(D) “SUPERVISION” MEANS THE RESPONSIBI LITY FOR IMMEDIATE 4
AVAILABILITY OF THE DIRECTING ANESTHESIO LOGIST FOR CONS ULTATION AND 5
DIRECTION OF THE ACTIVITIES OF THE ANESTHESIOLOGIST ASSISTANT, INCLUDING: 6
(1) PHYSICAL PROXIMITY THAT ALLOWS THE ANESTHESIOLOGIST TO 7
REESTABLISH DIRECT CONTACT WITH THE PATIENT TO MEET MEDICAL NEEDS AND 8
ANY URGENT OR EMERGENT CLINICAL MATTERS; AND 9
(2) PERSONAL PARTICIPATIO N BY THE DIRECTING 10

SERVICES PROVIDED TO ANESTHESIOLOGIST ASSISTANTS. 15
(B) (1) THE BOARD SHALL PAY ALL F EES COLLECTED UNDER THE 16
PROVISIONS OF THIS SUBTITLE TO THE COMPTROLLER. 17
(2) THE COMPTROLLER SHALL DIS TRIBUTE ALL FEES TO THE 18
BOARD. 19
(C) THE FEES SHALL BE USE D TO COVER THE ACTUA L DOCUMENTED 20
DIRECT AND INDIRECT COSTS OF FULFILLING THE STATUTORY AND RE GULATORY 21
DUTIES OF THE BOARD AS PROVIDED BY THIS SUBTITLE. 22

(2) SUBMIT AN APPLICATION TO THE BOARD ON A FORM THAT THE 26
BOARD REQUIRES; 27
(3) SUBMIT TO THE BOARD ANY ATTESTATION OR DOCUMENTATION 28

LICENSE IS RENEWED F OR AN ADDITIONAL TER M AS PROVIDED UNDER THIS 5
SUBTITLE. 6
(B) AT LEAST 1 MONTH BEFORE THE LICENSE EXPIRES, THE BOARD SHALL 7
SEND TO THE LICENSEE A RENEWAL NOTICE THAT STATES: 8
(1) THE DATE ON WHICH THE CURRENT LICENSE EXPIRES; 9
(2) THE DATE BY WHICH THE RENEWAL APPLICATION MUST BE 10
RECEIVED BY THE BOARD FOR THE RENEWAL TO BE ISSUED AND MAI LED BEFORE 11
THE LICENSE EXPIRES; AND 12
(3) THE AMOUNT OF THE RENEWAL FEE. 13
(C) THE BOARD SHALL RENEW THE LICENSE OF A LICENSEE WHO: 14
(1) IS OTHERWISE ENTITLED TO BE LICENSED; 15
(2) PAYS TO THE BOARD THE RENEWAL FEE SET BY THE BOARD; 16
(3) SUBMITS TO THE BOARD: 17
(I) A RENEWAL APPLICATION ON THE FORM THAT THE BOARD 18
REQUIRES; AND 19
(II) SATISFACTORY EVIDENCE OF COMPLIANCE WITH A NY 20
CONTINUING EDUCATION REQUIREMENTS AND OTHER REQUIREMENTS SET UNDER 21

EXCEED 12 MONTHS AS SET BY THE BOARD IN REGULATION. 9
(C) A TEMPORARY LICENSE AU THORIZES AN INDIVIDU AL TO PRACTICE 10
SUBJECT TO THIS SUBTITLE AND REGULATIONS ADOPTED BY THE BOARD. 11

(A) THE BOARD SHALL ADOPT REGULATIONS ESTABLISHING AN EXPEDITED 13
LICENSURE PROCESS FOR AN APPLICANT WHO HOLDS A CURRENT, ACTIVE LICENSE 14
AS AN ANESTHESIOLOGI ST ASSISTANT IN GOOD STANDING IN ANOTHER 15
JURISDICTION THAT THE BOARD DESIGNATES BY REGULATION. 16
(B) AN APPLICANT FOR EXPE DITED LICENSURE MUST MEET ANY 17
VERIFICATION, MORAL CHARACTER , AND CRIMINAL HISTORY RECORDS CHECK 18
REQUIREMENTS ESTABLISHED BY THE BOARD. 19
(C) THE BOARD MAY REQUIRE EVIDENCE OF SUBSTANTIALLY EQUIVALENT 20
EDUCATION, TRAINING, AND EXAMINATION FOR AN APPLICANT FOR EXP EDITED 21
LICENSURE UNDER THIS SECTION. 22

AND OBTAINING DRUGS AS DIRECTED BY THE SUPERVISING ANESTHESIOLOGIST; OR 7
(2) PROHIBIT A STUDENT AN ESTHESIOLOGIST ASSIS TANT WHO IS 8
ENROLLED IN A PROGRA M ACCREDITED BY THE COMMISSION ON ACCREDITATION 9
OF ALLIED HEALTH EDUCATION PROGRAMS, OR A SUCCESSOR ORGAN IZATION, 10

