FOR the purpose of requiring the State Department of Education to develop or approve an 4
artificial intelligence training program for members of county boards of education 5
that meets certain requirements; requiring each member of a county board to 6
complete a certain artificial intelligence training program each year; and generally 7
relating to an artificial intelligence training program for members of county boards 8

Preamble 20

WHEREAS, Rapid advances in artificial intelligence technology continue to 21
transform education; and 22

WHEREAS, R ecent federal actions, including Executive Order 14277 , Advancing 23
Artificial Intelligence Education for American Youth, issued by President Donald J. Trump 24
on April 23, 2025 , establish a national priority to responsibly implement artificial 25
intelligence technology in educational settings; and 26

WHEREAS, County boards of education are tasked with making decisions to solve 1
complex problems regarding the use of artificial intelligence technology in the State’s public 2
schools, including student privacy concerns; and 3

WHEREAS, Members of county boards of education need foundational and 4
continuing training to successfully implement the safe, equitable, and strategic use of 5
artificial intelligence technology in the State’s public schools; now, therefore, 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 7
That the Laws of Maryland read as follows: 8

Article – Education 9

(A) IN THIS SECTION , “ARTIFICIAL INTELLIGE NCE” HAS THE MEANING 11
STATED IN § 3.5–801 OF THE STATE FINANCE AND PROCUREMENT ARTICLE. 12

(B) THE DEPARTMENT SHALL DEVELOP OR APPROVE AN ARTIFICIAL 13
INTELLIGENCE TRAININ G PROGRAM FOR MEMBERS OF COUNTY BO ARDS THAT 14
INCLUDES: 15

(1) A FOUNDATIONAL TRAINING; AND 16

(2) CONTINUING ANNUAL TRAINING. 17

(C) (1) THE FOUNDATIONAL TRAINING REQUIRED UNDER SUBSECTION 18
(B) OF THIS SECTION SHALL CONTAIN THE FOLLOWING CURRICULUM COMPONENTS: 19

(I) FUNDAMENTALS OF ARTIF ICIAL INTELLIGENCE , 20
INCLUDING THE CAPABILITIES, LIMITATIONS, AND RISKS OF ARTIFICIAL 21
INTELLIGENCE; 22

(II) ARTIFICIAL INTELLIGENCE TECHNOLOGY USE POLICY 23
DEVELOPMENT, INCLUDING SAFETY AND ETHICAL CONSIDERATIONS BY AGE AND 24
GRADE LEVEL; 25

(III) STUDENT PRIVACY AND DATA PROTECTION LAWS; AND 26

(IV) ARTIFICIAL INTELLIGEN CE TECHNOLOGY PROCUR EMENT 27
GUIDELINES AND OVERSIGHT. 28

(2) THE CONTINUING ANNUAL TRAINING REQUIRED UNDER 1
SUBSECTION (B) OF THIS SECTION SHALL CONTAIN THE FOLLOWING CURRICULUM 2
COMPONENTS: 3

(I) A SUMMARY OF THE TOPIC S COVERED IN THE 4
FOUNDATIONAL TRAINING; AND 5

(II) DEVELOPMENTS IN ARTIF ICIAL INTELLIGENCE 6
TECHNOLOGY, EVOLVING BEST PRACTI CES FOR USE IN EDUCATION AL SETTINGS , 7
AND NEW GUIDANCE. 8

(D) THE TRAINING PROGRAM DEVELOPED OR APPROVED BY THE 9
DEPARTMENT UNDER THIS SECTION MAY BE OFFERED: 10

(1) IN PERSON, ONLINE, OR IN A HYBRID FORMAT; AND 11

(2) BY AN ORGANIZATION RESPONS IBLE FOR THE PROFESSIONAL 12
DEVELOPMENT AND EDUCATION OF MEMBERS OF COUNTY BOARDS. 13

(E) (1) (I) WITHIN 1 YEAR AFTER THE FIRST DAY OF A COUNTY BOARD 14
MEMBER’S TERM OF OFFICE, THE MEMBER SHALL COMPLETE THE FOUNDATIONAL 15
ARTIFICIAL INTELLIGENCE TRAINING REQUIRED UNDER SUBSECTION (B) OF THIS 16
SECTION. 17

(II) A MEMBER OF A COUNTY BOARD IN OFFICE ON JULY 1, 18
2026, SHALL COMPLETE THE FOUNDATIONAL ARTIFICIAL INTELLIGENCE TRAINING 19
REQUIRED UNDER SUBSECTION (B) OF THIS SECTION ON OR BEFORE JUNE 30, 2027. 20

(2) ON OR BEFORE JUNE 30 OF EACH YEAR OF A COUNTY BOARD 21
MEMBER’S TERM AFTER COMPLETION OF THE FOUNDATIONAL TRAINING, THE 22
MEMBER SHALL COMPLETE THE CONTINUING ARTIFICIAL INTELLIGENCE TRAINING 23
REQUIRED UNDER SUBSECTION (B) OF THIS SECTION. 24

(F) (1) ON COMPLETION OF THE ARTIFICIAL INTELLIGE NCE TRAINING 25
REQUIRED UNDER THIS SECTION, A MEMBER OF A COUNTY BOARD SHALL SUBMIT A 26
COPY OF THE MEMBER’S CERTIFICATE OF COMPLETION TO: 27

(I) THE PRESIDENT OF THE COUNTY BOARD ON WHICH THE 28
MEMBER SERVES; AND 29

(II) THE DEPARTMENT. 30

(2) A COUNTY BOARD OR THE DEPARTMENT MAY ESTABL ISH 1
PROCESSES TO AUTOMATICALLY REC ORD A COUNTY BOARD MEMBER’S 2
COMPLETION OF THE ARTIFICIAL INTELLIGE NCE TRAINING REQUIRE D UNDER 3
SUBSECTION (B) OF THIS SECTION IN PLACE OF THE SUBMISSION RE QUIREMENT 4
UNDER PARAGRAPH (1) OF THIS SUBSECTION. 5

(3) THE DEPARTMENT SHALL PUBLISH A REPORT ON ITS WEBSITE 6
LISTING ANY MEMBER OF A COUN TY BOARD WHO DID NOT COMPLETE THE 7
ARTIFICIAL INTELLIGENCE TRAINING REQUIRE D UNDER SUBSECTION (B) OF THIS 8
SECTION DURING THE PRIOR YEAR. 9

(G) ON OR BEFORE OCTOBER 1, 2028, AND EACH OCTOBER 1 EVERY 2 10
YEARS THEREAFTER , THE DEPARTMENT SHALL SUBM IT A REPORT TO THE 11
GOVERNOR AND , IN ACCORDANCE W ITH § 2–1257 OF THE STATE GOVERNMENT 12
ARTICLE, THE GENERAL ASSEMBLY ON THE EFFECTIVENESS OF THE ARTIFICIAL 13
INTELLIGENCE TRAINING PROGRAM FOR MEMBERS OF COUNTY BOARDS REQUIRED 14
UNDER THIS SECTION. 15

3.5–801. 17

(a) In this subtitle the following words have the meanings indicated. 18

(c) “Artificial intelligence” means a machine–based system that: 19

(1) can, for a given set of human –defined objectives, make predictions, 20
recommendations, or decisions influencing real or virtual environments; 21

(2) uses machine and human –based inputs to perceive real and virtual 22
environments and abstracts those perceptions into models through analysis in an 23
automated manner; and 24

(3) uses model inference to formulate options for information or action. 25

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 26
1, 2026. 27
