A BILL ENTITLED
AN ACT concerning 1
Public Safety – Law Enforcement – Response to Immigration Enforcement 2
Actions 3
FOR the purpose of requiring a law enforcement agency to respond to a report of an 4
immigration enforcement activity within the agency’s jurisdiction; requiring a law 5
enforcement officer responding to a report of an immigration enforcement activity to 6
observe and report certain information; requiring that the reports and recordings 7
created in accordance with this Act are subject to the Public Information Act; and 8
generally relating to law enforcement response to immigration enforcement. 9
BY repealing and reenacting, without amendments, 10

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 20
That the Laws of Maryland read as follows: 21
Article – Public Safety 22
3–101. 23
(a) In this title the following words have the meanings indicated. 24

(e) “Law enforcement agency” has the meaning stated in § 3–201 of this title. 1

(a) In this subtitle the following words have the meanings indicated. 3
(d) (1) “Law enforcement agency” means a governmental police force, sheriff’s 4
office, or security force or law enforcement organization of the State, a county, or a 5
municipal corporation that by statute, ordinance, or common law is authorized to enforce 6
the general criminal laws of the State. 7
(2) “Law enforcement agency” does not include members of the Maryland 8
National Guard who: 9
(i) are under the control and jurisdiction of the Military 10
Department; 11
(ii) are assigned to the military property designated as the Martin 12
State Airport; and 13
(iii) are charged with exercising police powers in and for the Martin 14
State Airport. 15

(A) IN THIS SECTION , “IMMIGRATION ENFORCEMENT” HAS THE MEANING 17
STATED IN § 6–111 OF THE STATE GOVERNMENT ARTICLE. 18
(B) (1) SUBJECT TO § 5–104 OF THE CRIMINAL PROCEDURE ARTICLE, ON 19
RECEIVING NOTICE OF AN IMMIGRATION ENFOR CEMENT ACTION HAPPENING IN A 20
LAW ENFORCEMENT AGEN CY’S JURISDICTION , A LAW ENFORCEMENT AG ENCY 21
SHALL DISPATCH AT LEAST ONE LAW ENFORCEMENT OFFICER TO: 22
(I) OBSERVE THE IMMIGRATION ENFORCEMENT ACTION; 23
(II) ENSURE THE SAFE TRANS FER OF AN INDIVIDUAL IN 24
CUSTODY AS A RESULT OF THE IMMIGRATION ENFORCEMENT ACTION; 25
(III) NOTWITHSTANDING ANY POLICY ADOPTED UNDER § 3–511 26
OF THIS SUBTITLE, AND TO THE EXTENT PRACTICABLE, RECORD THE IMMIGRATION 27
ENFORCEMENT ACTION WITH THE OFFICER’S BODY–WORN CAMERA; 28
(IV) FILE A REPORT DOCUMEN TING THE ACTIVITY OF 29
IMMIGRATION ENFORCEMENT OFFICIALS, INCLUDING: 30

1. THE DATE, TIME, AND LOCATION OF THE ACTION; 1
2. IF APPLICABLE , THE TYPE OF WARRANT USED FOR 2
THE IMMIGRATION ENFORCEMENT ACTION; 3
3. WHAT FEDERAL AGENCIES WERE INVOLVED WITH THE 4
IMMIGRATION ENFORCEMENT ACTION; 5
4. A DESCRIPTION OF ANY F ORCE USED DURING THE 6
IMMIGRATION ENFORCEMENT ACTION; 7
5. WHETHER ANY MEDICAL ATTENTION WAS REQUIR ED 8
AS A RESULT OF THE IMMIGRATION ENFORCEMENT ACTION; 9
6. WHETHER THE LAW ENFO RCEMENT OFFICERS WER E 10
RESTRICTED FROM OBSERVING OR RECORDING THE IMMIGRATION ENFORCEMENT 11
ACTION; AND 12
7. ANY VIOLATIONS OF LA W THE OFFICER OBSERV ED 13
DURING THE IMMIGRATION ENFORCEMENT ACTION; AND 14
(V) PRESERVE ANY EVIDENCE RELATED TO THE IMMIGRATION 15
ENFORCEMENT ACTION. 16
(2) WHILE RESPONDING TO A N IMMIGRATION ENFORCEM ENT 17
ACTION, A LAW ENFORCEMENT OF FICER SHALL CONTINUE TO PERFORM THE 18
CONSTITUTIONAL OBLIGATIONS OF THE OFFICER’S POSITION. 19
(3) THE DOCUMENTATION AND FOOTAGE RECORDED CONSISTENT 20
WITH PARAGRAPH (1)(III) AND (IV) OF THIS SUBSECTION SHALL BE SUBJECT TO THE 21
PROVISIONS OF TITLE 4 OF THE GENERAL PROVISIONS ARTICLE. 22
(4) (I) NOTWITHSTANDING ANY POLICY ADOPTED UNDER § 3–511 23
OF THIS SUBTITLE, FOOTAGE RECORDED CONSISTENT WITH PARAGRAPH (1)(III) OF 24
THIS SUBSECTION SHALL BE STORED FOR AT LEAST 4 MONTHS. 25
(II) THE REPORT FILED CONSISTENT WITH PARAGRAPH (1)(IV) 26
OF THIS SUBSECTION SHALL BE STORED FOR AT LEAST 4 YEARS. 27
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 28
October 1, 2026. 29
