AN ACT concerning 1
Vehicle Emissions Inspection Program – Exemption for Vehicles Formerly 2
Registered as Historic 3
FOR the purpose of exempting a vehicle that was registered as a historic motor vehicle 4
before a certain date from the requirements of the Vehicle Emissions Inspection 5
Program under certain circumstances; and generally relating to historic vehicles and 6
the Vehicle Emissions Inspection Program. 7

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 18
That the Laws of Maryland read as follows: 19

(a) (1) Subject to subsection (d) of this section, the Administration and the 22
Secretary shall establish an emissions control program in the State in accordance with the 23
federal Clean Air Act. 24

(b) (1) Subject to paragraph (3) of this subsection, the emissions control 1
program shall provide for a biennial exhaust emissions test and emissions equipment and 2
misfueling inspection for all vehicles of the 1977 model year and each model year thereafter. 3

(a) (1) A motor vehicle for which special registration plates have been issued 5
under § 13–616 of this article is exempt from the mandatory inspections requ ired by this 6
subtitle if: 7
(i) All of the owners of the motor vehicle meet the disability 8
requirements of § 13–616(b)(1) of this article; 9
(ii) The motor vehicle is driven 5,000 miles or less annually; and 10
(iii) The exemption is not otherwise prohibited by federal law. 11
(2) In order to qualify for an exemption under paragraph (1) of this 12
subsection, all owners of the motor vehicle shall certify the following: 13
(i) That the owner of the motor vehicle meets the disability 14
requirements of § 13–616(b)(1) of this article; 15
(ii) That the motor vehicle has been issued a special disabled 16
person’s registration number and special registration plates under § 13–616 of this article; 17
(iii) That the motor vehicle is driven 5,000 miles or less annually; and 18
(iv) The motor vehicle’s odometer reading at the time of the 19
certification. 20
(3) The certification required in paragraph (2) of this subsection shall be 21
made on a form provided by the Administration. 22
(b) (1) A motor vehicle owned by an in dividual who is at least 70 years of age 23
at the time of a scheduled mandatory inspection under this subtitle is exempt from the 24
mandatory inspections required by this subtitle if: 25
(i) All of the owners of the motor vehicle are at least 70 years of age 26
at the time of the scheduled mandatory inspection under this subtitle; 27
(ii) The motor vehicle is being driven 5,000 miles or less annually; 28
and 29
(iii) The exemption is not otherwise prohibited by federal law. 30

(2) In order to qualify for an exempt ion under paragraph (1) of this 1
subsection, all owners of the motor vehicle shall certify the following: 2
(i) That all of the owners of the motor vehicle are at least 70 years 3
of age at the time of a scheduled mandatory inspection under this subtitle; 4
(ii) That the motor vehicle is being driven 5,000 miles or less 5
annually; and 6
(iii) The motor vehicle’s odometer reading at the time of the 7
certification. 8
(3) The certification required in paragraph (2) of this subsection shall be 9
made on a form provided by the Administration. 10
(c) (1) A motor vehicle owned by at least one active duty member of the 11
uniformed services at the time of a scheduled mandatory inspection under this subtitle is 12
exempt from the mandatory inspections required by this subtitle if: 13
(i) An owner of the motor vehicle who is a member of the uniformed 14
services has received official orders: 15
1. For deployment outside the United States; or 16
2. To a duty station in a jurisdiction that is not subject to a 17
vehicle emissions control inspection and maintenance program; and 18
(ii) The exemption is not otherwise prohibited by federal law. 19
(2) In order to qualify for an exemption under paragraph (1) of this 20
subsection, all owners of the motor vehicle shall certify that at least one owner of the motor 21
vehicle has received official orders for deployment outside the United States or to a duty 22
station in a jurisdiction that is not subject to a vehicle emissions control inspection and 23
maintenance program. 24
(3) The certification required in paragraph (2) of this subsection shall be 25
made on a form provided by the Administration. 26
(d) (1) A MOTOR VEHICLE IS EXE MPT FROM THE MANDATO RY 27
INSPECTIONS REQUIRED BY THIS SUBTITLE IF THE MOTOR VEHICLE: 28
(I) WAS REGISTERED AS A HISTORIC MOTOR VEHICLE UNDER § 29
13–936 OF THIS ARTICLE BEFORE JULY 1, 2025; AND 30
(II) ON OR AFTER JULY 1, 2025, NO LONGER QUALIFIES AS A 31
HISTORIC MOTOR VEHIC LE SOLELY AS A RESUL T OF THE CHANGE TO T HE 32

DEFINITION OF “HISTORIC MOTOR VEHIC LE” ENACTED BY CHAPTER 604 OF THE 1
ACTS OF THE GENERAL ASSEMBLY OF 2025. 2
(2) IN ORDER TO QUALIFY F OR AN EXEMPTION UNDE R PARAGRAPH 3
(1) OF THIS SUBSECTION , THE OWNER OF THE MOT OR VEHICLE SHALL CER TIFY 4
THAT THE MOTOR VEHIC LE WAS REGISTERED AS A HISTORIC MOTOR VEH ICLE 5
UNDER § 13–936 OF THIS ARTICLE BEFORE JULY 1, 2025. 6
(3) THE CERTIFICATION REQUIRED UNDER PARAGRAPH (2) OF THIS 7
SUBSECTION SHALL BE MADE ON A FORM PROVIDED BY THE ADMINISTRATION. 8
(E) The Administrator may adopt regulations as necessary to administer or 9
enforce the provisions of this section. 10
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect July 11
1, 2026. 12
