HOUSE BILL NO. 4551

A bill to amend 1965 PA 203, entitled
"Michigan commission on law enforcement standards act,"
by amending section 3 (MCL 28.603), as amended by 2016 PA 289.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 3. (1) The Michigan commission on law enforcement 1
standards is created to carry out the intent of this act. The 2
commission is transferred as a type I transfer pursuant to section 3
3 of the executive organization act of 1965, 1965 PA 380, MCL 4
16.103, to the department of licensing and regulatory affairs. 5

(2) The commission consists of the following members: 1
(a) The attorney general, or his or her the attorney general's 2
designated representative from within the department of attorney 3
general. 4
(b) The director of the department of state police, or his or 5
her the director's designated representative who is a police 6
officer within the department of state police. 7
(c) The chief of a police department of a city that has a 8
population of more than 600,000, or his or her the chief's designee 9
who is a command officer within that department. 10
(d) The following members appointed by the governor, subject 11
to the advice and consent of the senate under section 6 of article 12
V of the state constitution of 1963, as follows: 13
(i) Three individuals nominated by the Michigan Association of 14
Chiefs of Police. 15
(ii) Three individuals nominated by the Michigan Sheriffs' 16
Association. 17
(iii) One individual nominated by the Prosecuting Attorneys 18
Association of Michigan. 19
(iv) One individual nominated by the Criminal Defense Attorneys 20
of Michigan. 21
(v) One individual nominated by the Michigan State Police 22
Troopers Association. 23
(vi) One individual nominated by the Michigan chapter of the 24
Fraternal Order of Police. 25
(vii) One individual nominated by the Police Officers 26
Association of Michigan. 27
(viii) One individual nominated by a police association not 28
otherwise represented on the commission representing law 29

enforcement officers employed by a law enforcement agency employing 1
more than 10% of the police officers in this state. 2
(ix) One individual nominated by the Police Officers Labor 3
Council of Michigan. 4
(x) One individual nominated by the Michigan Association of 5
Police. 6
(xi) One individual nominated by the Deputy Sheriff's 7
Association of Michigan. 8
(xii) One non-law enforcement individual representing the 9
public. 10
(3) The terms of the members of the commission who were 11
previously appointed by the governor and serving on the commission 12
on the effective date of the amendatory act that added this 13
subsection January 2, 2017 expire on the effective date of the 14
amendatory act that added this subsection.January 2, 2017. 15
(4) Not more than 90 days after the effective date of the 16
amendatory act that added this subsection, later than April 2, 17
2017, the governor shall appoint members to the commission as 18
provided in subsection (2)(d). 19
(5) The governor may appoint any individual meeting the 20
membership requirements of the organizations listed in subsection 21
(2)(d)(i) to (xii) if the organization permitted to nominate an 22
individual to the commission fails to provide a nominee not less 23
than 30 days before a vacancy created by the expiration of a term, 24
or not less than 30 days after the effective date of any other 25
vacancy. 26
(6) An individual selected under subsection (2)(d) shall serve 27
as a commission member only while serving as a member of the 28
organization that submitted his or her the individual's name to the 29

governor for appointment. 1
(7) Members of the commission appointed or reappointed under 2
subsection (2)(d)(i) to (xii) shall must be appointed for a term of 4 3
years. except that, of the members first appointed to the 4
commission, 6 shall serve for 1 year, 5 shall serve for 2 years, 5
and 5 shall serve for 3 years. 6
(8) The expiration dates of appointments under subsection 7
(2)(d) shall be are December 31 of the calendar year in which they 8
expire. 9
(9) A vacancy on the commission occurring other than by 10
expiration of a term shall must be filled by the governor in the 11
same manner as the original appointment for the balance of the 12
unexpired term. 13
