FOR the purpose of requiring certain persons to be licensed by the Motor Vehicle 4
Administration in order to perform a recalibration of an advanced driver assistance 5
system; establishing certain requirements for an automotive repair facility that 6
performs advanced driver assistance system recalibrations; prohibiting an insurance 7
company from taking certain actions relating to repairs or recalibrations of an 8
advanced driver assistance system and requiring an insurance estimate to include 9
certain information; establishing that a violation of certain provisions of this Act are 10
unfair, abusive, or deceptive trade practices subject to certain enforcement and 11
penalty provisions under the Maryland Consumer Protection Act; and generally 12
relating to automotive repai r facilities the Motor Vehicle Administration to study 13
and report on the repair and training requirements of advanced driver assistance 14
systems; and generally relating to the repair and training requirements of advanced 15

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 15
That the Laws of Maryland read as follows: 16
(a) The Motor Vehicle Administration shall study the repair of advanced driver 17
assistance systems and make recommendations on the feasibility of legislation related to 18
the repair of advanced driver assistance systems and training requirements for advanced 19
driver assistance systems. 20
(b) The study shall include research on: 21
(1) existing Maryland statutes and regulations on the repair of advanced 22
driver assistance systems; 23
(2) existing laws and regulations in other st ates on advanced driver 24
assistance systems; 25
(3) training requirements for advanced driver assistance systems; and 26
(4) statistics on accidents related to advanced driver assistance systems. 27
(c) In conducting the study required under subsection (a) of this section, the 28
Administration shall consult with representatives from: 29
(1) the Maryland Insurance Administration; 30
(2) the Maryland Automobile Dealers Association; 31
(3) the American Automobile Association; 32
(4) the property and casualty insurance industry; 33

(5) a national highway safety organization; 1
(6) a glass repair company; 2
(7) an automobile body shop trade association; 3
(8) an advanced driver assistance training company; 4
(9) an advanced driver assistance manufacturing company; and 5
(10) an advanced driver assistance systems parts company. 6
(d) On or before January 1, 2027, the Administration shall report its findings and 7
recommendations to the Senate Judicial Proceedings Committee and the House Economic 8
Matters Committee, in accordance with § 2–1257 of the State Government Article. 9

(XLIX) TITLE 15, SUBTITLE 11 OF THE TRANSPORTATION 16

(a) (1) In this section the following words have the meanings indicated. 19
(2) “Advanced driver assistance system” means an electronic system that 20
uses automated technology including cameras and sensors to detect nearby obstacles and 21
driver errors to assist a driver in the safe operation of a motor vehicle. 22
(3) “Motor vehicle” has the meaning stated in Title 11 of the Transportation 23
Article. 24
(4) (I) “Motor vehicle safety glass facility” means a person that ONLY: 25
[(i)] 1. Repairs or replaces motor vehicle safety glass; and 26

[(ii)] 2. Provides related recalibration of an advanced driver 1
assistance system. 2
(II) “MOTOR VEHICLE SAFETY GLASS FACILITY ” DOES NOT 3
INCLUDE AN AUTOMOTIV E REPAIR FACILITY , AS DEFINED IN § 15–1101 OF THE 4
TRANSPORTATION ARTICLE. 5
(5) “Recalibration” means the readjustment of cameras, sensors, and other 6
technology in an advanced driver assistance system to ensure proper working order in 7
accordance with motor vehicle manufacturer specifications. 8
(b) Before repairing or replacing motor vehicle glass, if a motor vehicle is 9
equipped with an advanced driver assistance system , a motor vehicle safety glass facility 10
shall: 11
(1) Inform the customer if the recalibration of an advanced driver 12
assistance system is required; and 13
(2) Provide the customer with a written statement that the work to be 14
performed on the motor vehicle will meet or exceed original equipment manufacturer 15
specifications. 16
(c) (1) Subject to paragraph (2) of this subsection, a motor vehicle safety glass 17
facility is not limited to motor vehicle glass, tooling, equipment, or repair procedures 18
provided by the vehicle manufacturer. 19
(2) Recalibration of an advanced driver assistance system performed by a 20
motor vehicle safety glass facility shall meet or exceed the motor vehicle manufacturer’s 21
specifications. 22
(3) A MOTOR VEHICLE SAFETY GLASS FACILITY MAY NOT PERFORM A 23
RECALIBRATION OF AN ADVANCED DRIVER ASSI STANCE SYSTEM UNLESS THE 24
MOTOR VEHICLE SAFETY GLASS FACILITY IS LI CENSED BY THE MOTOR VEHICLE 25
ADMINISTRATION IN ACC ORDANCE WITH § 15–1103 OF THE TRANSPORTATION 26
ARTICLE. 27
(4) A motor vehicle safety glass facility may not charge for services that are 28
not performed or successfully completed. 29
(d) A motor vehicle safety glass facility shall inform the customer if recalibration 30
of an advanced driver assistance system is required and is not performed or suc cessfully 31
completed. 32
(e) (1) A violation of this section by a motor vehicle safety glass facility is: 33

