INSTRUMENTALITY OF THE STATE. 2

(C) THE EXERCISE BY THE AUTHORITY OF A POWER UNDER THIS SUBTITLE 3
IS THE PERFORMANCE OF AN ESSENTIAL GOVERNMENTAL FUNCTION. 4

(D) THE GOVERNOR MAY SHALL INCLUDE EACH YEAR IN THE STATE 5

(1) THERE EXISTS WITHIN VARIOUS NEIGHBORHOOD S IN PRINCE 12
GEORGE’S COUNTY, PARTICULARLY THE SUITLAND ROAD AND SILVER HILL ROAD 13
CORRIDOR, A NEED FOR RESIDENTI AL AND COMMERCIAL DE VELOPMENT OR 14
REDEVELOPMENT IN FURTHERANCE OF THE PUBLIC’S INTEREST; 15

(2) THE SUITLAND ROAD AND SILVER HILL ROAD CORRIDOR HAS 16
EXPERIENCED LOW HOUS ING AND ECONOMIC DEV ELOPMENT IN THE COMM UNITY 17
FOR DECADES; 18

(3) AREAS IN THE SUITLAND ROAD AND SILVER HILL ROAD 19
CORRIDOR INCLUDE BOTH AREAS THAT ARE CONSIDERED SLUM OR BLIGHTED AND 20
AREAS THAT ARE DETER IORATED OR SUBJECT T O FURTHER DETERIORAT ING 21
CONDITION, AND THOSE AREAS ARE IN NEED OF DEVELOPME NT OR 22
REDEVELOPMENT FOR THE PUBLIC BENEFIT; 23

(4) THE REVITALIZATION O F AREAS WITHIN THE SUITLAND ROAD 24
AND SILVER HILL ROAD CORRIDOR NEEDING COMM ERCIAL DEVELOPMENT O R 25
REDEVELOPMENT IS AN ESSENTIAL GOVERNMENTAL FUNCTION AND IS A PUBLIC 26
USE THAT WILL CONFER A PUBLIC BENEFIT ON CITIZENS OF PRINCE GEORGE’S 27
COUNTY BY: 28

(I) RELIEVING CONDITIONS OF UNEMPLOYMENT; 29

(II) ENCOURAGING THE INCR EASE OF COMMERCE AND A 30
BALANCED ECONOMY; 31

(III) ASSISTING IN THE RET ENTION OF BUSINESSES AND 1
RESIDENTS; 2

(IV) ATTRACTING NEW INDUSTRIES AND COMMERCE; 3

(VI) GENERALLY PROMOTING THE HEALTH , WELFARE, AND 5
PUBLIC SAFETY OF RES IDENTS IN PRINCE GEORGE’S COUNTY AND INCREASING 6
PROPERTY TAX REVENUES FOR THE STATE AND PRINCE GEORGE’S COUNTY; 7

(5) THE ESTABLISHMENT OF THIS PUBLIC AUTHORITY TO PROVIDE 8
FINANCIAL RESOURCES FOR THE DEVELOPMENT AND ESTA BLISHMENT OF 9
RESIDENCES AND BUSIN ESSES THROUGH COMMUN ITY ORGANIZATIONS IN THE 10
TARGET AREA WILL SIG NIFICANTLY IMPROVE PRINCE GEORGE’S COUNTY 11
NEIGHBORHOODS AND IN CREASE PROPERTY TAX REVENUES FOR THE STATE AND 12
PRINCE GEORGE’S COUNTY; AND 13

(6) THE AUTHORITY IS THE ECON OMIC DEVELOPMENT AUT HORITY 14
FOR THE STATE TO BENEFIT THE NEIGHBORHOODS OF PRINCE GEORGE’S COUNTY 15
WITHIN THE TARGET AREA. 16

(B) THE LEGISLATIVE PURPOSES OF THE AUTHORITY ARE TO: 17

(1) REVIVE THE VARIOUS COMMUNITIES ALONG THE SUITLAND ROAD 18
AND SILVER HILL ROAD CORRIDOR IN PRINCE GEORGE’S COUNTY; 19

(2) PROMOTE ECONOMIC DEVELOPMENT; 20

(3) ENCOURAGE THE INCREASE OF BUSINESS ACTIVITY, COMMERCE, 21
AND A BALANCED ECONOMY IN PRINCE GEORGE’S COUNTY; 22

(4) HELP TO RETAIN AND A TTRACT BUSINESS ACTIVITY AN D 23
COMMERCE IN PRINCE GEORGE’S COUNTY; AND 24

(5) PROMOTE THE HEALTH , PUBLIC SAFETY , RIGHT OF GAINFUL 25
EMPLOYMENT, AND WELFARE OF RESIDENTS OF PRINCE GEORGE’S COUNTY. 26

(C) THE GENERAL ASSEMBLY INTENDS THAT: 27

(1) THE AUTHORITY OPERATE A ND EXERCISE ITS CORP ORATE 28
POWERS ALONG THE SUITLAND ROAD AND SILVER HILL ROAD CORRIDOR IN 29
PRINCE GEORGE’S COUNTY; 30

