SUBSTITUTE FOR
HOUSE BILL NO. 4415
A bill to amend 1909 PA 283, entitled
"An act to revise, consolidate, and add to the laws relating to the
establishment, opening, discontinuing, vacating, closing, altering,
improvement, maintenance, and use of the public highways and
private roads; the condemnation of property and gravel therefor;
the building, repairing and preservation of bridges; maintaining
public access to waterways under certain conditions; setting and
protecting shade trees, drainage, and cutting weeds and brush
within this state; providing for the election or appointment and
defining the powers, duties, and compensation of state, county,
township, and district highway officials; and to prescribe
penalties and provide remedies,"
by amending section 10 (MCL 224.10), as amended by 2020 PA 286.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 10. (1) The clerk and the members of a board of county 1
road commissioners are subject to 1968 PA 317, MCL 15.321 to 2

(2) The board of county road commissioners shall employ a 2
competent county highway engineer who shall make surveys ordered by 3
the board, prepare plans and specifications for roads, bridges, and 4
culverts, and exercise general supervision over construction to 5
insure that the plans and specifications are strictly followed. Two 6
or more adjoining counties may employ the same engineer, if the 7
work in 1 or more of the counties is not enough to employ the whole 8
time of the engineer. The engineer employed by the board shall be 9
is known as the county highway engineer. 10
(3) The board may also engage other professional and 11
consultant services as it considers necessary to implement this act 12
and promote efficiency and economy in the operation of the county 13
road system. The board may also employ other necessary laborers and 14
may purchase machines, tools, appliances, and materials that it the 15
board considers necessary or convenient for the performance of work 16
by the laborers. In Subject to subsection (4), in cases involving 17
the expenditure of an amount greater than $15,000.00 $75,000.00 for 18
the purchase of machines, tools, appliances, and materials, the 19
board of county road commissioners shall advertise for sealed 20
proposals for the machines, tools, appliances, and materials 21
proposed to be purchased, except under emergency conditions, in 22
which case the limit must not exceed $50,000.00. $250,000.00. All 23
purchases made under this section must be compiled separately for 24
purposes of board approval. The board shall advertise for sealed 25
proposals for the purchase of passenger vehicles and trucks 26
weighing less than 5,000 10,000 pounds. The board may purchase 27
surplus properties from the state and federal governments without 28
advertising for sealed proposals. 29

(4) For the fiscal year ending September 30, 2026, and each 1
subsequent fiscal year, the state treasurer shall adjust the dollar 2
amounts under subsection (3) by the percentage increase in the 3
Detroit Consumer Price Index for the preceding calendar year and 4
round to the nearest $100.00 increment. As used in this subsection, 5
"Detroit Consumer Price Index" means the most comprehensive index 6
of consumer prices available for the Detroit-Warren-Dearborn area 7
from the Bureau of Labor Statistics of the United States Department 8
of Labor. 9
(5) (4) Each county road commission shall take all reasonable 10
steps to ensure minority business enterprises have the equal 11
opportunity to compete and perform contracts or purchases of 12
services, or both, for the county road commission. The county road 13
commission shall issue a plan for implementing this subsection. 14
(6) (5) A county road commission may enter into a contract or 15
agreement for the purchase of real or personal property for public 16
purposes, to be paid for in installments over a period not to 17
exceed 30 years or the useful life of the property acquired, 18
whichever is less. Real or personal property purchased under this 19
act may serve as collateral in support of the purchase, contract, 20
or agreement. 21