[(1)] (I) An unfair, abusive, or deceptive trade practice within the 1
meaning of Title 13 of this article; and 2
[(2)] (II) Subject to the enforcemen t and penalty provisions contained in 3
Title 13 of this article. 4
(2) IN ADDITION TO PENALTIES UNDER TITLE 13 OF THIS ARTICLE, A 5
MOTOR VEHICLE SAFETY GLASS FACILITY THAT COMMITS THREE VIOLAT IONS OF 6
THIS SECTION WITHIN A 3–YEAR PERIOD IS SUBJE CT TO SUSPENSION OR 7
REVOCATION BY THE MOTOR VEHICLE ADMINISTRATION OF THE MOTOR VEHICLE 8
SAFETY GLASS FACILIT Y’S LICENSE ISSUED UND ER § 15–1103 OF THE 9
TRANSPORTATION ARTICLE. 10

(2) “AUTOMOTIVE REPAIR FACILITY” INCLUDES A BODY SHOP. 4
(3) “AUTOMOTIVE REPAIR FAC ILITY” DOES NOT INCLUDE A M OTOR 5
VEHICLE SAFETY GLASS FACILITY, AS DEFINED IN § 14–1327 OF THE COMMERCIAL 6
LAW ARTICLE. 7
(D) “ORIGINAL EQUIPMENT MA NUFACTURER” MEANS THE ORIGINAL 8
PRODUCER OF A MOTOR VEHICLE OR MOTOR VEHICLE COMPONENT. 9
(E) “POSITION STATEMENT ” MEANS A DOCUMENTED P OLICY OR 10

SPECIFICATIONS FOR THE REPAIR OF A MOTOR VEHICLE, ISSUED BY AN ORIGINA L 19
EQUIPMENT MANUFACTURER. 20

(A) THE GENERAL ASSEMBLY FINDS THAT: 22
(1) ADVANCED DRIVER ASSISTANCE SYSTEMS: 23
(I) ARE INCREASINGLY COMMON IN MOTOR VEHICLES; AND 24
(II) PLAY A CRITICAL ROLE IN MOTOR VEHICLE SAFETY; 25
(2) PROPER CALIBRATION OF ADVANCED DRIVER ASSI STANCE 26
SYSTEM COMPONENTS IS ESSENTIAL TO ENSURE THE SYSTEMS ARE FUNC TIONING 27
CORRECTLY; 28
(3) ORIGINAL EQUIPMENT MA NUFACTURER REPAIR PR OCEDURES 29
AND POSITION STATEME NTS PROVIDE CRITICAL SAFETY GUIDELINES RE GARDING 30
ADVANCED DRIVER ASSISTANCE SYSTEMS; 31

(4) INDIVIDUALS AND BUSIN ESSES THAT PERFORM A DVANCED 1

ENSURE PROPER MOTOR VEHICLE REPAIR AND RESTORATI ON OF SAFETY 4
FEATURES; AND 5
(5) PROFESSIONAL STANDARD S AND LICENSING OF I NDIVIDUALS 6
AND BUSINESSES THAT PERFORM ADVANCED DRI VER ASSISTANCE SYSTE M 7
CALIBRATION SERVICES IN THE STATE ARE NEEDED. 8
(B) IT IS THE PURPOSE OF THIS SUBTITLE TO: 9
(1) ESTABLISH REQUIREMENTS FOR ADVANCED DRIVER ASSISTANCE 10
SYSTEM CALIBRATION SERVICES; 11
(2) ENSURE INSURANCE COVERAGE FOR NECESSARY REPAIRS UNDER 12
ORIGINAL EQUIPMENT M ANUFACTURER REPAIR P ROCEDURE AND POSITIO N 13
STATEMENTS; 14
(3) PROVIDE CONSUMERS WITH ESSENTIAL INFOR MATION 15
REGARDING THE CONSUMER’S ADVANCED DRIVER ASSISTANCE SYSTEMS, AND HOW 16
REPAIRS IMPACT THE SYSTEMS; AND 17
(4) CREATE STANDARDS AND LICENSING REQUIREMEN TS FOR 18
INDIVIDUALS AND BUSI NESSES THAT PERFORM ADVANCED DRIVER ASSI STANCE 19
SYSTEM CALIBRATION SERVICES IN THE STATE. 20

