AN ACT concerning 1

Correctional Officers’ Retirement System – Dorchester County 2

FOR the purpose of requiring membership in the Correctional Officers’ Retirement System 3
for certain local detention center officers of Dorchester County in the event 4
Dorchester County becomes a participating governmental unit in the Correctional 5
Officers’ Retirement System; providing that certain local detention center officers 6
who join the Correctional Officers’ Retirement System and receive certain service 7
credit shall no longer be members of the Employees’ Pension System; and generally 8
relating to Dorchester County’s participation in the Correctional Officers’ 9
Retirement System. 10

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 16
That the Laws of Maryland read as follows: 17

(A) THIS SECTION APPLIES TO AN INDIVIDUAL WHO IS A LOCAL DETENTION 20

CENTER OFFICER OF DORCHESTER COUNTY BEFORE THE EFF ECTIVE DATE AND 1
WHO REMAINS A LOCAL DETENTION CENTER OFF ICER OF DORCHESTER COUNTY 2
THROUGH THE EFFECTIVE DATE. 3

(B) NOTWITHSTANDING ANY O THER PROVISION OF LA W, IF DORCHESTER 4
COUNTY BECOMES A PARTICIPATING GOVERNMENTAL UNIT IN THE CORRECTIONAL 5
OFFICERS’ RETIREMENT SYSTEM, MEMBERSHIP IN THE CORRECTIONAL OFFICERS’ 6
RETIREMENT SYSTEM IS MANDATORY F OR AN INDIVIDUAL DES CRIBED UNDER 7
SUBSECTION (A) OF THIS SECTION. 8

(C) IF DORCHESTER COUNTY COMMENCES PART ICIPATION IN THE 9
CORRECTIONAL OFFICERS’ RETIREMENT SYSTEM IN ACCORDANCE WITH 10
SUBSECTION (B) OF THIS SECTION, AN INDIVIDUAL DESCRIBED UNDER SUBSECTION 11
(A) OF THIS SECTION IS E NTITLED TO ELIGIBILI TY SERVICE AND CREDI TABLE 12
SERVICE IN THE CORRECTIONAL OFFICERS’ RETIREMENT SYSTEM FOR 13
EMPLOYMENT WITH DORCHESTER COUNTY BEFORE THE EFFECTIVE DATE. 14

(D) ON JOINING THE CORRECTIONAL OFFICERS’ RETIREMENT SYSTEM 15
AND RECEIVING SERVIC E CREDIT AS PROVIDED UNDER SUBSECTION (C) OF THIS 16
SECTION, AN INDIVIDUAL DESCRI BED UNDER SUBSECTION (A) OF THIS SECTION 17
SHALL: 18

(1) NO LONGER BE A MEMBE R OF THE EMPLOYEES’ PENSION 19
SYSTEM; AND 20

(2) HAVE NO FURTHER RIGHTS TO ANY BENEFIT IN THE EMPLOYEES’ 21
PENSION SYSTEM. 22

(E) THE TRANSFER OF CREDI TABLE SERVICE FOR AN INDIVIDUAL 23
DESCRIBED IN SUBSECT ION (A) OF THIS SECTION WHO IS A MEMBER OF THE 24
EMPLOYEES’ PENSION SYSTEM THROUGH THE EF FECTIVE DATE , AND WHO 25
TRANSFERS TO THE CORRECTIONAL OFFICERS’ RETIREMENT SYSTEM UNDER THIS 26
SECTION, IS NOT GOVERNED BY TITLE 37 OF THIS ARTICLE. 27

(F) IF DORCHESTER COUNTY BECOMES A PARTICIPATING GOVERNMENTAL 28
UNIT IN THE CORRECTIONAL OFFICERS’ RETIREMENT SYSTEM, § 31–2B–05(C) OF 29
THIS SUBTITLE SHALL GOVERN THE TRANSFER AND CREDITING OF ASSETS ON THE 30
EFFECTIVE DATE. 31

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect June 32
1, 2026. 33
