SECTION 1. Section 185A of Chapter 140, as appearing in the 2024 Massachusetts General Laws, is hereby amended by inserting at the end thereof the following new paragraph:--

“(c) No person shall sell or offer for sale a ticket of admission to any such theatrical admission, public show or public amusement or exhibition at a price greater than 110 percent of the price of an original ticket.”.

SECTION 2. Section 185D of Chapter 140, as so appearing, is hereby amended by inserting, in paragraph (c), in line 36, after the words “the total price.”, the following new words:--

“Licensees shall disclose to consumers that the resale price of the ticket is limited to 110 percent of the price of an original ticket by the provisions of subsection (c) of Section 185A of Chapter 140. Licensees shall not mislead consumers about the availability of tickets on that platform or on other platforms. Licensees shall not use deceptive website addresses or imply endorsement or ownership of any intellectual property of the venue or artist without explicit written authorization of the venue or artist. Licensees shall neither state nor imply that their exchange, website or reselling platform is affiliated with or endorsed by a venue, team or artist, including by using such words as ‘official’ in promotional materials, social media promotions, search engine optimization, paid advertising, URLs, or search engine monetization, unless the licensee has the express written consent of the venue, team or artist.”.