(A) (1) A PERSON MAY NOT PERFO RM A RECALIBRATION O N AN 22
ADVANCED DRIVER ASSISTANCE SYSTEM UNLESS THE PERSON IS LICENSED BY THE 23
ADMINISTRATION UNDER THIS SUBTITLE. 24
(2) ON OR AFTER NOVEMBER 1, 2027, A PERSON WHO VIOLATES THIS 25
SUBSECTION IS SUBJECT TO: 26
(I) A CIVIL PENALTY NOT TO EXCEED $5,000 PER VIOLATION; 27
AND 28
(II) INJUNCTIVE RELIEF. 29

INSURANCE ADMINISTRATION, SHALL ADOPT REGULATI ONS ON LICENSING 2

(A) AN AUTOMOTIVE REPAIR FACILITY THAT PERFORMS ADVANCED DRIVER 5
ASSISTANCE SYSTEM RECALIBRATIONS SHALL: 6
(1) MAINTAIN A CONTROLLED ENVIRONMENT THAT MEE TS OR 7
EXCEEDS ORIGINAL EQU IPMENT MANUFACTURER SPECIFICATIONS FOR 8
PERFORMING RECALIBRATIONS; 9
(2) POSSESS AND MAINTAIN TOOLS AND EQUIPMENT NEEDED FOR 10
RECALIBRATION THAT M EET OR EXCEED ORIGIN AL EQUIPMENT MANUFAC TURER 11
SPECIFICATIONS; 12
(3) HAVE ACCESS TO ORIGINAL EQUIPMENT MANUFACTURER REPAIR 13
PROCEDURES AND POSITION STATEMENTS; AND 14
(4) HOLD AND OPERATE IN A CCORDANCE WITH A LIC ENSE ISSUED 15
UNDER § 15–1103 OF THIS SUBTITLE. 16
(B) AN AUTOMOTIVE REPAIR FACILITY MAY NOT: 17
(1) WHEN A RECALIBRATION IS REQUIRED , RETURN A MOTOR 18
VEHICLE TO A CUSTOME R WITHOUT HAVING CALIBRATED THE ADVANCED DRIVER 19
ASSISTANCE SYSTEM IN ACCORDANCE WITH THE REPAIR PROCEDURE OR POSITION 20
STATEMENT; 21
(2) IF A RECALIBRATION WA S NOT PERFORMED ACCO RDING TO THE 22
REPAIR PROCEDURE OR POSITION STATEMENT, REPRESENT TO A CUSTOMER THAT 23
THE AUTOMOTIVE REPAIR FACILITY PERFORMED A RECALIBRATION; OR 24
(3) USE METHODS , TOOLS, OR EQUIPMENT FOR REC ALIBRATION 25
THAT DO NOT MEET OR EXCEED THE ORIGINAL EQUIPMENT MANUFACTUR ER’S 26
SPECIFICATIONS. 27
(C) AN AUTOMOTIVE REPAIR FACILITY SHALL: 28
(1) PERFORM ALL RECALIBRATIONS I N ACCORDANCE WITH TH E 29
REPAIR PROCEDURE OR POSITION STATEMENT; 30

(2) CONDUCT A POSTREPAIR SCAN TO VERIFY THAT ALL ADVANCED 1
DRIVER ASSISTANCE SYSTEMS ARE FUNCTIONING PROPERLY; AND 2
(3) KEEP A RECORD OF ALL SCANS AND RECALIBRAT IONS 3
PERFORMED. 4
15–1105. 5
(A) BEFORE BEGINNING ANY REPAIR WORK ON A MOT OR VEHICLE 6
EQUIPPED WITH AN ADV ANCED DRIVER ASSISTA NCE SYSTEM THAT REQU IRES 7
RECALIBRATION, AN AUTOMOTIVE REPAIR FACILITY SHALL PROVI DE THE 8
CUSTOMER WITH A WRITTEN STATEMENT CONTAINING: 9
(1) AN EXPLANATION OF EAC H ADVANCED DRIVER AS SISTANCE 10
SYSTEM IN THE VEHICLE; 11
(2) A DESCRIPTION OF ANY ADVANCED DRIVER ASSISTANCE SYSTEM 12
COMPONENT THAT MAY BE IMPACTED BY THE REPAIR; 13
(3) AN EXPLANATION OF THE REQUIRED RECALIBRATION; 14
(4) THE ESTIMATED PRICE FOR THE REQUIRED RECALIBRATION; AND 15
(5) THE POTENTIAL SAFETY IMPLICATIONS OF NOT PERFORMING 16
THE REQUIRED RECALIBRATION. 17
(B) ON COMPLETION OF REPA IR WORK ON A MOTOR V EHICLE EQUIPPED 18
WITH AN ADVANCED DRI VER ASSISTANCE SYSTE M, AN AUTOMOTIVE REP AIR 19
FACILITY SHALL GIVE THE CUSTOMER A WRITTEN STATEMENT THAT INCLUDES: 20
(1) DOCUMENTATION OF ALL DIAGNOSTIC SCANS; 21
(2) DOCUMENTATION OF ANY RECALIBRATION PERFOR MED AND 22
METHODS USED TO PERFORM THE RECALIBRATION; 23
(3) VERIFICATION THAT ALL ADVANCED DRIVER ASSI STANCE 24
SYSTEMS ARE FUNCTIONING PROPERLY; 25
(4) CONFIRMATION THAT ALL PREREQUISITE ORIGINAL EQUIPMENT 26
MANUFACTURER RECALIBRATION REQUIREMENTS WERE MET; AND 27
(5) INSTRUCTIONS FOR THE MONITORING OF AN ADVANCED DRIVER 28
ASSISTANCE SYSTEM TO ENSURE PROPER FUNCTIONING OF THE SYSTEM. 29

