AN ACT concerning 1

Electric Vehicle Fuel Sold at Retail – Equipment Requirements, Units of 2
Measure, Sales Price, and Fees 3

FOR the purpose of requiring the owner or possessor of a weight and measure used for the 4
retail sale of electricity as a vehicle fuel to display certain information in a certain 5
manner; requiring all electricity possessed, offered, or exposed for sale and sold at 6
retail as a vehicle fuel to be measured and sold in a certain manner; requiring the 7
Comptroller to determine the minimum price for the retail sale of electricity as a 8
vehicle fuel; authorizing the owner or possessor of a weight and measure used for the 9
retail sale of electricity as a vehicle fuel to charge certain fees for certain services; 10
and generally relating to the sale of electricity sold at retail as a vehicle fuel. 11

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 1
That the Laws of Maryland read as follows: 2

Article – Agriculture 3

11–101. 4

(a) In this title the following words have the meanings indicated. 5

(l) “Weight and measure” means any instrument or device used f or weighing or 6
measuring, and any appliance or accessory associated with any instrument or device used 7
for weighing or measuring. 8

11–316. 9

(A) (1) THE OWNER OR POSSESSO R OF A WEIGHT AND ME ASURE USED 10
FOR THE RETAIL SALE OF ELECTRICITY AS A VEHICLE FUEL SH ALL CLEARLY AND 11
CONSPICUOUSLY DISPLA Y INFORMATION DETAIL ING THE NAME , ADDRESS, AND 12
PHONE NUMBER OF A LO CAL PERSON RESPONSIB LE FOR THE WEIGHT AN D 13
MEASURE. 14

(2) THE INFORMATION REQUI RED TO BE DISPLAYED UNDER THIS 15
SUBSECTION MAY BE DI SPLAYED ON OR IMMEDI ATELY ADJACENT TO THE W EIGHT 16
AND MEASURE. 17

(B) (1) ALL ELECTRICITY POSSESSED, OFFERED, OR EXPOSED FOR SALE 18
AND SOLD AT RETAIL AS A VEHICLE FUEL SHALL BE MEASURED AND SOLD IN UNITS 19
OF KILOWATT–HOURS. 20

(2) DURING A CHARGING SES SION, A CUSTOMER MAY BE CH ARGED 21
ONLY FOR THE KILOWAT T–HOURS OF ELECTRICITY DISPENSED DURING THE 22
CHARGING SESSION. 23

(C) (1) ON OR BEFORE JULY 1 EACH YEAR, THE COMPTROLLER SHALL 24
DETERMINE THE MINIMU M PRICE FOR THE RETA IL SALE OF ELECTRICI TY AS A 25
VEHICLE FUEL. 26

(2) THE COMPTROLLER SHALL PUBLISH THE MINIMUM PRICE 27
DETERMINED UNDER THIS SUBSECTION ON THE COMPTROLLER’S WEBSITE. 28

(D) (C) (1) IN ADDITION TO THE PR ICE CHARGED FOR THE RETAIL 29
SALE OF ELECTRICITY AS A VEHICLE FUEL, THE OWNER OR POSSESSOR OF A WEIGHT 30
AND MEASURE USED FOR THE RETAIL SALE OF ELECT RICITY AS A VEHICLE FUEL 31

MAY CHARGE A FEE FOR SERVICES RELATED TO THE RETAIL SALE OF ELECTRICITY 1
AS A VEHICLE FUEL. 2

(2) THE FEE AUTHORIZED UNDER THIS SUBSECTION MAY: 3

(I) MAY BE A FIXED FEE OR AS SESSED BASED ON LENG TH OF 4
TIME; 5

(II) MAY BE APPLIED ONLY A T THE CONCLUSION OF A 6
CHARGING SESSION; AND 7

(III) SHALL BE ITEMIZED ON THE CUSTOMER’S RECEIPT. 8

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 9
1, 2026. 10
