Prince George’s County – Speed Monitoring Systems – Maryland Route 210 – 2
Penalties 3

FOR the purpose of authorizing under certain circumstances and requiring under certain 4
circumstances the Motor Vehicle Administration to suspend the registration of motor 5
vehicles involved in violations recorded by a speed monitoring system placed on 6
Maryland Route 210 (Indian Head Highway) in Prince George’s County; and 7
generally relating t o speed monitoring systems placed on Maryland Route 210 8
(Indian Head Highway) in Prince George’s County. 9

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 20
That the Laws of Maryland read as follows: 21

Article – Transportation 22

(a) (9) “Speed monitoring system” means a device with one or more motor 1
vehicle sensors producing recorded images of motor vehicles traveling at speeds at least 12 2
miles per hour above the posted speed limit. 3

(b) (1) (vii) 1. Not more than six mobile or stationary speed monitoring 4
systems may be placed on Maryland Route 210 (Indian Head Highway). 5

(g) (1) If a person liable under t his section does not pay the civil penalty or 6
contest the violation, the Administration may refuse to register or reregister the motor 7
vehicle cited for the violation. 8

(2) (I) THIS PARAGRAPH APPLIE S ONLY TO VIOLATIONS 9
RECORDED BY A SPEED MONITORING SYSTEM PLACED ON MARYLAND ROUTE 210 10
(INDIAN HEAD HIGHWAY) IN PRINCE GEORGE’S COUNTY. 11

(II) 1. SUBJECT TO SUBPARAGRA PH (III) OF THIS 12
PARAGRAPH, IF A PERSON LIABLE U NDER THIS SECTION DO ES NOT PAY THE CIVIL 13
PENALTY OR CONTEST T HE VIOLATION, THE ADMINISTRATION, ON NOTICE FROM 14
PRINCE GEORGE’S COUNTY, MAY SUSPEND THE REGI STRATION OF THE MOTO R 15
VEHICLE INVOLVED IN THE VIOLATION. 16

2. IF THE ADMINISTRATION DETERM INES THAT A 17
SUSPENSION SHOULD BE IMPOSED UNDER THIS S UBPARAGRAPH, THE 18
ADMINISTRATION SHALL GIVE WRITTEN NOTICE TO THE OWNER OF THE MOTOR 19
VEHICLE, AND THE OWNER MAY RE QUEST A HEARING AS P ROVIDED IN TITLE 12, 20
SUBTITLE 2 OF THIS ARTICLE. 21

(III) 1. THE ADMINISTRATION, ON NOTICE FROM PRINCE 22
GEORGE’S COUNTY, SHALL SUSPEND THE RE GISTRATION OF A MOTO R VEHICLE 23
INVOLVED IN VIOLATIONS FOR WHICH THE OWNER OF THE MOTOR VEHICLE OR THE 24
PERSON LIABLE UNDER THIS SECTION: 25

A. WITHIN ANY 90–DAY PERIOD , DOES NOT PAY THE 26
CIVIL PENALTY OR CON TEST THE VIOLATION F OR AT LEAST THREE OV ERDUE 27
CITATIONS; OR 28

B. AT ANY TIME, DOES NOT PAY THE CIVI L PENALTY OR 29
CONTEST THE VIOLATION FOR ANY NUMBER OF OVERDUE CITATIONS THAT TOTAL 30
AT LEAST $500 IN CIVIL PENALTIES. 31

2. THE ADMINISTRATION SHALL REINSTATE A 32
REGISTRATION SUSPENDED UNDER THIS SUBPARAGRAPH ON NOTICE FROM PRINCE 33
GEORGE’S COUNTY THAT THE OWNER OF THE MOTOR VEHICLE OR THE PERSON 34
LIABLE UNDER THIS SECTION HAS PAID: 35

A. ALL OVERDUE CIVIL PEN ALTIES AND ANY RELAT ED 1
FEES AND COURT COSTS APPLICABLE TO THE MOTOR VEHICLE THAT DERIVED FROM 2
THE OVERDUE CITATIONS; AND 3

