AN ACT concerning 1

Land Use – Historic Preservation Commission – Right of Appeal 2

FOR the purpose of authorizing a local jurisdiction to authorize any person aggrieved by a 3
decision of a historic preservation commission to appeal the decision to the board of 4
appeals of the local jurisdiction or the appropriate circuit court; and generally 5
relating to the right to appeal a decision of a historic preservation commission. 6

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 12
That the Laws of Maryland read as follows: 13

(A) Any person aggrieved by a decision of a commission may appeal the decision 16
in the manner provided for an appeal from the decision of the planning commission of the 17
local jurisdiction. 18

(B) IN ADDITION TO THE RIGHT TO APPEAL PROVIDED UNDER SUBSECTION 19
(A) OF THIS SECTION , A LOCAL JURISDICTION MAY AUTHORIZE ANY PE RSON 20
AGGRIEVED BY A DECIS ION OF A COMMISSION TO APPEAL THE DECISI ON TO THE 21
BOARD OF APPEALS OF THE LOCAL JURISDICTI ON, THE APPROPRIATE CIRC UIT 22
COURT, OR BOTH. 23

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect 1
October 1, 2026. 2
