FOR the purpose of requiring the reporting of certain procurement contracts and 4
memoranda of understanding entered into by certain public elementary and 5
secondary education systems in the State; requiring each local school system to make 6
public in a certai n manner certain in –kind services agreements, procurement 7
contracts, and memoranda of understanding; and generally relating to agreements, 8
procurement contracts, and memoranda of understanding entered into by education 9
systems in the State. 10

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 16
That the Laws of Maryland read as follows: 17

(A) (1) IN THIS SECTION THE F OLLOWING WORDS HAVE THE MEANINGS 20
INDICATED. 21

(2) “AGREEMENT” MEANS: 22

(I) AN IN–KIND SERVICES AGREEMENT; 1

(II) A PROCUREMENT CONTRACT; AND 2

(III) A MEMORANDUM OF UNDERSTANDING. 3

(3) “COVERED ENTITY” MEANS: 4

(I) A COUNTY BOARD; 5

(II) A COUNTY SUPERINTENDENT; 6

(III) A SCHOOL IN THE PUBLIC ELEMENTARY AND SECON DARY 7
EDUCATION SYSTEM OF THE STATE; 8

(IV) THE STATE BOARD; OR 9

(V) THE STATE SUPERINTENDENT. 10

(4) “PROCUREMENT CONTRACT ” HAS THE MEANING STAT ED IN § 11
11–101 OF THE STATE FINANCE AND PROCUREMENT ARTICLE. 12

(B) (1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION , 13
THIS SECTION APPLIES TO: 14

(I) A MEMORANDUM OF UNDERSTANDING ENTERED INTO BY A 15
COVERED ENTITY; AND 16

(II) A PROCUREMENT CONTRACT ENTERED INTO BY A COVERED 17
ENTITY. 18

(2) THIS SECTION DOES NOT APPLY TO A PROCUREMENT CONTRACT 19
OR MEMORANDUM OF UNDERSTANDING THAT INCLUDES INFORMATION THAT: 20

(I) MAY BE WITHHELD FROM DISCLOSURE BY LAW; OR 21

(II) IS PROHIBITED FROM DISCLOSURE BY LAW. 22

(C) (1) (I) ON OR BEFORE SEPTEMBER 1 EACH YEAR, EACH COVERED 23
ENTITY SHALL REPORT TO THE STATE SUPERINTENDENT A LIST OF EACH 24
PROCUREMENT CONTRACT OR MEMORANDUM OF UNDERSTANDING ENTERED INTO 25
IN THE PRECEDING FISCAL YEAR BY THE COVERED ENTITY. 26

(II) A COVERED ENTITY THAT IS A COUNTY SUPERINT ENDENT 1
OR A SCHOOL IN THE P UBLIC ELEMENTARY AND SECONDARY EDUCATION SYSTEM 2
OF THE STATE MAY SATISFY THE REPORTING REQUIREMEN T UNDER 3
SUBPARAGRAPH (I) OF THIS PARAGRAPH B Y SUBMITTING THE REQ UIRED 4
INFORMATION TO THE COUNTY BOARD OF EDUCATION BY A DATE DETER MINED BY 5
THE COUNTY BOARD. 6

(III) AS PART OF A REPORT MADE UNDER SUBPARAGRAPH (I) OF 7
THIS PARAGRAPH, A COUNTY BOARD SHALL REPORT ANY INFORMATION RECEIVED 8
UNDER SUBPARAGRAPH (II) OF THIS PARAGRAPH. 9

(2) (I) ON OR BEFORE OCTOBER 1 EACH YEAR , THE STATE 10
SUPERINTENDENT SHALL: 11

1. ISSUE A REPORT COMPILING THE INFORMATION 12
PROVIDED UNDER PARAGRAPH (1) OF THIS SUBSECTION; AND 13

2. SUBMIT THE REPORT, IN ACCORDANCE WITH § 2–1257 14
OF THE STATE GOVERNMENT ARTICLE, TO THE SENATE BUDGET AND TAXATION 15
COMMITTEE, THE SENATE COMMITTEE ON EDUCATION, ENERGY, AND THE 16
ENVIRONMENT, THE HOUSE APPROPRIATIONS COMMITTEE, AND THE HOUSE WAYS 17
AND MEANS COMMITTEE. 18

(II) THE REPORT REQUIRED U NDER SUBPARAGRAPH (I) OF 19
THIS PARAGRAPH SHALL INCLUDE: 20

1. A LIST OF EACH PROCURE MENT CONTRACT AND 21
MEMORANDUM OF UNDERSTANDING ENTERED INTO BY EACH COVERED ENTITY; 22

2. THE TOTAL AMOUNT REQU IRED TO BE PAID BY A 23
COVERED ENTITY UNDER A PROCUREMENT CONTRACT; AND 24

3. THE TOTAL AMOUNT PAID BY A COVERED ENTITY 25
DURING THE PRECEDING FISCAL YEAR. 26

(D) (1) ON OR BEFORE SEPTEMBER 1, 2026, EACH LOCAL SCHOOL 27
SYSTEM SHALL MAKE PUBLICLY AVAILABLE ON ITS WEBSITE EACH AGREEMENT THE 28
LOCAL SCHOOL SYSTEM ENTERED INTO FROM JULY 1, 2025, TO JUNE 30, 2026. 29

(2) WITHIN 30 DAYS AFTER AN AGREEMENT A LOCAL SCHOOL SYSTEM 30
ENTERS INTO ON OR AFTER JULY 1, 2026, THE LOCAL SCHOOL SYSTEM SHALL MAKE 31
THE AGREEMENT PUBLICLY AVAILABLE ON ITS WEBSITE. 32

(3) THE DEPARTMENT SHALL ENSURE COMPLIA NCE WITH THIS 1
SUBSECTION. 2

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 3
1, 2026. 4
