A BILL ENTITLED

AN ACT concerning 1

State Retirement and Pension System – Transfers of Service 2

FOR the purpose of authorizing certain members of the State Retirement and Pension 3
System to transfer certain prior service into the State Police Retirement System; and 4
generally relating to transfers of service in the State Retirement and Pension 5
System. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 7
That: 8

(a) In this section, “Local Fire and Police System” means the Local Fire and Police 9
System established under Title 28 of the State Personnel and Pensions Article. 10

(b) This section applies to an individual who: 11

(1) is an active member of the State Police Retirement System; 12

(2) is eligible for a vested benefit from the Local Fire and Police System; 13

(3) is not an active member in the Local Fire and Police System; and 14

(4) incurred a break in employment: 15

(i) after ceasing employment in a position in which the individual 16
was required to be a member in the Local Fire and Police System; and 17

(ii) before beginning employment as a member of the State Police 18
Retirement System. 19

(c) Notwithstanding § 37–202(a) of the State Personnel and Pensions Article, an 20
individual described under subsection (b) of this section may transfer the individual’s 21

creditable service in the Local Fire and Police System to the State Police Retirement System 1
in accordance with Title 37 of the State Personnel and Pensions Article. 2

(d) An individual described under subsection (b) of this section shall make a 3
request to transfer service in accordance with subsection (c) of this section: 4

(1) on or before December 31, 2026; and 5

(2) by submitting to the Board of Trustees for the State Retirement and 6
Pension System a form provided by the State Retirement Agency for the purpose of electing 7
to transfer service under this Act. 8

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 9
1, 2026. It shall remain effective for a period of 6 months and, at the end of December 31, 10
2026, this Act, with no further action required by the General Assembly, shall be abrogated 11
and of no further force and effect. 12
