FOR the purpose of authorizing the Information Technology Investment Fund, at the 4
discretion of the Secretary of Information Technology, to be used for certain purposes 5
in connection with certain information technology agreements; and generally related 6
to the Information Technology Investment Fund. 7

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18
That the Laws of Maryland read as follows: 19

(a) There is an Information Technology Investment Fund. 3
(l) (1) Notwithstanding subsection (b) of this section an d in accordance with 4
paragraph (2) of this subsection, money paid into the Fund under subsection (e)(2) of this 5
section: 6
(I) shall be used to support: 7
[(i)] 1. the State telecommunication and computer network 8
established under § 3.5 –404 of this tit le, including program development for these 9
activities; and 10
[(ii)] 2. the Statewide Public Safety Interoperability Radio 11
System, also known as Maryland First (first responder interoperable radio system team), 12
under Title 1, Subtitle 5 of the Public Safety Article; AND 13
(II) AT THE SECRETARY’S DISCRETION , MAY BE USED TO 14
SUPPORT STATE–OWNED COMMUNICATION SITES, COMMUNICATIONS FACILITIES, 15
AND TELECOMMUNICATIO NS EQUIPMENT USED IN CONNECTION WITH 16
INFORMATION TECHNOLO GY AGREEMENTS ENTERE D INTO UNDER § 3.5–307 OF 17
THIS SUBTITLE, INCLUDING PROGRAM MANAGEMENT FOR THESE ACTIVITIES. 18
(2) The Secretary may determine the portion of the money paid into the 19
Fund that shall be allocated to each program described in paragraph (1) of this subsection. 20
(3) (I) ON OR BEFORE JANUARY 15 EACH YEAR, THE SECRETARY 21
SHALL SUBMIT A REPOR T TO THE GENERAL ASSEMBLY, IN ACCORDANCE WITH § 22
2–1257 OF THE STATE GOVERNMENT ARTICLE, SPECIFYING THE AMOUN T OF 23
MONEY PAID INTO THE FUND THAT WAS ALLOCATED TO EACH PROGRAM DESCRIBED 24
IN PARAGRAPH (1) OF THIS SUBSECTION. 25
(II) THE REPORT REQUIRED U NDER THIS PARAGRAPH SHALL 26
INCLUDE HOW FUNDS WERE ALLOCATED AT THE SECRETARY’S DISCRETION UNDER 27
PARAGRAPH (1)(II) OF THIS SUBSECTION. 28
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 29
1, 2026. It shall remain effective for a period of 5 years and, at the end of June 30, 2031, 30
this Act, with no further action required by the General Assembly, shall be abrogated an d 31
of no further force and effect. 32
