A BILL ENTITLED
AN ACT concerning 1
Health Insurance – Physical Therapy – Copayments, Coinsurance, and 2
Deductibles 3
FOR the purpose of prohibiting insurers, nonprofit health service plans, and health 4
maintenance organizations from imposing a copayment, coinsur ance, or deductible 5
for covered physical therapy services that is greater than the copayment, 6
coinsurance, or deductible imposed for an annual physical or wellness visit under the 7
same plan or contract; requiring insurers, nonprofit health service plans, and health 8
maintenance organizations to state in each plan or contract the coverage 9
requirements, limitations, conditions, and exclusions for the provision of physical 10
therapy services; and generally relating to health insurance and physical therapy 11
services. 12

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18
That the Laws of Maryland read as follows: 19
Article – Insurance 20

(A) IN THIS SECTION , “PHYSICAL THERAPY SER VICES” MEANS SERVICES 22
PROVIDED TO A PATIEN T WITHIN THE SCOPE O F PRACTICE OF A PHYS ICAL 23
THERAPIST WHO IS LIC ENSED BY THE STATE BOARD OF PHYSICAL THERAPY 24

EXAMINERS TO PRACTICE PHYSICAL THERAPY UNDER THE HEALTH OCCUPATIONS 1
ARTICLE. 2
(B) THIS SECTION APPLIES TO: 3
(1) INSURERS AND NONPROF IT HEALTH SERVICE PL ANS THAT 4
PROVIDE COVERAGE FOR PHYSICAL THERAPY UND ER INDIVIDUAL , GROUP, OR 5
BLANKET HEALTH INSUR ANCE POLICIES OR CON TRACTS THAT ARE ISSU ED OR 6
DELIVERED IN THE STATE; AND 7
(2) HEALTH MAINTENANCE O RGANIZATIONS THAT PR OVIDE 8
COVERAGE FOR PHYSICA L THERAPY UNDER INDI VIDUAL OR GROUP CONT RACTS 9
THAT ARE ISSUED OR DELIVERED IN THE STATE. 10
(C) FOR EACH DATE COVERED PHYSICAL THERAPY SER VICES ARE 11
PROVIDED, AN ENTITY SUBJECT TO THIS SECTION MAY NOT IMPOSE A COPAYMENT, 12
COINSURANCE, OR DEDUCTIBLE AMOUNT FOR THE PHYSICAL THE RAPY SERVICES 13
THAT IS GREATER THAN THE COPAYMENT, COINSURANCE, OR DEDUCTIBLE AMOUNT 14
IMPOSED FOR AN ANNUAL PHYSICAL OR WELLNESS VISIT UNDER THE SAME PLAN OR 15
CONTRACT. 16
(D) AN ENTITY SUBJECT TO THIS SECTION SHALL CLEARLY STATE IN EACH 17
PLAN OR CONTRACT THE COVERAGE REQUIREMENTS, LIMITATIONS, CONDITIONS, 18
AND EXCLUSIONS FOR THE PROVISION OF PHYSICAL THERAPY SERVICES. 19
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall apply to all 20
policies, contracts, and health benefit plans issued, delivered, or renewed in the State on or 21
after January 1, 2027. 22
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 23
January 1, 2027. 24
