A BILL ENTITLED

AN ACT concerning 1

Wicomico County – Highway Pedestrian Safety Act 2

FOR the purpose of prohibiting a person in Wicomico County from standing in a roadway, 3
shoulder, median divide, or intersection determined by the county or a municipal 4
corporation in the county to be inherently dangerous; prohibiting a police officer from 5
issuing a citation for a violation of this Act unless certain conditions are met; and 6
generally relating to prohibiting standing in inherently dangerous roadways, 7
shoulders, median dividers, or intersections in Wicomico County. 8

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 14
That the Laws of Maryland read as follows: 15

Article – Transportation 16

21–507.1. 17

(A) THIS SECTION APPLIES ONLY IN WICOMICO COUNTY. 18

(B) IN THIS SECTION , “INHERENTLY DANGEROUS ” MEANS POSING A 19
SERIOUS RISK OF INJURY TO A PEDESTRIAN, A DRIVER OR PASSENGER IN A VEHICLE, 20
OR OTHER PERSONS THAT CANNOT BE MIT IGATED WITH THE EXER CISE OF 21
ORDINARY CARE. 22

(C) A PERSON MAY NOT STAND IN A ROADWAY , SHOULDER, MEDIAN 1
DIVIDER, OR INTERSECTION DETE RMINED BY THE COUNTY OR A MUNICIPAL 2
CORPORATION IN THE COUNTY TO BE INHERENTLY DANGEROUS. 3

(D) A POLICE OFFICER MAY N OT ISSUE A CITATION FOR A VIOLATION OF 4
THIS SECTION UNLESS: 5

(1) THE INHERENTLY DANGER OUS ROADWAY, SHOULDER, MEDIAN 6
DIVIDER, OR INTERSECTION HAS APPROPRIATE SIGNS INSTALLED THAT NOTIFY THE 7
PUBLIC THAT A PERSON MAY NOT STAND IN VIOLATION OF THIS SECTION; AND 8

(2) THE SIGNS ARE INSTALL ED IN ACCORDANCE WIT H THE MANUAL 9
AND SPECIFICATIONS F OR A UN IFORM SYSTEM OF TRAFFIC CONTROL D EVICES 10
ADOPTED BY THE STATE HIGHWAY ADMINISTRATION UNDER § 25–104 OF THIS 11
ARTICLE. 12

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect June 13
1, 2026. 14
