AN ACT concerning 1

Correctional Officers’ Retirement System – Allegany County 2

FOR the purpose of requiring membership in the Correctional Officers’ Retirement System 3
for certain local detention center officers of Allegany County in the event Allegany 4
County becomes a participating governmental unit in the Correctional Officers’ 5
Retirement System; providing that certain local detention center officers who join 6
the Correctional Officers’ Retirement System and receive certain service credit shall 7
no longer be members of the Employees’ Pension System; and generally relating to 8
Allegany County’s participation in the Correctional Officers’ Retirement System. 9

SECTION 1. BE IT ENACTED BY THE GEN ERAL ASSEMBLY OF MARYLAND, 15
That the Laws of Maryland read as follows: 16

(A) THIS SECTION APPLIES TO AN INDIVIDUAL WHO IS A LOCAL DETENTION 19
CENTER OFFICER OF ALLEGANY COUNTY BEFORE THE EFFECTIVE DATE AND WHO 20
2 SENATE BILL 748

REMAINS A LOCAL DETENTION CENTER OFFICER OF ALLEGANY COUNTY THROUGH 1
THE EFFECTIVE DATE. 2

(B) NOTWITHSTANDING ANY O THER PROVISION OF LA W, IF ALLEGANY 3
COUNTY BECOMES A PARTICIPATING GOVERNMENTAL UNIT IN THE CORRECTIONAL 4
OFFICERS’ RETIREMENT SYSTEM, MEMBERSHIP IN THE CORRECTIONAL OFFICERS’ 5
RETIREMENT SYSTEM IS MANDATORY F OR AN INDIVIDUAL DES CRIBED UNDER 6
SUBSECTION (A) OF THIS SECTION. 7

(C) IF ALLEGANY COUNTY COMMENCES PART ICIPATION IN THE 8
CORRECTIONAL OFFICERS’ RETIREMENT SYSTEM IN ACCORDANCE WITH 9
SUBSECTION (B) OF THIS SECTION, AN INDIVIDUAL DESCRIBED UNDER SUBSECTION 10
(A) OF THIS SECTION IS E NTITLED TO ELIGIBILI TY SERVICE AND CREDI TABLE 11
SERVICE IN THE CORRECTIONAL OFFICERS’ RETIREMENT SYSTEM FOR 12
EMPLOYMENT WITH ALLEGANY COUNTY BEFORE THE EFFECTIVE DATE. 13

(D) ON JOINING THE CORRECTIONAL OFFICERS’ RETIREMENT SYSTEM 14
AND RECEIVING SERVIC E CREDIT AS PROVIDED UNDER SUBSECTION (C) OF THIS 15
SECTION, AN INDIVIDUAL DESCRI BED UNDER SUBSECTION (A) OF THIS SECTION 16
SHALL: 17

(1) NO LONGER BE A MEMBE R OF THE EMPLOYEES’ PENSION 18
SYSTEM; AND 19

(2) HAVE NO FURTHER RIGHTS TO ANY BENEFIT IN THE EMPLOYEES’ 20
PENSION SYSTEM. 21

(E) THE TRANSFER OF CREDI TABLE SERVICE FOR AN INDIVIDUAL 22
DESCRIBED IN SUBSECT ION (A) OF THIS SECTION WHO IS A MEMBER OF THE 23
EMPLOYEES’ PENSION SYSTEM THROU GH THE EFFECTIVE DAT E, AND WHO 24
TRANSFERS TO THE CORRECTIONAL OFFICERS’ RETIREMENT SYSTEM UNDER THIS 25
SECTION, IS NOT GOVERNED BY TITLE 37 OF THIS ARTICLE. 26

(F) IF ALLEGANY COUNTY BECOMES A PART ICIPATING GOVERNMENT AL 27
UNIT IN THE CORRECTIONAL OFFICERS’ RETIREMENT SYSTEM, § 31–2B–05(C) OF 28
THIS SUBTITLE SHALL GOVERN THE TRANSFER AND CREDITING OF ASSETS ON THE 29
EFFECTIVE DATE. 30

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect June 31
1, 2026. 32
