AN ACT concerning 1
Public Health and Health Insurance – Access to Abortion Care – Reporting 2
Requirements 3
FOR the purpose of requiring that the annual report on the Abortion Care Clinical Training 4
Program include certain recommendations; requir ing the Maryland Insurance 5
Commissioner to collect certain data on certain segregated accounts established 6
under the federal Affordable Care Act and certain federal regulations from certain 7
insurers, nonprofit health service plans, and health maintenance organizations and 8
submit a certain report to certain committees on or before a certain date each year; 9
and generally relating to abortion care. 10

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 26
That the Laws of Maryland read as follows: 27

(a) In this subtitle the following words have the meanings indicated. 3
(c) “Program” means the Abortion Care Clinical Training Program. 4

On or before July 1 each year, the Department shall submit an annual report on the 6
Program to the Governor and, in accordance with § 2–1257 of the State Government Article, 7
the General Assembly, THAT INCLUDES RECOMMENDATIONS ON ACTIONS THE STATE 8
CAN TAKE TO ENSURE T HAT THERE ARE A SUFF ICIENT NUMBER OF HEA LTH 9
PROFESSIONALS TO PROVIDE ABORTION CARE IN THE STATE. 10

(A) THIS SECTION APPLIES WITH RESPECT TO: 13
(1) INSURERS AND NONPROF IT HEALTH SERVICE PL ANS THAT 14
PROVIDE HOSPITAL, MEDICAL, OR SURGICAL BENEFITS TO INDIVIDUALS OR GROUPS 15
ON AN EXPENSE –INCURRED BASIS UNDER HEALTH INSURANCE P OLICIES OR 16
CONTRACTS THAT ARE ISSUED OR DELIVERED IN THE STATE; AND 17
(2) HEALTH MAINTENANCE O RGANIZATIONS THAT PR OVIDE 18
HOSPITAL, MEDICAL, OR SURGICAL BENEFITS TO INDIVIDUALS OR GROUPS UNDER 19
CONTRACTS THAT ARE ISSUED OR DELIVERED IN THE STATE. 20
(B) (1) EACH YEAR , THE COMMISSIONER SHALL CO LLECT DATA FROM 21
THE ENTITIES SUBJECT TO THIS SECTION ON R ECEIPTS, DISBURSEMENTS, ENDING 22
BALANCES, AND INTEREST FOR SEG REGATED ACCOUNTS EST ABLISHED UNDER § 23
1303(B)(2)(B) AND (C) OF THE FEDERAL PATIENT PROTECTION AND AFFORDABLE 24
CARE ACT AND 45 C.F.R. § 156.280. 25
(2) (I) ON OR BEFORE JANUARY 1 EACH YEAR , THE 26
COMMISSIONER SHALL RE PORT TO THE SENATE FINANCE COMMITTEE AND THE 27
HOUSE HEALTH COMMITTEE, IN ACCORDANCE WITH § 2–1257 OF THE STATE 28
GOVERNMENT ARTICLE, ON THE AGGREGAT E DATA COLLECTED UND ER 29
PARAGRAPH (1) OF THIS SUBSECTION. 30

(II) THE REPORT REQUIRED U NDER SUBPARAGRAPH (I) OF 1
THIS PARAGRAPH SHALL USE DATA COLLECTED FOR THE CALENDAR YEAR THAT IS 2
2 YEARS IMMEDIATELY PRECEDING JANUARY 1 OF THE YEAR IN WHICH THE REPORT 3
IS DUE. 4
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 5
1, 2026. 6
