By Representative Meschino of Hull and Senator O'Connor, a joint petition (accompanied by bill, House, No. 4314) of Joan Meschino (by vote of the town) that the town of Hingham be authorized to use municipal property as the location for a center for active living. SECTION 1. Notwithstanding any general or special law to the contrary, the town of Hingham may change the use of approximately 5.387 acres of land located on a portion of the parcel shown as Assessor’s Map 77, Lot 1, off Bare Cove Park drive in the town of Hingham, as more particularly shown on that certain plan entitled “Plan showing the Delineated Limit of Development, Center for Active Living, Bare Cove Park Drive, Hingham, MA”, dated March 14, 2025, prepared by CHA Consulting, Inc., a copy of which is on file with the town clerk, and described in a deed recorded with the Plymouth county registry of deeds in book 3917, page 327, which land is under the care, custody, management and control of the select board for use as passive and active recreation, to a new use as the location for the town of Hingham Center for Active Living and uses associated therewith.

SECTION 2. As replacement for the land identified in section 1, the town shall transfer the care, custody, management and control of approximately 6.847 acres of land shown as “AREA TO BE COMBINED WITH “CONSERVATION” LOT” on the plan entitled “Approval Not Required Plan of Land, 200 High Street, Hingham, MA 02043”, dated April 15, 2025, prepared by CHA Consulting, Inc., a copy of which is on file with the town clerk, and described in a deed recorded with the Plymouth county registry of deeds in book 3354, page 260 , from the school committee to the conservation commission, to be held for conservation purposes under Article 97 of the Articles of Amendment to the Constitution of the Commonwealth of Massachusetts.

SECTION 3. This act shall take effect upon its passage.
