

1. PROVIDED IN THE MANU FACTURER’S ORIGINAL 1
SEALED CONTAINER OR IN A CONTAINER CLOSED WITH A CAP, CORK, SEAL, OR LID 2
WITH NO HOLES FOR STRAWS OR SIPPING; AND 3
2. SOLD NOT LATER THAN 11 P.M. 4
(C) THE BOARD: 5
(1) MAY NOT CHARGE A LIC ENSE HOLDER AN ADDIT IONAL FEE FOR 6
SELLING ALCOHOLIC BEVERAGES IN ACCORDANCE WITH THIS SECTION; AND 7
(2) MAY LIMIT THE QUANTITY OF ALCOHOLIC BEVERAGES THAT MAY 8
BE SOLD UNDER THIS SECTION TO AN INDIVIDUAL IN A SINGLE TRANSACTION. 9
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 10
1, 2026. 11