(2) WITHOUT LIMITING ITS AUTHORITY TO OTHERWISE EXERCISE ITS 1
POWERS, THE AUTHORITY EXERCISES ITS POWERS TO ASSIST PRIVATE REAL ESTATE 2
ENTITIES AND NONPROFIT CO MMUNITY DEVELOPMENT CORPORATIONS TO 3
DEVELOP AND REHABILI TATE HOUSING AND COM MERCIAL UNITS IN PRINCE 4
GEORGE’S COUNTY AND SUPPORT LOCAL ECONOMIC DEVELOPMENT AGENCIES TO 5
CONTRIBUTE TO THE EX PANSION, MODERNIZATION, AND RETENTION OF EXI STING 6
ENTERPRISES IN PRINCE GEORGE’S COUNTY AS WELL AS THE ATTRACTION OF NEW 7
BUSINESSES TO PRINCE GEORGE’S COUNTY; AND 8

(3) THE AUTHORITY SHOULD NOT OWN AND OPERATE A PR OJECT 9
UNLESS: 10

(I) THE BOARD DETERMINES BY R ESOLUTION THAT THE 11
PRIVATE SECTOR HAS N OT DEMONSTRATED SERIOUS AND SIGNIFICANT INTE REST 12
AND DEVELOPMENT CAPACITY TO OWN AND OPERATE THE PROJECT; OR 13

(II) A REPRESENTATIVE OF A GOVERNMENTAL UNIT REQUESTS 14
IN WRITING THAT THE AUTHORITY OWN AND OPERATE THE PROJECT. 15

(C) ON OR BEFORE DECEMBER 15, 2027, THE AUTHORITY SHALL REPORT 12
ITS COMPREHENSIVE NEIGHBORHOOD REVITALIZATION STRATEGY, INCLUDING ANY 13
PROCUREMENT ACTIVITIES UNDERTAKEN BY THE AUTHORITY, TO THE GOVERNOR 14
AND, IN ACCORDANCE WITH § 2–1257 OF THE STATE GOVERNMENT ARTICLE, TO 15
THE SENATE BUDGET AND TAXATION COMMITTEE, THE HOUSE ECONOMIC 16
MATTERS COMMITTEE, AND THE HOUSE APPROPRIATIONS COMMITTEE. 17

DEVELOPMENT OR PROJE CT, THE AUTHORITY’S ACTIVITIES IN OPER ATING AND 8
MAINTAINING A DEVELOPMENT OR PROJE CT, AND REVENUES FROM A 9
DEVELOPMENT OR PROJECT. 10

(B) ANY PROPERTY THAT IS SOLD OR LEASED BY TH E AUTHORITY TO A 11
PRIVATE ENTITY IS SU BJECT TO PRINCE GEORGE’S COUNTY AND LOCAL REAL 12
PROPERTY TAXES FROM THE TIME OF SALE OR LEASE. 13

(C) THE AUTHORITY IS EXEMPT F ROM STATE AND LOCAL TRANS FER AND 14
RECORDATION TAX. 15

(D) THE AUTHORITY IS EXEMPT F ROM THE SALES AND US E TAX ON 16
CONSTRUCTION MATERIALS FOR A PROJECT IN THE TARGET AREA OF THE BUFFER 17
ZONE. 18

(A) IN THIS SECTION , “FUND” MEANS THE SUITLAND DEVELOPMENT 20
AUTHORITY FUND. 21

(B) THERE IS A SUITLAND DEVELOPMENT AUTHORITY FUND. 22

(C) THE PURPOSE OF THE FUND IS TO PROVIDE FU NDS FOR THE 23
AUTHORITY TO USE FOR CONSULTING FEES , SALARIES, AND ADMINISTRATIVE 24
EXPENSES. 25

(D) THE AUTHORITY SHALL ADMINISTER THE FUND. 26

(E) (1) THE FUND IS A SPECIAL , NONLAPSING FUND THAT IS NOT 27
SUBJECT TO § 7–302 OF THE STATE FINANCE AND PROCUREMENT ARTICLE. 28

(2) THE STATE TREASURER SHALL HOLD THE FUND SEPARATELY , 29
AND THE COMPTROLLER SHALL ACCOUNT FOR THE FUND. 30

(F) THE FUND CONSISTS OF: 1

(1) MONEY APPROPRIATED IN THE STATE BUDGET TO THE FUND; 2

(2) INTEREST EARNINGS; AND 3

(3) ANY OTHER MONEY FROM ANY OTHER SOURCE ACC EPTED FOR 4
THE BENEFIT OF THE FUND. 5

(G) THE FUND MAY BE USED ONLY FOR ADMINISTRATIVE PURPOSES AND TO 6
CARRY OUT THE FUNCTIONS OF THIS SUBTITLE. 7

(H) THE STATE TREASURER SHALL INVES T THE MONEY OF THE FUND IN 8
THE SAME MANNER AS OTHER STATE MONEY MAY BE INVESTED. 9

(I) EXPENDITURES FROM THE FUND MAY BE MADE ONLY IN ACCORDANCE 10
WITH THE STATE BUDGET. 11

(a) (2) (i) This paragraph does not apply in fiscal years 2024 through 2028. 14

(ii) Notwithstanding any other provision of law, and unless 15
inconsistent with a federal law, grant agreement, or other federal requirement or with the 16
terms of a gift or settlement agreement, net interest on all State money allocated by the 17
State Treasurer under this section to special funds or accounts, and otherwise entitled to 18
receive interest earnings, as accounted for by the Comptroller, shall accrue to the General 19
Fund of the State. 20

(iii) The provisions of subparagraph (ii) of this paragraph do not 21
apply to the following funds: 22

212. the Department of Social and Economic Mobility Special 23
Fund; [and] 24

213. the Population Health Improvement Fund; AND 25

214. THE SUITLAND DEVELOPMENT AUTHORITY FUND. 26