B. A $30 ADMINISTRATIVE FEE T O PRINCE GEORGE’S 4
COUNTY. 5

(IV) 1. ON OR BEFORE DECEMBER 1, 2026, AND EACH 6
DECEMBER 1 THEREAFTER, THE ADMINISTRATION SHALL REPORT TO THE 7
GENERAL ASSEMBLY, IN ACCORDANCE WITH § 2–1257 OF THE STATE GOVERNMENT 8
ARTICLE, ON ACTIONS TAKEN UNDER THIS PARAGRAPH. 9

2. THE REPORT SHALL INCLUDE: 10

A. THE NUMBER OF REGISTRATIONS SUSPENDED UNDER 11
THIS PARAGRAPH, BROKEN DOWN BY THE REASONS FOR THE SUSPENSIONS; 12

B. THE NUMBER OF REGISTR ATIONS REINSTATED 13
AFTER BEING SUSPENDED UNDER THIS PARAGRAPH; 14

C. A GEOGRAPHIC BREAKDOWN OF THE MOTOR VEHICLE 15
REGISTRATIONS SUSPENDED UNDER THIS PARAGRAPH; AND 16

D. A DESCRIPTION OF THE O UTCOMES OF COURT 17
PROCEEDINGS INVOLVING PERSONS SUBJECT TO THIS PARAGRAPH. 18

26–305. 19

(a) The Administration may not register or transfer the registration of any vehicle 20
involved in a parking violation under this subtitle, a violation under any federal parking 21
regulation that applies to property in this State under the jurisdiction of the U.S. 22
government, a violation of § 21–202(h) of this article as determined under § 21–202.1 of this 23
article or Title 21, Subtitle 8 of this article as determined under § 21 –809 or § 21 –810 of 24
this article, or a violation of the Illegal Dumping and Litter Control Law under § 10–110 of 25
the Criminal Law Article or a local law or ordinance adopted by Baltimore City relating to 26
the unlawful disposal of litter as determined under § 10 –112 of the Criminal Law Article, 27
if: 28

(1) It is notified by a political subdivision or authorized State ag ency that 29
the person cited for the violation under this subtitle, § 21 –202.1, § 21–809, or § 21–810 of 30
this article, or § 10–110 or § 10–112 of the Criminal Law Article has failed to either: 31

(i) Pay the fine for the violation by the date specified in the citation; 32
or 33

(ii) File a notice of his intention to stand trial for the violation; 1

(2) It is notified by the District Court that a person who has elected to stand 2
trial for the violation under this subtitle, under § 21 –202.1, § 21–809, or § 21 –810 of this 3
article, or under § 10–110 or § 10–112 of the Criminal Law Article has failed to appear for 4
trial; or 5

(3) It is notified by a U.S. District Court that a person cited for a violation 6
under a federal parking regulation: 7

(i) Has failed to pay the fine for the violation by the date specified 8
in the federal citation; or 9

(ii) Either has failed to file a notice of the person’s intention to stand 10
trial for the violation, or, if electing to stand trial, has failed to appear for trial. 11

(b) (1) Notwithstanding the provisions of subsection (a) of this section, the 12
Administration may suspend the registration of a vehicle involved in a parking violation 13
under this subtitle or a violation under any federal parking regulation that applies to 14
property in this State under the jurisdiction of the U.S. government if notified in accordance 15
with subsection (a) of this section that the violator is a chronic offender. 16

(2) The Administration may adopt rules and regulations to define chronic 17
offender and develop procedures to carry out the suspension of registration as authorized 18
by this subsection. 19

(3) FOR A VIOLATION RECOR DED BY A SPEED MONIT ORING SYSTEM 20
ON MARYLAND ROUTE 210 (INDIAN HEAD HIGHWAY) IN PRINCE GEORGE’S 21
COUNTY, THE ADMINISTRATION: 22

(I) MAY SUSPEND A VEHICLE RE GISTRATION AS AUTHOR IZED 23
UNDER § 21–809(G)(2)(II) OF THIS ARTICLE; AND 24

(II) SHALL SUSPEND A VEHIC LE REGISTRATION AS R EQUIRED 25
UNDER § 21–809(G)(2)(III) OF THIS ARTICLE. 26

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 27
October 1, 2026. 28
