Bill H.3982

SECTION 1. Section 321 of chapter 94 of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by inserting after the word “water”, in line 6, the following words:- , cannabis-infused beverages.

SECTION 2. Said section 321 of said chapter 94, as so appearing, is hereby further amended by inserting after the definition of “Bottler” the following definition:-

“Cannabis-infused beverage”, a legally distributable beverage containing cannabinoid or hemp or which has a cannabinoid profile, as those terms are defined in section 1 of chapter 94G.

SECTION 3. Section 323 of said chapter 94, as so appearing, is hereby amended by inserting after the word “distributor”, in line 15, the words:- ; provided, that a distributor shall not be required to pay any such handling fee for any cannabis-infused beverage container.

SECTION 4. Said section 323 of said chapter 94, as so appearing, is hereby further amended by inserting after the word “accepted”, in line 33, the following words:- ; provided, that a redemption center shall accept a cannabis-infused beverage container if it meets all of the requirements for a redeemable beverage container.

SECTION 5. Said section 323 of said chapter 94, as so appearing, is hereby further amended by inserting after the word “container”, in line 38, the words:- ; provided, that a distributor shall not be required to pay any such handling fee for any cannabis-infused beverage container.