(A) AN INSURANCE COMPANY MAY NOT: 2
(1) DENY COVERAGE FOR ANY REPAIR OR RECALIBRAT ION THAT IS 3
RECOMMENDED BY THE REPAIR PROCEDURE OR POSITION STATEMENT; 4
(2) REQUIRE REPAIR S THAT CONFLICT WITH THE REPAIR 5
PROCEDURE OR POSITION STATEMENT; OR 6
(3) CONSIDER A REPAIR TO A MOTOR VEHICLE COMPLETE UNTIL AN 7
AUTOMOTIVE REPAIR FA CILITY PERFORMS ALL NECESSARY RECALIBRAT IONS IN 8
ACCORDANCE WITH THE REPAIR PROCEDURE OR POSITION STATEMENT. 9
(B) AN INSURANCE ESTIMATE FOR MOTOR VEHICLE CO LLISION REPAIRS 10
SHALL INCLUDE: 11
(1) A LINE ITEM FOR: 12
(I) NECESSARY PREREPAIR A ND POSTREPAIR DIAGNO STIC 13
SCANNING; AND 14
(II) ALL NECESSARY RECALIBRATIONS; AND 15
(2) THE COST OF ALL TOOLS , EQUIPMENT, AND FACILITY 16
REQUIREMENTS REQUIRED TO PERFORM PROPER RECALIBRATION. 17
(C) AN INSURANCE COMPANY THAT VIOLATES THIS S UBSECTION IS 18
SUBJECT TO DISCIPLINE BY THE MARYLAND INSURANCE ADMINISTRATION. 19
15–1107. 20
(A) A VIOLATION OF THIS SUBTITLE OCCURRING ON OR AFTER NOVEMBER 21
1, 2027, IS: 22
(1) AN UNFAIR , ABUSIVE, OR DECEPTIVE TRADE P RACTICE WITHIN 23
THE MEANING OF TITLE 13 OF THE COMMERCIAL LAW ARTICLE; AND 24
(2) SUBJECT TO THE ENFORC EMENT PROVISIONS CON TAINED IN 25
TITLE 13 OF THE COMMERCIAL LAW ARTICLE, EXCEPT § 13–408 OF THE 26
COMMERCIAL LAW ARTICLE. 27

(1) FOR A FIRST VIOLATION , A CIVIL PENALTY NOT EXCEEDING 4
$1,000; 5
(2) FOR A SECOND VIOLATIO N WITHIN 3 YEARS AFTER A FIRST 6
VIOLATION, A CIVIL PENALTY NOT EXCEEDING $2,500; AND 7
(3) FOR A THIRD OR SUBSEQUENT VIOLATION WITHIN 3 YEARS AFTER 8
A FIRST VIOLATION , A CIVIL PENALTY NOT EXCEEDING $5,000, SUSPENSION OR 9
REVOCATION OF THE AU TOMOTIVE REPAIR FACI LITY’S LICENSE BY THE 10
ADMINISTRATION, OR BOTH. 11

THE ADMINISTRATION, IN CONSULTATION WITH THE MARYLAND INSURANCE 13
ADMINISTRATION, SHALL ADOPT REGULATI ONS TO IMPLEMENT THIS SU BTITLE, 14

(1) STANDARDS FOR ADVANCE D DRIVER ASSISTANCE SYSTEM 16
RECALIBRATION TRAINING PROGRAMS; 17
(2) AUTOMOTIVE REPAIR FACILITY INSPECTION STANDARDS; AND 18
(3) TECHNICAL STANDARDS FOR RECALIBRATION EQUIPMENT. 19
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 20
October June 1, 2026. 21
