FOR the purpose of requiring a State agency to provide certain climate and sustainability 4
information on submission of a certain contract award recommendation to the Board 5
of Public Works; requiring certain liaisons to the Board to ensure compliance with 6
this Act; requiring the climate and sustainability information to be placed on the 7
Board agenda; and generally relating to the Board of Public Works and climate and 8
sustainability. 9

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 20
That the Laws of Maryland read as follows: 21

In this title, “Board” means the Board of Public Works. 24

(A) THIS SECTION APPLIES TO THE FOLLOWING CAT EGORIES OF 2
CONTRACTS SUBMITTED TO THE BOARD FOR ITS APPROVAL: 3

(1) ARCHITECTURAL AND ENGINEERING SERVICES; 4

(2) CONSTRUCTION; 5

(3) ENERGY PERFORMANCE; 6

(4) GENERAL MISCELLANEOUS; 7

(5) LANDLORD LEASE; AND 8

(6) TENANT LEASE. 9

(B) THE BOARD SHALL REQUIRE AN AGENCY TO PROVIDE, TO THE EXTENT 10
APPLICABLE, THE FOLLOWING CLIMAT E AND SUSTAINABILITY I NFORMATION ON 11
SUBMISSION OF A CONTRACT AWARD RECOMMENDATION TO THE BOARD: 12

(1) IF THE CONTRACT CONT RIBUTES TO THE STATE’S GREENHOUSE 13
GAS EMISSIONS REDUCTION OR NET –ZERO CARBON GOALS, HOW THOSE BENEFITS 14
ARE ATTAINED; 15

(2) HOW THE CONTRACT PROVIDES FOR RESILIENCE ADAPTATION TO 16
PROJECTED CLIMATE CHANGE AND EXTREME WEATHER EVENTS OVER THE TERM OR 17
THE USEFUL LIFE OF THE SUPPLIES OR SERVICES; 18

(3) HOW THE CONTRACT ADV ANCES THE STATE’S GOALS AND 19
LEADERSHIP ON CLIMATE MITIGATION, ADAPTATION, RESILIENCY, OR INNOVATION 20
FOR SUSTAINABLY SOURCED SUPPLIES OR SERVICES; 21

(4) HOW THE CONTRACT INCLUDES SUPPLIES OR SERVICES THAT ARE 22
ENVIRONMENTALLY PREF ERABLE, AS DEFINED BY THE MARYLAND GREEN 23
PURCHASING COMMITTEE UNDER § 14–410 OF THIS ARTICLE; 24

(5) HOW THE CONTRACT INC ORPORATES ASPECTS OF DESIGN OR 25
CONSTRUCTION THAT AR E CONSISTENT WITH TH E STANDARDS ADOPTED BY THE 26
MARYLAND GREEN BUILDING COUNCIL; AND 27

(6) HOW THE CONTRACT INC ORPORATES ASPECTS OF DESIGN OR 1
CONSTRUCTION THAT AR E CONSISTEN T WITH THE INTENT OF THE HIGH 2
PERFORMANCE BUILDING REQUIREMENTS UNDER § 3–602.1 OF THIS ARTICLE. 3

(C) THE LIAISONS TO THE BOARD FROM THE OFFICES OF THE GOVERNOR, 4
THE COMPTROLLER, AND THE STATE TREASURER SHALL: 5

(1) ENSURE COMPLIANCE WI TH THE REQUIREMENTS OF THIS 6
SECTION; AND 7

(2) ENSURE THAT THE INFO RMATION REQUIRED IN THIS SECTION 8
APPEARS ON THE AGEND A OF THE BOARD WHEN THE CONTRA CT IS TO BE 9
CONSIDERED. 10

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 11
1, 2026. 12
