AN ACT concerning 1

Frederick County – Sheriff – Salary 2

FOR the purpose of altering the annual salary of the Sheriff of Frederick County to be a 3
certain amount for a certain calendar year; altering the annual salary of the Sheriff 4
of Frederick County to be a certain percentage of the salary of the State’s Attorney 5
for Frederick County for certain subsequent calendar years; and genera lly relating 6
to the salary of the Sheriff of Frederick County. 7

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18
That the Laws of Maryland read as follows: 19

(a) This section applies only in Frederick County. 2

(b) (1) The Sheriff of Frederick County shall receive an annual salary of: 3

(I) $125,000 FOR CALENDAR YEAR 2026; 4

(II) $175,000 FOR CALENDAR YEAR 2027; AND 5

(III) 82.5% OF THE STATE’S ATTORNEY FOR FREDERICK 6
COUNTY’S ANNUAL SALARY INCL UDING ANY INCREMENTS AND SALARY 7
ADJUSTMENTS AUTHORIZED UNDER § 15–411(B)(2) OF THE CRIMINAL PROCEDURE 8
ARTICLE FOR CALENDAR YEAR 2028 AND EACH SUBSEQUENT CALENDAR YEAR. 9

(2) ANY CHANGE IN THE SAL ARY PAID TO THE STATE’S ATTORNEY 10
FOR FREDERICK COUNTY DURING THE TERM OF OFFICE OF THE SHERIFF MAY NOT 11
APPLY DURING THE SHERIFF’S CURRENT TERM OF OFFICE, BUT THE CHANGED RATE 12
SHALL TAKE EFFECT AT THE BEGINNING OF THE NEXT FOLLOWING TERM OF OFFICE. 13

SECTION 2. AND BE IT FURTHER ENACTED, That, in accordance with Article 14
III, § 35 of the Maryland Constitution, this Act may not be construed to extend or apply to 15
the salary or compensation of the Sh eriff of Frederick County while serving in a term of 16
office beginning before the effective date of this Act, but the provisions of this Act 17
concerning the salary or compensation of the Sheriff of Frederick County shall take effect 18
at the beginning of the n ext following term of office. This limitation does not apply to an 19
individual appointed or elected after the effective date of this Act to fill out an unexpired 20
term. A Sheriff of Frederick County whose term begins after the effective date of this Act 21
may not receive during the term of office of the Sheriff an increase in salary or 22
compensation as a result of the increase in the salary of the State’s Attorney for Frederick 23
County if the increase of the salary of the State’s Attorney for Frederick County was not 24
fixed at the time the term of office of the Sheriff began. 25

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 26
October 1, 2026. 27