(II) IS NOT SUBJECT TO PREAPPROVAL; AND 29

(29) VIOLATES ANY PROVISIO N OF THIS TITLE OR A NY RULE OR 18
REGULATION PERTAINING TO ANESTHESIOLOGIST ASSISTANTS THAT IS ADOPTED BY 19
THE BOARD, THE STATE, OR THE FEDERAL GOVERNMENT. 20
(B) EXCEPT AS OTHERWISE P ROVIDED IN THE ADMINISTRATIVE 21
PROCEDURE ACT, BEFORE THE BOARD OR A DISCIPLINA RY PANEL TAKES ANY 22
ACTION UNDER SUBSECTION (A) OF THIS SECTION, IT SHALL GIVE THE INDIVIDUAL 23
AGAINST WHOM THE ACTION IS CONTEMPLATED AN OPPORTUNITY FOR A HEARING 24
BEFORE THE BOARD OR THE DISCIPLI NARY PANEL IN ACCORD ANCE WITH THE 25
HEARING REQUIREMENTS OF § 14–405 OF THIS TITLE. 26
(C) (1) ON THE FILING OF CERTIFIED DOCKET ENTRIES WITH THE BOARD 27
BY THE OFFICE OF THE ATTORNEY GENERAL, A DISCIPLINARY PANEL SHALL ORDER 28
THE SUSPENSION OF A LICENSE IF THE LICEN SEE IS CONVICTED OF OR PLEADS 29
GUILTY OR NOLO CONTE NDERE WITH RESPECT T O A CRIME INVOLVIN G MORAL 30
TURPITUDE, WHETHER OR NOT ANY APPEAL OR OTHER PROCEEDING IS PENDING TO 31
HAVE THE CONVICTION OR PLEA SET ASIDE. 32

(2) AFTER COMPLETION OF T HE APPELLATE PROCESS , IF THE 1
CONVICTION HAS NOT BEEN REVERSED OR THE PLEA HAS NOT BEEN SET ASIDE WITH 2
RESPECT TO A CRIME INVOLVING MORAL TURPITUDE , A DISCIPLINARY PANEL 3
SHALL ORDER THE REVO CATION OF A LICENSE ON THE CERTIFICATION BY THE 4
OFFICE OF THE ATTORNEY GENERAL. 5
(D) (1) IF, AFTER A HEARING UNDE R § 14–405 OF THIS TITLE , A 6
DISCIPLINARY PANEL FINDS THAT THERE ARE GROUNDS UNDER SUBSECTION (A) OF 7
THIS SECTION TO SUSPEND OR REVOKE A LICENSE, TO REPRIMAND A LICENSEE, OR 8
TO PLACE A LICENSEE ON PROBATION, THE DISCIPLINARY PAN EL MAY IMPOSE A 9
FINE SUBJECT TO THE BOARD’S REGULATIONS IN ADD ITION TO SUSPENDING OR 10
REVOKING THE LICENSE , REPRIMANDING THE LIC ENSEE, OR PLACING THE 11
LICENSEE ON PROBATION. 12
(2) THE BOARD SHALL PAY ANY F INES COLLECTED UNDER THIS 13
SECTION INTO THE GENERAL FUND OF THE STATE. 14
(E) IN ADDITION TO ANY SA NCTION AUTHORIZED UNDER THIS SECTION , A 15
DISCIPLINARY PANEL MAY REQU IRE A LICENSEE TO CO MPLY WITH SPECIFIED 16
TERMS AND CONDITIONS DETERMINED BY THE DISCIPLINARY PANEL. 17

(A) (1) ANY PERSON AGGRIEVED BY A FINAL DECISION OF THE BOARD OR 19
A DISCIPLINARY PANEL UNDER THIS SUBTITLE MAY TAKE A DIRECT JUDICIAL 20
APPEAL. 21
(2) THE APPEAL SHALL BE M ADE AS PROVIDED FOR JUDICIAL 22
REVIEW OF FINAL DECISIONS IN THE ADMINISTRATIVE PROCEDURE ACT. 23
(B) AN ORDER OF THE BOARD OR A DISCIPLINA RY PANEL MAY NOT BE 24
STAYED PENDING REVIEW. 25
(C) THE BOARD MAY APPEAL FROM ANY DECISION THAT REV ERSES OR 26
MODIFIES AN ORDER OF THE BOARD OR A DISCIPLINARY PANEL. 27
SECTION 2. AND BE IT FURTHER ENACTED, That, on or before October 1, 2027, 28
the State Board of Physicians shall adopt regulations necessary to carry out this Act, 29
including establishing the date by which the Board shall begin accepting applications for 30
licensure under this Act. 31
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect 32
October 1, 2026. 33
